I think it's fair to say when a version of iOS is end of life, that some services for those versions might expire as well.
It's their hardware/software, they're free to do what they want in my opinion. if we don't like it, we can go to another company.

That said, if it is working and working fine, it's hard to say that when there's no visible reason that my iPhone 5 with IOS6 would suddenly stop working for FaceTime.

That's all I have to say about it. This doesn't affect me right now, and I think it's fair to say it's a bit silly to still run iOS6

I think the lawsuit has no merit. Everything with Apple is proprietary and people come into the ecosystem knowing this. Besides at that time Skype could be used as an alternative. I know FaceTime is more convenient and I prefer it over Skype myself especially with friends and family that have Apple devices but there is another option.

It's like Windows XP. Sure Internet Explorer is left behind (very dangerous!) but you can download Chrome or Firefox. If you choose to use obsolete discontinued software you really cannot complain. I understand that the features it came with should continue to work but there are patent licenses and oftentimes other IP that is only licensed for a limited time. For example the native YT app doesn't work on any iOS 5 device and below nor does it work on ATV2 or earlier nor many smart TVs that cost thousands at the time of purchase.
[doublepost=1501532071][/doublepost]This is the reality with digital things. You really only license them. You never really own them. This is why I still like to purchase physical PS4 games and Blu-rays/DVD. I own them. A digital store can shut down at any time and then what? What's to say that PSN will keep providing the digital games they're selling now on their servers?

My conclusion, your idea is absolutely stupid and with destroy financial incentive for developers to create companies thus killing startup culture in the United States. The effect of this would kill small businesses and allow and reward large companies for stealing code from small companies.

If you're solution to fix copyright and patent legislation can be summed up in a sentence, the idea is stupid and useless and should be outright dismissed. Further, that kind of stupidity should ban you from voting because people who say stupid crap like that vote idiots into public office.

I think you need some ice, I heard the south pole is nice.

So people are suing over something they could've fixed themselves by upgrading, but because they felt like not doing so they want to get money from Apple?

Don't get me wrong, there have been legitimate law suits against Apple, but at this point it has become ridiculous. Apparently everybody wants a piece of the cake now.

Forced obsolescence... it would appear apple deliberately cut off those users unless they bought a new device. That's wrong on every level.

But FaceTime was a feature ON ios6 and the 4s was marketed as having it. By law, said device must have that feature or it's false advertisement.

The feature is available on iOS 7 and worked on iOS 7. They even made sure that the iPhone 4 received 7 in order to keep FaceTime. In fact I still have both an iPhone 4s and an iPad 2 on 9.3.5 and FaceTime is still working. Sure the device is obviously much slower than on iOS 5 or 6 but to say that the feature has been removed is just false. Besides using iOS 6 is a huge security risk by this point.

I'm surprised there isn't some brief, obscure, size-4 font legal jargon in the iOS EULA that covers Apple deactivating certain iOS services in obsolete/prior iOS versions.

Are you freaking kidding me? I had an iPhone 4 way back then. Since when was "upgrading to iOS 7 not an option"?! There are always a bunch of whiners who don't want to upgrade something, no matter what. Included with iOS 7 were numerous security fixes and the (now realized) knowledge that FaceTime was more securely being routed through Apple's own servers. Many of these obstinate complainers probably didn't want to bust their iOS 6 jailbreak they had at the time.

Apple SHOULD be sued for allowing 4 and 4S users the ability to upgrade to iOS7 because it all but breaks their device. They knew it would ruin those phones and knowingly allowed them to be upgraded anyway. At the very least, they should have said "Upgrading to iOS7 will severely hinder the performance of your device and cause serious issues that may become bothersome."

I had an iPhone 4, and iOS 7 did not break my device. I don't recall a noticeable degradation in my phone's performance from 6.x to 7.x. I used iOS 7 on that iPhone for almost 1.5 years before moving to my iPhone 6 (which I'm currently using with 100% satisfaction on iOS 10.3.3).

So, I don't know about "They knew it would ruin those phones." Seems more a matter of fear/opinion than one of established fact. He said/she said.

I don't know of a single developer who would post a notice to the effect of, ""Upgrading to iOS7 will severely hinder the performance of your device and cause serious issues that may become bothersome." If things were knowingly that bad, they'd simply declare that version of the app/OS to be incompatible. It's why iOS 7.1.2 was the last version to be offered for iPhone 4.

The thing is, you see claims/counter-claims of OS "breaking" hardware for every new version of every new OS (and my memory goes back to the early days of MS DOS). Yeah, eventually the new features added to an OS can't be supported on hardware built to run older versions of the OS. That's the normal push-pull of software/hardware development, not some isolated exception.

Your correct. Consumers expectations of backward compatibility are no longer realistic. There will always be the push from corporate to have you upgrade. However, hardware is also moving at such a rapid pace I doubt most want their iOS taking up 10gb on their devices either.

You can't always have your cake and eat it to. :apple:

This is an example of a juridical process taking so long, that its outcome has become obsolete.
It won't change anything - and particularly not deter corporate arrogance to do these things again and again and again. People will be bought off with some virtual lollipop iTunes bonus.
Other example: an import ban for a 4 year old device.

Not everyone would have been able to upgrade; a limited number of devices were unable to upgrade beyond iOS 6 so those owners would have had to buy a whole new device just to keep using the service. Otherwise, you're right though.
while it is true that there are iPhones not capable of higher than ios6 support those iPhones all also lacked the camera required for FaceTime to work in the first place. ie original iPhone the 3g and the 3gs. all iPhone 4 could go up to 7.1.2 and the 4s could go up to 9.3.5 thus the point you are trying to make doesn't even count in this case and no they wouldn't have to buy a new device for FaceTime to work again

Happy for apple to outdate features as long as they they us install previous versions of iOS . As it stands , I agree with the lawsuit . Apple is looking after its own $$$$$
As they should. Apple is for profit corporation, not charity. As a shareholder I'd not be happy with company payment of 50 million dollars a year for 5 dudes that are not willing to update. It's a problem that Apple provided with simple solution. If one doesn't like a solution it's fine as long as they are willing to pay for their own. They never been promised that all functions stay forever. So what is this lawsuit about?

People were happy to keep the old iOS, but Apple decided to kill a feature out from under them. People paid for that feature when they purchased the phone. So rather than actually fix their issue with VirnetX, they killed it. Every update Apple forces upon older models cripples the device further and further. It's been shown time and time again that every update makes your device run slower and slower. I for one am looking forward to my piece of the settlement.

Totally agree. I bought a a Mac Book Pro 2009, updated every update. Had to stop using it and buy a new MBP 2015--old one got so slow it took 30 secs just to open Preview.

Bought a Mac Mini late 2012 dual core 2.3Ghz i7, never updated beyond Yosemite, still runs as flawlessly today and blindingly fast just like the day I bought it.

Did the same thing with an I-Pad v.1 --haven't updated in years--runs fine, surf web, email, Kindle, movies, WP Office, Sketchbook it's good enough for me.

if people want the latest and greatest, go for it, but some of us don't need it and it's unfair to make our purchases unusable just because you want to become the world's richest company.

Remember when Mac OS updates cost money? Like a $100 or so? Now you know why they're free now. Renders your hardware obsolete. My grandmom still has a refrigerator that's like forty years old. Imagine if you were forced to buy a new refrig every five years, or washing machine, or car or bicycle.

While I'm against lawsuits like trolling, etc. This one is no exceptional...

I'm siding with lawsuit on this one. Apple broke the FaceTime software because my mother in law iPhone 4s at that time couldn't FaceTime with my daughter. Apple should've known better not to screw us customers.

This should be dismissed. Why is this woman wasting the courts time with non-sense. She is literally wasting tax payer dollars.

The real reason for iOS 7 was to kill off all the G5 users running 10.5 Leopard, and force us to buy a new computer to run iTunes 11, which is what I had to do.

They keep doing this every two or three years to force upgrades. I recently had to go from iOS 8 to iOS 10 and then I had to buy another computer to run El Capitan because the last computer could only go to Lion.

When iOS 12 or 13 comes out I'll have to buy another computer again since El Capitan is the last MacOS I can run.

I felt that iOS 7.1 was still slower than iOS 6, but my 3.5" iPhone 4 got a whole new life because iOS 7 took up so much less screen space at the top and bottom that there was way more room for content.

Also, with such a huge change in UI, I knew that third party apps would drop iOS 6 support as soon as possible, and didn't want to get left behind for all the app updates.

For security, it's a really bad idea staying on old devices. My view is, iOS gives you the unprecedented ability to have a secure and up to date phone for about 3-5 years. Ammortise the cost of the phone accordingly.

The problem with the iPhone 4 was that it didn't last as long as other devices, since it came out right before Apple CPUs went multicore, so it was outclassed by its successor to a greater deal than most generations. But anyone saying an iPhone 4s couldn't handle iOS 7 is just wasting the court's time.

This is about software from over a decade ago.
Over a decade ago? That's funny because the iPhone just turned 10.
You're saying these 4-5 year old phones were running pre-release software?

It's a legit claim. Apple stripped out a key feature due to costs. Pure and simple.
And forcing the upgrade to iOS7 may fix the FaceTime issue, but at a cost of a slew performance issues.

People keep saying "upgrade" but in many ways iOS 7 was in fact a downgrade from iOS6. Even if the performace hit on some devices wasn't a thing (and it absolutely IS a thing) the user interface is a massive downgrade that Apple STILL hasn't fixed.

Care to explain? Or are you just going to go with an empty comment about the user interface being a downgrade? What was the change that drove you mad?

OMG!!! All the whiners out there!!!

When a computing device is created it has a certain amount of "power", if you will. The hardware has the capability to run software that makes certain demands of it. As software improves, it requires more powerful hardware.

When that hardware becomes outdated, it will not run newer software with the same quality that it used to. Or it will not run some software at all.

It is the same with computers (Windows or macOS), GPS for your car, media players… the list goes on and on. Stop beeching, update the OS and live with the reduced performance or buy a new damn iPhone.
