It's difficult to "accept it for what it is" when it's still not clear what is restricted and why. And since I myself cannot physically become the human incarnation of male genitalia, I shall repeat my previous question...
If true, that would mean that a father could not make the purchase for his child in college, nor could a homeschool mother make the purchase with her Apple ID and transfer that purchase to a child's notebook.
My original comment was about giving away or selling the codes, breaking up the bundle. It was not about transferring the entire bundle to your child. Which I'm sure is totally okay.
Below are the Terms that I received when I purchased the bundle. Perhaps they can answer your questions.
Content Code Terms and Conditions
Pursuant to the Content Code Terms and Conditions below (“Content Code Terms”), Apple Inc. (“Apple”) is providing you with alphanumeric codes (“Content Code(s)”) that are redeemable on the Mac App Store for the Apple software identified on the cover sheet of these Content Code Terms (“Apple Software”). You will receive one (1) Content Code for each Apple Software license purchased by you. Each Content Code may only be redeemed for one (1) Apple Software license in accordance with these Content Code Terms. Except as set forth in Section (b) below, using a Content Code to obtain more than one (1) Apple Software license is prohibited. Except as set forth in these Content Code Terms or otherwise agreed to in writing by Apple, you agree that your use of the Content Code(s) will be subject to the terms and conditions and usage rules applicable to the Mac App Store (
http://www.apple.com/legal/itunes/ww/) (“Mac App Store Terms”), and your use of the Apple Software will be subject to the terms and conditions of the end user software license agreement(s) (“EULA(s)”) provided with the Apple Software. By redeeming the Content Code(s), you agree to be bound by these Content Code Terms, Mac App Store Terms and EULA terms. If you do not agree to these terms, do not use the Content Code(s), do not install or use the Apple Software, delete the Apple Software from your system(s) and destroy or return the Apple Software in accordance with Apple’s return policy.
You further agree to the following:
a. Except as set forth in Section (b) below, you may only redeem the Content Code(s) with an Apple ID owned and controlled by you, your organization, institution or company. You agree you, your organization, institution or company will always maintain ownership and control of the software license(s) obtained with the Content Code(s) except as permitted by the Mac App Store Terms or EULA(s).
b. If you are a validly registered student, faculty member, or staff at an institution of higher education, such as a college or university, or department thereof or a teacher or staff member at a K-12 institution (collectively, “Education Institution”), Apple grants you a non-transferable limited right to redeem Content Codes for the Apple Software. If you are acting on behalf of an Education Institution, Apple grants you a non-transferable limited right to allow current students of your Education Institution authorized by you (“Eligible Education End Users”) to redeem Content Codes for the Apple Software. Each Content Code must be redeemed with an Apple ID owned and controlled by you or your Eligible Education End Users.
Content Codes purchased on behalf of Education Institutions shall not be distributed to any end-users who no longer attend or are currently unaffiliated with your Education Institution as they are not an Eligible Education End User. You must provide all Eligible Education End Users with a copy of these Content Code Terms and they must understand and agree to these Content Code Terms prior to redeeming any Content Code(s). You are also responsible for ensuring that all Eligible Education End Users have an opportunity to review the Mac App Store Terms and the EULA(s) prior to their use of the Apple Software, and that they agree to and comply with the Mac App Store Terms and all terms and conditions of the EULA(s). By redeeming the Content Code(s), you (and, where applicable, your Eligible Education End Users) agree to be bound by these Content Code Terms, Mac App Store Terms and EULA terms. If you are an Education Institution, you may administer an institutional deployment of the Apple Software by redeeming one or more Content Codes and installing the Apple Software to multiple institutionally owned and controlled Apple-branded computers, so long as the total number of installations of the Apple Software does not exceed the total number of licenses purchased for that Apple Software. For this type of institutional deployment, the Content Code(s) must be redeemed with an Apple ID owned and controlled by the Education Institution.
c. Once redeemed by an eligible Apple ID, the Content Code(s) is not transferable.
d. Apple may audit your compliance with these Content Code Terms during regular business hours, and you will promptly provide to Apple any reasonably requested information, records, and documents related to the subject matter of these Content Code Terms.
e. You shall not resell the Content Code(s) or accept any form of payment in connection with the distribution of the Content Code(s) and you shall prohibit third parties from doing so.
f. You may not export the Content Code(s) for use outside the territories in which Apple or any Apple affiliate directly or indirectly owns and operates the Mac App Store online.
g. You shall be solely responsible for your and any end users’ use of the Content Code(s), and for any loss or liability to yourself or Apple therefrom.
h. To the extent not prohibited by applicable law, risk of loss and title for the Content Code(s) passes to you upon delivery to your email address. i. Apple reserves the right to disable any and all applicable Apple IDs if the Content Code(s) is fraudulently obtained or used.
j. Apple has the right to deactivate Content Code(s), even if already delivered to you or any of your end users, in the event you or any end users violate any of the terms of your agreements with Apple.
k. Apple is not responsible for lost or stolen Content Code(s). If you or your end users have any questions, please visit the Apple iTunes Store Purchaser Service at
http://www.apple.com/support/.
l. To the extent that you utilize an agent to install or set up the Apple Software on your behalf, you agree that such agent is authorized by you to accept and agree, on your behalf, to the EULA terms and the Mac App Store Terms presented upon installation or set up of the Apple Software,
and that the EULA terms and the Mac App Store Terms shall be binding upon you as if you had accepted the EULA terms and Mac App Store Terms yourself.
m. Any part of these Content Code Terms may be void where prohibited or restricted by law. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of these Content Code Terms shall continue in full force and effect.
n. These Content Code Terms, together with the Mac App Store Terms and the EULA terms, which are hereby incorporated by reference, constitute the entire agreement with respect to the use of the Content Code(s) and Apple Software as authorized herein and supersede all prior or contemporaneous understandings regarding such subject matter. In the event of any conflict or inconsistency between these Content Code Terms and the Mac App Store Terms, or between these Content Code Terms and the EULA, these Content Code Terms shall control. No amendment to or modification of these Content Code Terms will be binding unless in writing and signed by Apple.
