Except Apple isn't in the food business, and even if they got in, they'd be the late comer to this.

In addition, one of the areas the trademark was for was in software.

You wouldn't get away with a logo of a window if you made software even if it didn't resemble microsoft's.

Its silly but the law requires Apple to defend it’s trademarks or lose them. It doesn't mean the party cant use it, but if Apple wins, the party can’t trademark it.

Only if Apple is officially acknowledging itself to be a political organisation.

IKR? something so simple in copyright and trademark laws and people just don't get it. smh.
 
1) This is definitely a case of enforce or lose it
2) Fremskrittspartiet has been using this logo for as long as I can remember, predating Apple by quite a lot IIRC. Maybe since the 1970s?
3) This is due to them registering the logo with the patent office specifically for the use of software and electronics
4) Fremskrittspartiet are the worst

This is a non story TBH.

crazy... I'm surprised Apple doesn't go after apple producers for growing fruit that resembles it's logo. :(
Apple producers should form a consortium and sue Apple – put "computers" and Sir Isaac Newton back into its branding to make it not similar with food brands.
 
Dutch toothpaste brand mentadent is using an apple in their visual communications since the '70s. In Italy it's a leader brand in this field. The apple bite became iconic: their TV ads ended for years with that bite and its crunch sound.

It's not used as a logo (mentadent has its logotype), the leaf is missing and, granted, they didn't applied to use the trademark for computer software like Fremskrittspartiet did.

Still, it always resembles me to Apple. Especially the bite, of course.

I think it's worth mentioning that Fremskrittspartiet is a far-right political party with anti-immigration politics, which probably plays into Apple not wanting to be associated with it.

But still, the difference is quite substantial.

They are not far right, although they are anti-immigration. They have been in government for the past couple years and despite that Norway has not turned into a Nazi state yet. They are a populist answer to a growing set of problems within Norwegian society. FWIW their leader is a woman, Siv Jensen.

I don't like them, I think a lot of their policies don't make sense (some do) and I didn't vote for them, but that doesn't mean that they are far right.

So everything that has an image/picture of an apple is now considered part of Apple's property? Such nonsense and shame on Apple for this!
 
the most important thing about logo infringement potential is, firstly, and, most directly important, simply what areas tbe company has been granted the trademark in.
was it granted only in computers, or automotive, or food, or medicine, etc etc.
only then, and broadly secondarily and subject to broad interpretation, is what the logo actually looks like.

Well maybe they should start suing Huawei, Meizu, Oppo, Lenovo, OnePlus, Vivo and Xiaomi for copying their phone designs. But you know they won't dare do anything about Chinese companies, even if the resemblance is too uncanny.

Doing a bit of look up, seems like the Progress Party didn't start using an apple until early 90s or so. Apple has been using it since they started in '76
 



Apple has objected to an apple logo trademark that Norway's Fremskrittspartiet or Progress Party filed for back in November, according to the Norwegian Patent Office.

The image in question features a red apple with a stem and a green leaf that also has a white "F" on the front, an icon used by the Fremskrittspartiet.

In an objection letter provided to Norway's Patent Office, Apple says that the trademark that the Fremskrittspartiet has registered "resembles" the "very well-known" trademarked Apple logo and is likely to be confused with Apple's prior trademarks.

The Fremskrittspartiet has applied to use the trademark for computer software, digital media, stationary and other paper products, household items, textiles like flags, clothing and headgear, buttons, and games and toys.

It's not yet clear how this will play out, but Apple plans to provide additional documentation to support its case in the future. Apple is asking the Norwegian Patent Office to repeal the Fremskrittspartiet's trademark registration.

Apple why don’t you start spending your time on creating more innovative products rather than objecting logo trademarks that look nothing like yours!
 
Both this logo and the one for Apple has a "cutout" in the primary color to the right. Both operate (now as of this filing which is a change from its prior use) in the same industries, which is the primary basis to judge similarity besides shape. Apple uses different colors and rainbow colors, so color is not the issue.

The F logo more closely resembles a real apple so one wonders if that is trademarkable at all as a common household object.

I would deny it.
 
This reminds me of the time when Microsoft went after a young programmer named Mike Rowe who had the domain name mikerowesoft.com.

Microsoft ended up with plenty of egg on its face.
Actually they got the domain by giving him a Xbox and some games. And it's not the famous Mike Rowe I think it was a kid and was happy with what Microsoft gave him for the domain.

Perfect time for Apple Records to sue Apple, Inc.
How would Apple Records do that? Do you think Apple is using any trademarks that are owned by Apple Records? Fact: They don't. Apple has bought all relevant trademarks of Apple Records, for some not quite insignificant amount of money, and Apple Records is using their own name with permission by Apple.

The law requires Apple to defend it's trademarks, yes. However, it does not require them to defend every alleged trademark violation... and they don't. This particular alleged violation never should have seen the light of day.

It's not about whether people can distinguish two logos shown side by side. It's about whether people seeing a computer with a green Apple logo on it think it is made by Apple Inc.

Yup, they gave him a small sum of money and a swag bag of goodies. They originally offered him $10 for the domain name, which was what really got the negative PR bus rolling. It's totally understandable for Microsoft to freak out about a business name that was phonetically the same as theirs, but their overreaction was what made it a bad look for them.
