I can understand the reasoning. These people are paying a fairly heavy premium for yearly access to the latest model. A simple solution for the future. Would be for Apple to open up ordering to premium members a day or two before it opens to everyone else. But limit early orders to the number of phones they currently have the requisite 12 payments on.

The only premium is Apple Care+ which is what lots of people choose to buy with their iPhone, so actually IUP customers are paying the same if not less for their iPhone. It works out at just over £400 a year for the phone, whereas buying outright would be £700+. Switch the £ to $ and it's still accurate.

Upgrading on the IUP should be an automated process. Apple should reach out to customers within a month of their 12th payment (11th in the UK) and ask what model configuration they want and which store. On pre-order day, IUP customers should get an email saying 'That's reserved for you.' stating that there's a model waiting for them at their local store. That's how it should play out in the future. Apple know how many IUP customers they have and that all of them will want to upgrade because that's the damn point of the program, there's no excuse to be under stocked for this group of people.

I like many others have said since this little fiasco first began, until Apple fully acknowledges the failure and emails everyone who was unable to place their order, they're not taking ownership of the problem. They have had since Friday to cure the tort. They're trying to keep the whole thing as quiet as possible because it's a PR disaster if the program they marketed as the best way to get a new iPhone every year turns out to be the WORST way to get an iPhone.

I just called Apple, and after 10 minutes on hold, I asked specific details about how to end my IUP participation, as in, is my phone free to sell the moment I pay it off or do I need to do something. The lady tried to sell me on giving them a second shot saying she could get me through to the IUP team but that it was a 45 minute wait to speak to someone and "things are pretty chaotic over there." She said that getting a phone by Friday wasn't looking good but she didn't really know and I should speak with the IUP team.

I told her, "Sorry, nothing personal but at this point Apple's efforts are too little, too late."

the good news is that if there is proof of the existence of agitated hostile Aliens out there, the idea to evade earth, knowing that the inhabitants are narrow minded greedy gadget freaks with no patience at all, will probably not worth the effort.
 
.. either apple breached contract or some people signed up for something and they weren't fully aware of what they were signing up for.. (which, i suppose, could add complications to the case as it could then be argued the ads were misleading)

the first bit of it doesn't seem very convincing at all.. or it pretty much say apple hasn't done anything illegal.. just that some people are upset.. but then #4 comes up:

4- This action seeks to hold Apple responsible for its misleading marketing of the iPhone Upgrade Program.

..and most of the subsequent points are regarding marketing.. so maybe a little more complex case than whether or not apple breached contract.. from what i gather, even the people doing the suing aren't challenging the contract itself.. just the marketing.

tbh, i don't think this case is going to go over so well for the boston firm.

I pretty much disagree with all the comments disregarding this lawsuit.

Sure it might seem petty but they should have been allowed to pre-order just like everyone else for pick up in store. Being forced to only pick from apple store stock is 'restricted access'. I hate lawyers but apples policy is a wrong one, you can't just ask for the change it won't happen.

Btw i dont understand the need to upgrade every year, this is the most mental part. Apple should have know they'd collected the crazy then created a storm.
 
I feel like these days....if your company is not in a class action lawsuit then you are doing something wrong.
 
We went from "this is the worst iPhone ever" and "nobody wants this iPhone" and from "Apple is doomed" or "Apple can keep it's iphone without a jack" to If I don't have it now I am sueing.....

I am with you on not understanding the need to upgrade every year, but some people feel the need to do it.

I think the lawsuit is a legitimate thing here. Apple can't just promise and advertise to all these users that they can upgrade after 12 payments and not even allow them to place orders on replacement phones. I understand supply and demand and I am not saying Apple should have phones on hand ready for all of these people at launch, they shouldn't. However, Apple needs to find a way that these people can order the phone one way or another so they can at least know on a specific date range their phone will be in and they can swap it for their current one. Allow them to purchase online like everyone else only the phone gets shipped to a specific store they pick or something like that. They shouldn't have to log in every day of the week to attempt to find a store in the area that finally has the phone they want in stock.

I think the issue most IUP users have is that for phones like the Jet Black ones that have shipping dates in November now they don't even have a way to put a place holder somewhere in that line of shipping for their own phone. Instead they are stuck having to wait it out until a store in their area gets it which could be who knows how long.

Yes and no. If you signed up purely to get your upgrade after 12 payments, but in fact you end up paying 13 to get the same upgrade that's not really OK is it?

Give it a chance! What a heck is wrong with people? If they don't get the phone on the very first day the world comes to an end?? Geeezzz!!

These people are not just missing out on launch day, they're missing out on the launch month. Or in some cases, the first two months of launch. All because they were given an unequal chance to make an order.
 
I have decided not to upgrade from my iPhone 6plus to 7s. I don't understand what the fuss is all about. Samsung's S7 edge has an OLED screen, wireless charging, and expandable memory. Features absent from the 7s. The only reason I have not moved to samsumg is because all of my computers and gadget are from Apple.

Surely you must have heard about Good Faith. Millions of consumers in good faith enrolled in the iPhone Upgrade Program with the realistic expectation that they would be able to upgrade (or at least given the fair chance to pre-order) to the next iPhone on launch date. In fact, Apple's own website seems to imply just that:

I should sue Apple because the dual camera is only on the plus model, I am so disappointed I am missing out and I am not treated like the people that get the plus
 
I wonder if Apple would announce:

Pre Order start on 9th of September.
Customer who are on iPhone Upgrade program start being server from 25th of September.
Even they can make a statement from 25th of September till 10th of October we will be honoring all our Upgrade Program subscribers....?

Wouldn't that be more normal?

They know how many subscribers they have on the iPhone program - they can build stock and align their schedule....

I was just a thought....

Anyway, I am not American, I am not defending the impatient people and I am not curious about having an iPhone on day 0 or 1 ......

I doubt if any regulations exist covering reservations of products like this on line. I expect this to be an annoyance lawsuit thrown out of court with no merit.

no she didn't.

I don't think she died (at least not right away), but she did get severe 3rd degree burns all over her legs and private part area. It was pretty bad, not just a red area on her leg for a while.
 
This is a moronic first world problem, just pure disgusting greed on the part of skumbag Lawyers looking for any stupid reason to sue and make money - and i'm in the iUP program. All these frivolous lawsuits cause so much more damage than the alleged "problems" they fix. Our insurance rates are going thru the roof because of these stupid lawsuits. Not getting an iphone on launch day is not an issue that harms anyone and I'm sure Apple will make good on any payments made in errs. The judge that allows this case to go thru needs to be put out to pasture and replaced. My life will somehow continue if I don't get the phone this friday . And guess what - COFFEE IS FREAKING HOT!!!!!

have you made 12 payments. The first 12 months won't be up until at least the 23rd or the 26th of September. Did you ready terms of the program? Eligible to upgrade after 12 months....

It's just a fact that people can actually upgrade their phone on this IUP , because my wife got is going to upgrade to the Pink 7 plus on launch day with the reservation.

Oh .. and if you actually are in the program, you will know that there is a eligiblity checking link, and it clearly state for all of the early IUP people that they are all eligibile.

This again show that you are arguing just for the sake of arguing ... get the IUP and you will know why people are upset
