I'm sorry, but that is ridiculous.

Yeah what's the damage they have suffered? Nobody is FORCING them to sign a contract to buy a phone they don't want.

Damn I wish I was a US lawyer. In Australia I reckon you'd risk having your practising certificate torn up for this kind of claim...

Who said that people were forced to sign the contract? It was the fact that such contract was not fullfilled. If people know this will happen, no one will sign the contract.
Please argue with the correct fact.

By the way, this is called customer protection. This is literally bait and switch.

I just got off the phone with a guy from the 'Executive Communications' department or whatever, basically the people you end up speaking to if you email the execs which is what a lot of us have done. He said they're so very sorry about what's happened and Tim Cook is WELL aware of the issue both in the US and in the UK. They said they really believe people will be able to get the configuration they want over the weekend and into next week, as demand becomes a little weaker. He went on to explain that Black and Jet Black models were in particular high demand and they would be prioritising these models after launch so people can get what they want eventually. He said they appreciate the feedback and that people should be assured that the highest execs in the company are well aware of what's going on and how angry people are.

He said he was certain the system would be improved for next year. I'm pretty satisfied with that answer, he knew exactly where I was coming from and I could tell the opinions he was sharing matched mine and were very candid and I'll be eagerly trying to get a reservation in for this weekend if not sometime next week, he seemed pretty confident on that.

For what it's worth, he said the Managing Director had personally forwarded my email for follow up. I didn't ask if Tim Cook had seen it too, but I'd presume not.
 
Absolutely astonished at the people saying this lawsuit is ridiculous.

People signed up to the upgrade programme on the proviso - as stipulated in the terms and conditions - that they could upgrade after x number of payments.

That they are then unable to upgrade after x number of payments means they end up paying more than they should. Why the hell shouldn't there be a lawsuit?

I hope this means Apple will shape up ahead of next year and guarantee fast track entry for upgrade programme customers.

It has nothing to do with guaranteeing a 12 month upgrade and everything to do with apple limiting the stock for upgrades and making it more difficult to find a phone. If you weren't one of the lucky people to find one available at your nearest store on release day, there is currently no way to even place an order. At the time upgrade reservations sold out (within minutes/some even seconds) non IUP people could still order online for release day delivery, and then shipping started slipping which would still be fine if we could order for 2-3 week shipping... but the point is we can't. shipping dates keep slipping further and further away and IUP people can't order their phones. They have to check their nearest apple store every day until they have their model in stock. So if Apple receives extra payments because of this, yeah its a problem. With that said, I'm not sure this was intentional and I would give Apple a chance to respond before suing them.
Sure you can get a phone... when they are available to you. OR buy one out of the program if you want it now. Your call. BUT nothing was ever guaranteed to anyone in the program.

Of course Apple will probably obfuscate, deny and parse words to deflect criticism and avoid accepting blame or error. For all of their acumen in many things, Apple has never subscribed the idea that they should acknowledge an issue and fix it quickly.
Issue a credit for the extra time that people are without their upgraded phones. They surely know how many folks are in the upgrade program with contracts due in September and October. Perhaps they should roll out the color options and not try to produce 5 different variation of each phone.
Then on the other hand, I don't expect the iPhone 7 to ignite or explode like a certain other company's phone.
 
We went from "this is the worst iPhone ever" and "nobody wants this iPhone" and from "Apple is doomed" or "Apple can keep it's iphone without a jack" to If I don't have it now I am sueing.....

These are iUP customers. They'll buy the next iPhone no matter what it is.

From the terms and conditions of the upgrade program:
  1. Eligible iPhone Availability. Purchase of a new eligible iPhone is subject to availability at the time you exercise your Upgrade Option. Depending on the eligible iPhone model chosen, your monthly installment payment may change.
Simple... if there's no phones, there's no upgrade. No bait and Switch. Just common sense. I expect when the iPhone 8 is released next year, for the first time, I won't get it on launch day because I'm in this program. I'm okay with that... I still get the option to get one.

I know, but it just seems wierd, I mean, it was supposed to be the phone nobody wanted, hence giving updaters more chances to get it..... now it seems demand was way over what estimated, hardly a bad thing for Apple, and people should understand that it is not easy to make everyone happy..
 
What exactly are you gaining by implying that you're superior to others based on the amount of money you can part with every 12 months?
None, I'm starting year 3 with my iPhone 6 on contract free Aio/Cricket.
Have no desire to downgrade to no-audio-jack-phone.

Once you've made 12 payments on the unsecured loan an individual entered into with Citizens One you are eligible to upgrade.

I have no time or patience for ******** like this. A "smart man' doesn't play money/contract games with these kind of payday loan money lenders. They aren't doing you a favor of interest free out of the goodness of their hearts.
 
I'm not in the iPhone Upgrade Program so I don't have a dog in this fight but, I find it funny how numerous posters refer to iUP members as the "most loyal" Apple customers. They're not the most loyal. They're just the ones that want a new iPhone every year. Nothing more, nothing less. iPhone might be the only Apple product they own.

When I got my 5s I didn't pre-order, didn't wait in line for hours/days I went to my local Phone retailer about 30 min before they opened and had a shiny new iPhone about an hour later in the color and size I want. No fuss no worries.
