If you've paid the 13th month then presumably you're signing up for another year and you'll get your next one after only 11 payments.
That is not how it works.

And I spend 60 minutes on the phone with Apple to clarify this. If you wait 13 months, then you are one month short, if you want to get the next iPhone at launch, you have to pay the extra month to be eligible for it at launch, otherwise you have to wait until a month after it is released.
 
As long as the lawsuit does not affect my Verizon preorder date of 9/23 they can sue all day long. Lesson learned is don't do the iPhone upgrade plan through Apple.
I got a S7 on Verizon's yearly upgrade plan and had no problems trading that sucker in for a iPhone 7 Plus online, just had to pay early to get out. But for Apple to screw these first adopters like that is amazing to me. I would figure that those folks would have first shot at the phones.

that is one thing with the upgrade program that i don't like which is, i understand why i have to pay off the rest of the year to get an iphone, but if i paid 13 months than i should get a 1 month discount as well.

that should be the class action law suit.
 
Well.. I'm part of the Apple Upgrade Program and wasn't able to reserve a phone. I'm not complaining though since I was indeed late (10 mins.) in getting in the site to reserve a phone.

Unfortunately it is really a bit on an issue since we are subscribed to Apple for the phone so it'll be good to have some privileges (at least some reserved stock, or as others have suggested to have at least something in advance to inform Apple that we would want to opt in for an exchange).

Plus unlike others we can only get our phone through Apple since we can't purchase them to other retailers (e.g. BestBuy, Target, Costco) or even to carriers (e.g. AT&T, Verizon, Sprint).

Why would you have some privileges??
You are renting a device in monthly basis, I'm paying the full price at once!!. If it were a house: I own the house, you are just a tenant. In that case I have more rights than you.

BTW. On launch day, I was pending of the store, page was not working until minute 10, take me 7 mins to verify my address, and credit card. Minute 17 I got my order mail. I have to wait 3 weeks. And I'm not going to sue, come on it's just a phone, and eventually you will have like everyone else.

Maybe I should sue ATT for system crashes that caused me to miss launch day. I have to wait until 9/26!! Unacceptable.

Who is with me? Let's class action this *****.
 
This has nothing to do with wanting priority. I am part of the program and still can't even pre-order. I just want to get in line like everyone else and we are not allowed to do so. We have to wait until they are available in stores. This is likely november for those of us who want the most popular models. I would not complain if we were allowed to get in line like everyone else. However we can't and it is costing us a payment every extra month we wait. Don't comment unless you understand the situation. This is not wanting special treatment, priority, or wishing supplies were better. We literally are losing around 100 dollars by not being allowed to pre-order.
 
This one is silly. These people have been harmed no more than any other customer that has wanted to purchase an out of stock item. Unless some promise was made about being given priority, there's no merit to this.
 
Was promised I could upgrade after 12 payments. It's clearly spelled out in the contract. You can tell this is an issue by Apple scrambling to fix the issue.

"Conditions for Upgrade Option. You may exercise your Upgrade Option to purchase a new eligible iPhone, subject to availability, under all of the following conditions:
  • Payments. You have paid the equivalent of at least twelve (12) installment payments under your Installment Loan plus any taxes and fees paid at the time of enrollment;"
It says at least 12 payments.

How exactly are you losing money? You have an iPhone to use, but its not the latest. When you finally get the new model, you can upgrade again after a year, correct? You all can't possibly think that whenever Apple happens to launch new iPhones that they have to guarantee that everyone who is on this plan can have them immediately... with Apple not having any idea what models all these people would want. This program to me is basically a perpetual lease for a phone... so you'll always being paying every month forever.
 
Or your phone exploding in your hands, burning down your car or hotel room? That has to be in the works.
Thats a great point...that's actually a safety hazard whereas this upgrade mess is a mere inconvenience. I feel like if iPhones were exploding and not Samsungs then the fallout would be much worse
 
We need some sort of special MacRumors Bingo card around here: "class action suit", "where's my updated Mac?", "no headphone jack sucks", "Android did it first", "Get rid of Timmy", "Steve would never have done this", (what ones am I missing?)

Also, how about, if you sign on to this class action suit, then Apple cannot deliver your new iPhone 7 until the lawsuit has completely played out in court, including the lengthy appeals process, because your phone is part of an ongoing court case?

There was a problem, Apple clearly failed to plan properly for this situation, and by all accounts they're now doing everything they can to rectify the problem. But some lawyers are smelling a lucrative opportunity. And some people think a lawsuit is the proper response to any inconvenience.
