If Apple "prevails," and the court dismisses the lawsuit, that is a "win".

You don't know that Apple would "prevail"/"win". That is for the court to decide what the "facts" are. What you stated was an "opinion".

And like almost every class action lawsuit, only the attorneys "win". $$$$

Then there's not point of wasting several precious months to a couple of years dealing with a class action lawsuit only to see the lawyers get everything and the consumer got nothing. OH, but their principals are satisfied. Try convincing yourself of that.
I'll bet if the majority of complainers that come here ended up getting nothing after spending way too much time in a class action lawsuit against Apple they would be here crying about it. I highly doubt many would be satisfied on principle.

When fighting against a big company in court principles are as good as yesterday's trash.
 
I'm going to start a petition to have the word "bend" and all its tenses stricken from the universe.

A person involved in a class action lawsuit like to see the defendant "lose" and name tarnished, that is probably enough for the plaintiff to be satisfied whether or not the plaintiff receives monetary compensation.

It really doesn't not matter to me, these lawsuits keeps me in business.
 
And the lawyers get a massive percentage of the settlement. Rest assured you will not get your full purchase price if you won in a class action suite, which would take years to settle as well.

Didn't alot of 3GS owners get like ~$260-$280 checks recently from the class action? For someone that spent $199+ tax on the phone, they get every cent back they spent that day buying the phone..

Still no scientific proof it's a defect or even a thing. All I've seen is a bunch of random people on the internet post a picture of a bent and claiming it bent from being in their pocket. If that counts as scientific proof for bend gate, I should post a picture of an Alien ship and get a Nobel prize for discovering Aliens.

All I've seen is people purposely bending phones. Still no video of someone putting their iPhone 6+ in their front pocket on live camera, with a resulting bending iPhone 6+. Still waiting.

Depends on perspective, in reality they spent retail price. They just paid the rest back in the monthly bill. It would be curious to see how it would play out with Apple writing $1k checks. It would certainly be a way to keep a repeat from happening.

Guys, Apple sold 10,000,000 of these phones. Don't you think there would be a huge up roar by now if these had a bending problem. I'm not saying that there may not be some that have a weak spot but come on if it was a common thing you would know it. I don't think Apple could hide a problem like that.

From what I've been hearing apple were replacing units before depending on the store as they hadn't received official advice. That seemed to change a few days ago and now everyone is being told it is damage and won't be replaced.

If normal people are actually having their phones bent, that's a real serious problem that Apple needs to address. It would be cheaper than a class action lawsuit.

I know if my 6+ bent under normal use and Apple denied a replacement, I wouldn't make a scene about it. I'd walk away quietly but never purchase another iPhone again.

But then we'd have to stop our iMessage chats. :(
 
That's usually accounted for before settlement. You'll get back cost of the phone at MINIMUM.
I doubt it'll be full MSRP. At best, it'll just be OOW cost. That or maybe a voucher for a replacement iPhone. The actual cost of those is far less than MSRP particularly for someone who got a 6 Plus 128GB.

How much did folks for the class action lawsuit who got refused warranty service on overly sensitive water sensors get?
 
Well, I don't know about any of that, but I can tell you I had one of the older iPhones (can't remember which one 4s, or 5) that had the home button contact bounce problem. When pressing the home button only once it acted like it was pressed twice or not at all. It was well out of warranty and Apple replace it without any question and said it was a known issue.

I can't imagine why they would start cutting their CS now. It's one of the things that has set themselves apart from the competition.

A few weeks ago 9to5mac released an "Inside Apple" article that revealed a lot of inside talks and internal policies within Apple. In the article it was said that typically after a launch of a new product if you drop, damage or have any issues with your device (like WiFi or cellular connectivity) you are more likely to get it replaced because Apple wants to collect those devices and have the engineers review them to see what may have caused the issue to quickly find a solution.

It could be that Apple has collected enough bent iPhones and are no longer offering an exchange.

Nice try but you failed. That has nothing to do with Bendgate. The iPhone 6's have not been proven to be defective. So starting a class action lawsuit is not going to guarantee a win.

Very true, to prove whether it is defective it needs a large enough number of people experiencing the same problem and the numbers are no way big enough for that yet. But most of the worlds users are only in their first couple of weeks or still waiting for their order to arrive. Too early to tell yet, give it a few months and then we will see.
