They *might* have, had they released a successful iPhone-Killer. Didn't happen.

List of failed iPhone-Killers:

LG Voyager, HTC Touch, BlackBerry Bold, Samsung Omnia, Sony Ericsson Xperia, BlackBerry Storm, Palm Pre, BlackBerry Storm 2, Motorola Droid, Google's rebadged HTC Nexus One... Next?!

Most of which best the iphone in almost every feature! I offer up the nexus one for example... care to dispute that fact!?

Sure, I'll concede that. It's just a POS with tech that Apple obsoleted overnight.

Now let's discuss HTC's post-June 2007 knockoffs.

I didn't know the iPhone had a trackball.

Or are you just saying a large screen phone is a knock off now. OR are you blaming Google for copying the iPhone?

I am amazed how many claim companies are copying the iPhone. WebOS, Android and Windows Mobile 7 all do things differently that separate their OS from the iPhone OS.

Down with our Patent system! Apple, or anyone for that matter, should only be able to go after companies who outright copy hardware design/software and not generic features like 'use fingers to touch screen'. If HTC made an exact, code stripped, OSX iphone clone then sure sue the crap out of them, otherwise ****.

And for those who keep insisting Apple invented everything first you are wrong, smartphones and touch UI were around long before 2007. Sure they made one better (arguably) but that doesn't mean Nokia, Palm etc don't hold any sort of patents on tech that didn't get utilized as well as the iPhone.

You can implement Apple's patents - and if you're not Apple, there's a good chance you'll mess it up.

You'll end up with a bad iPhone copy. Which is what the Nexus One is.

So you have never, ever had one in your hands.

If the Nexus One is a copy of the iPhone, the current range of MacBook Pros must be a copy of older Sony and Fujitsu-Siemens computers.

But hey, if other companies can only mess it up, than there is no reason for Apple to worry. Right? What's the hassle then?

So how is it ok for apple to use a GSM radio in there phone? Do they just pay the patent holder?

One would assume.

And apple iphone was innovative in 2007... not so much now... everything is surpassing it...

If by "everything" you mean "nothing yet," I agree. The market so disagrees with you it's amazing you could write what you wrote with a straight face.

This is probaly why apple is mad. They are getting beat at their own game

And no evidence to back up those statements.

Seems to me some competition shows up and Apple can't stand that so must sue. Multitouch has been around long before the iphone. Microsoft had it on surface years before the iphone ever showed up.
I'm rather disappointed at apple for this. I would have thought better of them than to resort to these petty tactics.

The only people marketing "iPhone killers" are the news outlets....and i'm sick of it.

Think of it this way...you know what the iPhone was a killer of? The Razr. Yes, the iPhone is the Razr killer.

People will be waiting a long time for a phone to receive as much general consumer hype as the iPhone received. The iPhone also has the HUGE benefit of being an iPod. That reason alone means there will always be people who want to stick with a version of an iPhone.

Nexus One is not sweeping the market though. I like it except that it doesn't give you enough memory for really big apps.

Sorry I mean surpassing in features/tech... Nothing can surpass apples marketing machine.

I proved you wrong. It was designed before the iPhone was announced. How the hell is it a ripoff? You can't rip off something that doesn't exist.

Most of your several posts about disclosure of a patentable idea and its legal implications are not correct. Even if HTC did disclose (reveal) a patentable idea prior to Apple's, they still have to get the patent application submitted (you have a year in the U.S.). Simply disclosing it means nothing.

Hopefully cmaier will spend a little time some day and provide us all with some patent basics, so we don't have to read the same misinformed opinion every time a patent story comes up. If he has free time.

Wanna know what this is really about ?

It's about "Multipoint touchscreen"

It's Apple patent.

Right then children sit down we have a treat for you today.

Today we are going to yet again play your old favorite game, sue and counter sue, lets see who can come up with the most ridiculous reason for suing and then lets see how much money is the highest we can sue for......

Another day, another reason for Apple to stop the industry moving forward with some pathetic load of BS. It's quite funny when you think Palm stated they have a very large thick book full of patent infringements the iPhone has made against them, they were even egging Apple on at one point to just try and sue and see what happens lol, Funnily enough Apple backed off I do believe  Scared of some of it's own medicine I guess?

Sorry I mean surpassing in features/tech... Nothing can surpass apples marketing machine.

OK, thank you for clarifying. Well, I guess we'll disagree. I like my multitouch, multitasking Apple device more than any other feature set I've seen. If you prefer other feature sets, that's fine. That's what an open market is for.

It's first to invent, not first to file. Given that both were designed in secret, it's hard to say who was the first to invent, but the fact HTC revealed it first is in their favor.

Common misconception, Any dev worth their weight know to put system file on the nexus one system memory and offload the other stuff onto the sdcard... I have games with 500mb on my card and the other 20-40mb on the system...

Nexus One is not sweeping the market.... doesnt mean it doesnt surpass the iphone in software and hardware features...

Agreed. The most disgraceful thing about this is the unlock patent, which was issued only one month ago. Now I understand that this patent may have been in process for some time - it's not as if Apple applied for it February 1st and got it on the 2nd. However, it's still patently (har har) obvious that this was something they patented only after seeing other companies implement it so that they could then go and sue. In other words, when HTC first implemented the feature, Apple clearly didn't hold a patent for it if it was just granted on Feb 2nd. They're taking out patents on stuff that everybody's already using but nobody has thought to patent yet, just so they can file litigation.

That's hardly "protecting their innovations."

go get em

How can anyone give this a negative review? Good for Apple defending their patents - they spend MILLIONS on R&D, they have every right to protect their investment.

Just the opposite, really. Apple is only suing those who copy them. Those who move the industry forward (by definition the opposite of copying) are being left alone.

57MB big enough?

http://www.hyperdevbox.com/exzeus-android/
IMPORTANT NOTICE :

. This game will download an additional 57MB data package from the internet and install it on your sdcard.

Android apps can use the SD card to store assets. Only the executable (APK) needs to be on the main memory.

It's about "Multipoint touchscreen"

It's Apple patent.

I'm fairly positive that current touchscreen phones use ea different algorithm than the iPhone. (at least from what i've read).

Much like Microsoft Surface was doing multi-touch in a different way I don't think this patent would hold.

Esp. since multi-touch panel is not a new tech....just a new consumer tech.

But if this is honestly the case, why not go after Palm as well?

How can anyone give this a negative review?

Lots of Microsoft (and other companies) astroturfers go all over the Net looking for reasons to push the party line on Apple, or any other company in competition with Microsoft. These Mac forums are no exception, which is why you see any contentious article get ripped by these astroturfers pretending to be Apple fans. They also vote negative.

And apple iphone was innovative in 2007... not so much now... everything is surpassing it...

In hardware, marginally (which is going to happen back and forth.) In software, not even close.

The iPhone User Experience is still the Gold Standard. With Apple about to up the ante in June, it'll be business as usual in terms of iPhone success.
