My guess is that they'll take the Apple way out and offer 'X months free' to whatever subscription service they have.

I'm not a tax attorney by any measure, but I believe a company can claim both what you and I theorize as a settlement as a tax write-off. Think it's called "an ordinary and necessary business expense."

Fines or penalties aren't deductible however, at least not to my knowledge.

They've attached "built for Apple Intelligence" to things that were designed and released before it was even a going concern of theirs.

It's gaslighting to make it look like this was all a grand plan, as opposed to what really happened -- getting caught with shorts off when the tide went out.
Just noticed notification from Apple Store to buy 16 pro because ‘it’s built for Apple intelligence’. Guess technically not misrepresenting.

No way they are going to offer free services instead of a partial refund IMO. They are going to want to get out from under this early.
Anyway, the attorneys would not even accept that offer.

We'll have to see what happens.

Opposing counsel can reject the settlement of free services under the argument that said settlement doesn't fully address the harm(s) caused by the misrepresentation, however that burden of proof is then upon opposing counsel to effectively argue.

That was one of the worst ADs I've ever seen. The fact that it made it past concept stage, all the way to production and release shows that something is SERIOUSLY wrong inside Apple.
If the wife was relying on Siri to remind her of the husbands birthday... :rolleyes:

Leonardo DiCaprio STILL uses an iPhone SE 1 in 2025. Even celebrities prefer practical iPhones without gimmicks.
Why won't Apple follow this? Ditch Siri and Apple Intelligence and go back to useful iPhones.

And of course back to real advertisements with finished products. Because right now Apple is severely mismanaged.

There's the Gemini app for iOS but as you know, Apple has system integration locked down to Siri, which everyone else knows, is pure garbage.

The lawsuit was filed in a San Jose, California court and the plaintiffs are seeking class action status along with damages for customers who purchased an Apple device that supports Apple Intelligence.

No need to argue about it, but I’m sure there are plenty of people there who don’t even use their services. Makes no sense.
 
Who purchased those phones for those features? No one, that's who. This won't of no where
Feel free to exclude yourself from the class action if it comes to that.
I run iOS betas and I bought the 16 Pro so I could run the intelligence… So there’s at least one of us 😉.
Otherwise, I was plenty happy with my 13 Pro and would have kept using that.

People are ridiculous defending Apple for this. The point of the whole topic is that Apple pushed the hell out of AI as THE SELLING POINT of the iPhone 16 series (along with almost every product this cycle). It now appears to be almost certain that these features will not arrive until the iPhone 17 series (and probably post-launch). It could have been any other feature. It just happened that they false advertised AI to drive sales. Mentioning it at WWDC is one thing. Putting it in EVERY SINGLE ad for your products as the tag line is another.

Enough with the individualistic overkill, where people want to blame individuals for being deceived. Oh, someone robbed you? That’s your fault for being an idiot and not protecting yourself. Should have known there are thieves out there. /s

The most shameless, disgraceful, die-hard Apple defenders will respond to you like this: "Where exactly did you see Apple promise any specific features? Where did they promise a release date?"
They’ll accuse you with anger and indignation, as if you’ve personally offended them.
 
iPhone 19 if you can make it. It will still be cactus come the 17, generally improve during the 18 and be better but not great for the 19. After all, if you've followed Apple for 40 years you know that non-exciting product maintenance and improvement is not their forte.
