Moreover, it sounds like it's about the look and feel of the accessories, not the device itself.

Actually, read the update and the Samsung quote, this is Germany all over again :

In fact, the intellectual property asserted are patents related to the utility of mobile devices and design rights related to the external appearance of devices.

A little detail missed by the true believers ;)

Don't get me wrong, I love Apple products. I have a Macbook Air, Macbook Pro, iMac, Mac Mini, iPad, iPhone and two Apple TV's. Not to mention thousands of dollars in apps and media from iTunes and the App store. So I am clearly not a hater. But I am also not delusional either. My lips are not firmly on Apple's you know what. Apple puts together some awesome products. But there would be no awesome Apple products if companies like Samsung didn't innovate the parts going into our iPads and iPhones. When Ipad 3 and its amazing 2500 x 1500 or whatever it is screen comes out, who do you think made that screen even possible? Companies like Samsung.

So, its time for Apple to get a grip and stop this ridiculous nonsense. Companies do have to protect their IP's, I get that, but this is getting just plain stupid. Pretty soon Apple is going to sue Samsung because the boxes they use to ship their Galaxy tabs use cardboard, just like Apple

Let's jsut say I'd be more impressed with Apple's case against Samsung if the iPad didn't contain so many Samsung parts.

Going to a fancy restaurant and ordering a Steak from the best Chef in town is great but don't forget to give the Farmers who grass fed the cows, grew the veggies, and the companies who developed the oils and butters used for cooking. Apple much like the chef has a vision, but "grocery shops" for the components. Together they bring you the best meal you've ever had. Just don't give the chef all the credit.

Apple what a failure.

Don't hate the player, apple. Hate the game.

I know they know it. I read the article. That why I'm disappointed.

You're disappointed in Apple for what exactly ? For suing over something entirely not the Smart cover clone thing by Anymode ?

Am I not understanding you correctly, you say :

I'm really disappointed that Apple is going to these depths to try take out the competition. It's a 3rd party case Apple

And then claim that you know Apple knows it's a 3rd party case. Why are you then pointing this out to "Apple" ?

Again, did you read the article ? You do realise the snippet about the Anymode case has nothing at all to do with Apple's notice, that it is just a tidbit thrown there by MacRumors staff ?

this is getting so tedious now

and turning into a snooze-fest!!!

You all have to remember 95% of people in the public don't even care or know that this is all going on. They don't troll the mac forums like us and don't really give a rats a** about any of it. Also all these people are bagging on apple about suing over I.P. almost EVERY tech company there is has been doing this all year. Seems like the fad for 2011. Not to say it never happens before but this year its brought to the forefront. Googles main reason for buying Motorola was there patent portfolio. Yes its over the top.... but its not just Apple. They are all hedging there bets on patent and I.P portfolios and buying companies just for that reason. The truth is Non of these companies are gonna lose customers over this... except the 5% that are techies like us. Personally I don't care... I just use the best product for ME. And right now thats MAC. Yes I used to work for Apple... But I never used Mac till I worked for them. As a employee I Loved working for them because they JUST GET IT!! I didn't like them because of the products. I liked them because of how they treat there employees and that they promote Individuality and Let there employees be themselves and be unique. Tattoos, Earrings none of that stuff matters to Apple. To say that there employees are embarrassed is a huge overstatement. 95% of them don't care or follow this crap either. Just like the public don't care. And before all the Haters ask... I left Apple to join The military. I am just now getting back into Mac and Love the product... Thats all I give a crap about. And thats why 50% of the people Buying a Mac are first time buyers moving from windows. Does that mean windows sucks? No... But you do have to be a little more tech savvy with windows than you do with Mac. Again 95% of people are not like us and just want to hit power and go... This patent Crap will continue for the near future then Die down. This is a unprecedented time in technology... with more competition comes more *********. just the way it is. Meanwhile people are still gonna buy Apple products in droves. I own a Galaxy S2 and its a great phone... But I will buy a iPhone if they increase the screen size. 3.5 is just too small for me. Again just a preference. Meanwhile the ones laughing at this is Macrumors. Lol...

BTW. There was a hearing yesterday in Samsung's appeal to the Duesseldorf court order (Galaxy ban in the EU) and Apple is now losing this case too.

The judge made a lot of fun with quoting from Apple's request ("rectangular", "round corners", "ultra thin", "color(!) icons when switched on"). Apple's lawyers weren't so happy, the final decision will be made in the beginning of January.

link?

i think it's about time that the thread is closed. it's become nothing but flames and trolling, spurred on by the initial photo of the cases.

Closed? It was created with the whole purpose of generating flames and trolling. Why close down what was successful?

Let's analyze this --

[1] The third party company (Anymode) that makes the covers is privately held and the CEO is the nephew of the Samsung chairman and CEO.

First, is he the nephew of Samsung chairman or the Samsung CEO(s)??? Because, these 2 guys are not the same person. Chairman is Lee Kun-hee and CEO is Gee-Sung Choi. Also note that there are different CEOs. J S Shin is also a CEO of South-West Asia operation So, please clarify which top-dog in the family is related to the Anymode CEO.

That particular "he", the so-called nephew of multiple CEO and Chairman is this person: http://www.anymode.net/company/?mid=ceo

[2] The parent company of Anymode is Youngbo engineering, who's CEO is also the CEO of Samsung himself...

You are saying CEO of Youngbo engineering is also the CEO of Samsung

Sangyong Kim (http://www.youngboeng.com/english/about/about_ceo.asp) is the chairman and CEO of Youngbo engineering. So, you saying Sangyong Kim is also the CEO of Samsung. Do anyone know who this person is?? YES, he is the CEO of Anymode - CEOs of Anymode and Youngbo are same. Press mentions him as "Sang-yong Kim" aka Sangyong Kim. I must be blind, coz you saying that Sangyong Kim is the CEO of Samsung. But how can Sangyong Kim be the CEO of Samsung when he is also the nephew of Samsung's CEO?

WHAT???

I will wait for your reply.

ohh, I almost forgot, so much for innovation:

Bath tub??

(No, I'm not being serious)

Hi,

Here's the article

http://9to5mac.com/2011/07/18/famil...ification-and-a-place-on-their-store-shelves/

It may have been updated since to correct any translation error ... but the basically there is a clear family connection between the them.

Sang-yong Kim, CEO of the Anymode Corp., is the first son of Son-hee Lee, the third daughter of former Samsung’s chairman Beoung-chul, Lee. He ran the company through selling the Samsung mobile phone’s accessories and is also nephew of current chairman Gun-hee, Lee and in relation as a cousin of Jae-young, Lee, CEO of the Samsung Electronics.

(I don't get the comparison with the bathtub cover)

This is so annoying...these companies need to get over themselves. They will make money whether or not they sue each other.

You are disappointed that Apple isn't suing Samsung over a third party case?

That Apple is suing over any case really. They look petty like this. I know they might have a patent on something but I'm pretty sure all they're trying to do is tarnish samsungs image. It's like high school.

And you've read the update that it's about the outer design of the devices, not accessory cases right ?

Thanks for pointing that out. (They should put in a thread-inline post as well, so people reading from other than the first page might see it.)

Also, that it's being done in Australia.

I wonder what kind of design IP Apple holds in Australia or if this is simply going to be "Trade-dress". We won't know until there's an actual filing though.

The report from today that Samsung outsold Apple in the past quarter, probably explains why Apple is still eager to stop Samsung in Australia:

"The smartphone market is now 65% of the total Australian mobile phone market, with Android taking over Apple iOS as no.1 position holding 49% market share.

Apple iOS, in second place, holds 36% unit share as the market eased in preparation for the new iPhone 4S launched in October 2011."

Apple has registered Designs in Australia. These are kind of like the EU Community Designs in that anyone can pay a fee and get theirs put in. Anyone else can challenge a design, and if it passes the challenge, it gets a Certificate of Examination which helps, but still can be challenged again apparently. See FAQs here.

You can search for their designs using this link and entering the search fields as follows:

Search Field = Name
Operator = INCLUDES
Value = Apple

Then click Search. It comes up right away with drawings of multiple registrations for iPad and iPhone designs. Be sure to click Next Page at the bottom of any drawing you look at, to see the registration dates.

The report from today that Samsung outsold Apple in the past quarter, probably explains why Apple is still eager to stop Samsung in Australia:

Indeed. I wrote this in (two) other threads - but the thread are all related, so here goes...

The real "behind the scenes" issue is that, despite Apple being #1 and having amazing sales - they are worried about competition. And there's nothing wrong with that. But these lawsuits to try and stop sales is more designed to keep competition from being able to sell their devices and gain even more marketshare than it is about Apple being worried about whether or not the user can click on a phone number and have the phone dial. The lawsuit/patents are a means to an end.
