Actually the outer metal conductor is supposed to be what sends volume signal information to the ipod.

So, since the iphone is missing the contact on its end for this it's unlikely apple will get it working in FW.

That does not make sense. Here are the pin-outs for the iPhone standard (no volume control) ear phones:

Tip (1) - Right
Ring (2) - Left
Ring (3) - Ground
Sleeve (4) - Microphone

Clicking the button shorts Microphone to Ground.

Since the new Apple In-Ear Headphones work in the iPhone and support the same functions, the pin-outs must be the same. There are no extra contacts on the Apple In-Ear Headphone connector and no missing connectors on the iPhone since it must support all four.

It's quite possible that the iPhone does not have the hardware to deal with reading whatever signal changes occur when pressing the volume up and down buttons on the Apple In-Ear Headphones. But, the iPhone connector has all the appropriate physical contacts to support the volume feature.

I went the store the first day they came in to get my monitor replaced; hesitated to buy one and the next day they were sold out. I finally got a fair today…
 
Now that I have used the new Apple In-Ear Headphones for a couple of days now, I can say that these are indeed very nice headphones. My previous comments still apply but I did find that I got even better sounding bass by getting an even better seal using the large tips/buds.

I only have about 12 hours of sound through them so I expect the sound to get a bit better yet.

The only strangeness is talking on the phone with both ear pieces in place. I am not used to the sound. But, I can always pull the left ear piece out.

Picked up a pair yesterday. The sound of the upper end and midrange is very clean and clear. Not harshly bright at all. A little anemic on the low-end, but most likely I'm just not used to it as I've been listening a lot on a pair of overly bass-heavy and muddy $100 Bose in-ear 'phones.

The button functions as expected - single click to pause/answer, double click to fast forward, triple click to go back a track. I did not expect the volume controls to function and personally don't really care if its something doable in firmware or not.

The fit is very comfortable and they don't pop right out like the original Apple in-ear headphones did way back when.

While certainly not the best earbuds on the planet, I think they're very, very competitive in their price range.

after letting them sit playing random sounds/music for 12 hours to break-in i went out and gave mine a good test. so far so good. a little light on the bass, but i'm not as big into rap/hip hop as i was when i was younger so this is fine for me. sound is crisp and clear, good highs and mids. only complaint i had was apple's tips. they didn't seat in my ear near as well as my shure or etymotic headphones did.
simple enough fix though and now sound isolation is even better

What tips did you replace the stock ones with? I'm becoming a bit uncomfortable with mine...
 
etymotic tips fit rather well. shures holes were too big and would not fit.
i'll probably pick up another set of triple flanges as all i have left now are double flanges
