Wow. Let's just sue Apple for everything little thing that we deem "wrong".
If this actually becomes a case, does this mean that they will go after hard drive manufacturers next, because that 1TB drive that you purchased isn't really 1TB of space?

Worst part is that Apple continues to sell 16gb devices, even in the latest generation.

Yes I know they made the 64gb upgrade cheaper by eliminating 32gb, but they should have made 32gb standard and then offered the other upgrade options to 64/128.

16gb in today's smartphones is silly, especially ones with non upgradeable memory like Apple's iOS devices.

While I understand your point, 16GB is not silly. There are many average joes that use the phone for, you know, making calls. ;)...and have no intention of storing hundreds of photos or tons of songs from their entire iTunes collection. My best friend is a musician, we both bought iPhone 6 Pluses and I got the 32GB and he got the 16GB. I told him that was a big mistake. Since release day he hasn't used even 1/2 of his available out-of-the-box storage. He came from an iPhone 4S with 16GB which he used for 3 years without issue of storage limits.

I guess returning it is out of the question

At least in the US, there is a 14 day return window to cancel all changes made to a cell phone plan and a full refund is normally given (at least at retail stores like Best Buy). Every time I sell an iPhone with only 16GB I warn the customer about that and let them make their own decision.

I only partially agree that a 16GB iPhone should be a thing of the past. Some people want the least expensive version of the newest phone and many people use it primarily as a phone/email device and don't necessarily use it store all of their media. I know many people that are more than happy with their 6 even though it only has 16GB.

The person filing suit should have tried looking at their phone beforehand and returned it to the store for a full refund and cancellation of any changes that they made to their plan.

Who wants to join me to sue microsoft with all the pc manufacturers together for not advertising that windows takes a couple of GB of my hard drive with which my computer was advertised?

The point isn't that the OS takes up SOME space, it's that it takes up to 23.1% of advertised space. Did your Windows OS take up 231GB of the 1TB drive that came with your PC? Didn't think so... ;)

Tell that to Motorola too. My Moto X 2014 16gb has only 10gb straight out of box with no means of bolstering it via micro-sd card either.

I don't understand. iOS devices have been shown numerous times to have the closest to advertised storage space of any platform.

And to everyone saying "Apple still sells 16gb devices", so does every manufacturer....

How about we move to the mobile space and talk about whose OS takes up the least amount of advertised space?

I think the real problem here is that US is just terrible when it comes to consumer protections.

Putting aside the merits of this particular suit, I do believe it would be nice if manufactures (not just Apple) said something like " *___GB Available Storage"), in smaller print, when selling a device.

It is somewhat misleading to advertise the full 16GB (or whatever), when a significant percentage of that may already be eaten up by the OS which comes installed.

Kinda have to agree with you, but some people in my area actually find having an 16 GB option fine. Not only because of its price, but also because they don't need much space. Some people even only are getting a second smartphone, or a tablet just for a specific reason. For example, I gave my (8 GB) iPhone 4 to my grandmother a few months ago. She only uses it to make photos, which are all being synced to her iPad. There aren't any other apps on the iPhone, because she uses those on her iPad.

Fair enough, isn't it? :p

But of course, it would be a smarter move to completely remove the 8 GB AND the 16 GB models, and replace them with the 32 GB model keeping the same price as for the 16 GB model. I think a lot people would agree with that. Looking forward to see what Apple is going to do with that. iOS 9 will get even bigger, might be a good reason to only release a 32 GB, 64 GB and 128 GB model starting with the next iPhone. Maybe a 16 GB option for the 'oldest' iPhone (which will be the iPhone 5s after the next iPhone is announced). Could sell well enough. :p

By the way, I by myself have an 64 GB iPhone 6. And it's the first time I have an iPhone with more than 8 GB of storage. That is a HUGE difference, I can tell. I will never go for less anymore. xD

The part I don't understand is it say's people are being pressured at important moments to buy more storage space. How does someone buy more storage space on the phone?

They should target Microsofts surface tablets, now that OS takes a hefty part of your storage. :roll eyes:

Duh, It has always been that way, on most phones and computers it will take a part of the storage medium.

They already did and the majority of Apple fans were OK with it, but now that the tables have turned and apples the one getting sued it's an atrocity. See how blindly you guys follow Apple?

Apple is getting sued over this? Really? Didn't Gizmodo do an article a few months back showing that Samsung phones have 50% of their 16GB models taken up by the OS?

This. The USA consumer has no protections in place to prevent from misleading advertising. Everytime I see a phone with BIG.little architecture being sold as an "8-core" system, I get pissed off.

Good !!! Bring Apple DOWN HARD !!!!! They are suckers !!! @ NT1440 : It's the same thing in Europe !!

This will go absolutely nowhere. Every single Apple product packaging clearly states "Actual formatted capacity less." Right there Apple has theirselves covered. Maybe people should do a little research before purchasing an expensive device.

For the record. I absolutely hate when companies false advertise. It's my biggest pet peeve. But it is written in the fine print so this is not considered false advertising. It's the consumers job to read the fine print.

Yep, someone above just said that about Samsung phones taking up 50%.

It's Apple, it's the only reason.

The lawyers argument is inconsistent. If people were told that ios 8 was huge, they would be effectively steered towards the more expensive 64 and 128 gb models. Then Apple would be sued for that. You can't win.

I disagree.

Relavent to the discussion:

I hope he wins! All mobile phone companies do this and it sickens me! Apple as well! Why make a great os that takes up so much space and advertise otherwise of offerings of 16gb, 64gb and 128gb when the OS is gonna take up 4-5 or so GB. Why dont they just add an additional 5-10gb allocated just for OS needs and leave the storage we were promised?!?!

Actually it does. The Surface Pro's Windows OS and default software is/was taking up nearly 40% of the advertised storage space and MS wasn't forward about it. How did you miss that news?

Yes but does Samsung let this be known to their customers before they purchase the phone? Also Samsung allows for removable storage.

I don't fully understand the plaintiff's argument. What evidence does the plaintiff have that iOS 8 uses more storage as an OS than iOS 7? It's around 4GB currently. Is their complaint that Apple should be advertising 12GB instead of 16GB because 4 is being used by the OS? Are they alleging that Apple wants you to pay for increased iCloud storage?

They should. It’s like the people that manufactured your car advertising the power output as 200HP. Then when you get home due to an inefficient design you find that only 160HP is available.
Give me either both figures or give me the one that is more useful. Before I buy.

The part I don't understand is it say's people are being pressured at important moments to buy more storage space. How does someone buy more storage space on the phone?

They Can't !! That's the whole point. Either you buy a very expensive 64 or 128 Gb iPad or iPhone, or you're stuck with it. And since you cannot put a SD card in it, and that's the reason, you're again stuck !!! 23% of your storage is A LOT !!!!!!
They're trying to have you buy a very expensive device. They do not care about their customers at all. All they care about, is MONEY !!!
