I'm with Rogers, on a 2-year contract, with an iPhone 3G, started in August of last year. I'm not eligible for a hardware upgrade either. Have to wait a year or else buy the new iPhone outright. I assume if you bitched enough to your carrier they *might* be able to do something for you, but as it stands that isn't policy.
AT&T might cave and throw customers a bone (they might be smart to), but they're really not bound to do that.
It's any cell phone company. Anytime I've ever tried to get a new phone midstream of a contract I've been quoted the full price- often $600 or more for a phone half as capable as the iPhone (In the dark past, of course; I now have an iPhone).
