Nah. No need to wish for that. They just need to clean up their act a bit and step up their game. Start pulling off a few June 2007s and January 2010s once in a while. Blaze a few trails like Apple.

Nobody can compare to Apple. There's no need for them to try, it's a losing battle. Let them fold. It's Darwinism at it's finest. Only the strong will survive. In the end, there will only be Apple.

Because that's what Apple wants, and that's all that matters.
 
By Apples reasoning they should be suing all tablet makers. This is all because the Galaxy is an "Actual" competitor to the iPad. Other tablets don't come close.

Hopefully suing Samsung is just the start. Soon there will be no other tablets on the market except the iPad. That's the way it should be and the way it was meant to be.
 
It's a case over design. In the EU, this is about a Community Design registration. In the US it is about a design patent. This is more akin to trade dress than actual patents. Sales figures would be used to prove that Apple's allegation that the Samsung tablets are causing confusion and thus lost sales for them in the market.

It would strengthen their positions. Of course, with them not even able to keep stock of the iPad 2, they probably can't really prove that Samsung is harming their sales.

Oh ok that makes sense then. I know in U.S. trade dress/trademark cases, actual confusion may not be necessary to prove if the likelihood of confusion is great, particularly with a product yet to be released. Is this the same in Australia or the EU? (Unfortunately I'm more familiar with copyright when it comes to the EU and not patent and trademark)

But I have a question: Aren't all businesses anti-competitive in the sense that they want to sell more of their stuff (or services) than any other company? Isn't it the goal to do more business that one's competitor and, if possible, put them out of business.

The goal of any business is, it seems to me, is to do better than anyone else. And if that puts the competitor out of business, so much the better.

I'm not suggesting whether this is a good or bad thing. It's just that it seems that no business wants it's competitors to succeed.

Am I way off base here??? :confused:
 
Apple invented the tablet computer, they were the first to bring a tablet computer to the mass market, hope they screw Samsung and every other tablet maker for every penny they have.

I want to see a world where the only tablet out there is Apple and the only smartphone out there is Apple

Yes. Companies strive for monopolies, as that allows for the charging of monopoly rents. That is why we have anti-competitive regulation in place.

The tablet computer was stuck in some development lab in another company yes but Apple were the company to grab the bull by the horns and take it to market and make tablet computing the way of life it is now, while Jobs/Ive did not actually invent the tablet computer as such they ran with it and made it mass market, Samsung are just a clone that are trying to cash in on Apple's efforts

No, progress would stagnate and you'd be using essentially the same product for years before Apple would need to improve it. It wouldn't strengthen anything but iOS market share and Apple's bank account.

Like I said, Apple DID NOT invent the tablet. Tablets were available to the public loooooong before the iPad. Tablet computing is also not a way of life either, a tablet is a poor replacement for a computer.

Tablets have been at the market for almost a decade. Tech just hasnt been mature enough to make the product commercially viable in the consumer market. That said, Jobs did well. But he did not invent the tablet. Not by any standard.

There are some brilliant android developers out there who have not got involved in the iOS market plus if iOS apps were the only ones out there you would get the market penetration for big games companies and big media companies to come on board and port across all their big titles, at the moment with Apple and Android dividing the market many companies are holding off but if it is Apple only then iOS app store would be more than incredible

Jobs developed the iPad before the iPhone and the iPod touch, they are both essentially slimmed down iPad's as opposed to the iPad being an iPod touch on steroids so Jobs/Ive developed the iPad years ago and only took it to market in 2010, Jobs said as much
 
The 7.7 filing is new. As was the case for the 10.1 in Dusseldorf, the injunction was granted with no hearing or a chance for Samsung to submit objections/comments of their own.

We're still waiting for a ruling on the prior 10.1 injunction, which is supposed to come in on september 9th. The 7.7 claims are new and thus will require a different hearing I guess.

Dusseldorf is just that easy for plaintiffs hence why Apple chose them, as was discussed earlier.

To bad when Apple losses they do not have to pay Samsung for its cost. There should be a punishment when one loses their case in an injunction like this. Make it so if you want one granted you have to pay the party that had to pull its products all cost it took from it plus pay them full retail for any device that might of been sold and then some additional money on top of that. Basically make damn sure you have a case before you start requesting crap like this.

Apple knows full out and well that it is going to loss and really just trying to slow down Samsung as much as possible and cost Samsung as much as possible. Never mind the fact they have no case.

Gang... this is all more than just Apple suing people... I see this as a flushing out of the Patent laws. I'm sure Apple (and other companies) are tired of the free-for-all and sue me later if I infringe attitude. I'm also sure they (as others) are tired of weak patents popping up after the fact and causing all sorts of trouble. There are many sides to the story here.

But, what we may be witnessing is a flushing out of IP patents and what's weak and what's strong. It seems as though Apple is testing the courts to see how strong their design patents are in an effort to see how far can they go. Also, I'm sure the patent courts are watching all this closely to see what needs to be tightened up to stop the "free-for-all" mentality that is out there now. And, stop companies such as Apple and others from filing weak and petty patents.

The whole patent situation is a mess and these actions plus others going on by other companies may be what it takes to flush it all out. It seems Patents were a great idea when people weren't patenting things like how to press a button.

If Apple monopolise the tablet and phone market and have 100% penetration then companies could no longer ignore Apple and we would be able to play all the top games from other formats and other devices - Super Mario HD, Gran Turismo HD etc

This is insane.

How can Apple sue Samsung for the device looking too similar to the iPhone and iPad? Apple practically made the two markets, and so it should expect the competition to look similar.

It's like one car manufacturer is telling another "i'm gonna sue you, because your car has 4 wheels, an engine, and similar looking front and rear design!" c'mon Apple.. let it be, focus on the bigger things.

This is definitely business incentive by Apple.
