You clearly have no idea how bad the plastic was on the ipod nano and 5g ipod. It was unacceptable how soft it was, some people could barely read the screens anymore because of how badly it would scratch from just being in their pocket. No one gets sued because a product isnt scratch proof, they get sued when the product scratches so ridiculously easy that it gets ruined from normal use or requires you to buy something just to protect it from getting ruined.

No I guess I do not.

I've had lots and lots of stuff in my life made of plastic, and it all suffered from scratching. I clearly admit to not knowing that this particular plastic is more prone to scratching than it should be, having never owned a nano or whatever.

I've immediately and obviously placed myself in the camp of "this lawsuit is frivolous", as so many lawsuits are.

I have 2 of these units that are mangled scratch-wise.. i put the serial numbers in and it tells me that they are not first Gen iPod Nanos and arent eligible!!! WTF...

92.5% to go...

Scratches were's a big issue with my 1G nano, and they weren't what convinced me to stop buying iPods, but they were an issue. So I'll happily accept a refunt of 7.5% of the purchase price. If only there were a successful suit over the pitiful lifespan of the built-in battery, so I could get back the other 92.5%.
 
I have a feeling that anyone who still has a Nano 1g is not the type to care about the scratches. I have seen some REALLY f**ked up nanos, and the owners really didn't care. They still played music. Those who did care, well, they went out and bought the 2g, then the 3g, then the new 4g.

Speaking of scratches, let me just say that I think it is lame that the iPod classics don't ship with the sleeve anymore. They are certainly less prone to scratches, but that sleeve is wonderful to have, especially if you are trying to make that iPod last for years and years like I am. Thank god my friend was willing to trade his sleeve for his 5g iPod for my iPod video cable that no longer works with the Classics... lol

This is everything that is wrong with America. A consumer device gets scratched??? OMG!!!!! I am shocked ! Shocked!

Good thing the lawyers clogged up the court with this nonsense and walked away with a few million in fees.

Why? Mine is first gen and it is a bit scratched but $25 for that? Silly. My Brother is a Lawyer but this type of litigation gives all Lawyers a bad name - and they need little help in that respect!

I never have had a case for my iPod (5 gig, the original) 3 nanos, 2 shuffles, 2 1Pod (what are we now, 5th gen??) and an iPhone. I am a guy and dump them in my pocket with keys etc. No significant scratch problem.

Cases at 20 dollars each are a scam. Thats why apple does not give them a sleeve or case when shipped.

The 1GB nanos were made well after they started adding the protective coating to the nano (~Dec 2005).

I have 2 of these units that are mangled scratch-wise.. i put the serial numbers in and it tells me that they are not first Gen iPod Nanos and arent eligible!!! WTF...

Again, the settlement is only for first gen nanos without the protective covering (sold sept-dec 05).

I have one from late dec 05 that's not eligible.

6th. The "iPod", under that name only, went up to 5.5G. The Classic can be considered 6G, and the 120 maybe 6.5G?

I know full well WHY they are doing it. They can make tons of money selling additional cases, or they got kickbacks from cases makers for not including it :rolleyes: I am just saying it is lame, because I have counted on that sleeve for the other 2 iPods (5G) that I have owned, and I feel it does a good job overall (especially when put in a pocket)

A class action lawsuit like this is just stupid, plastic scratches, no sh*t.
Take care of your things and this won't happen.
 
Like others, I can't understand why someone would sue because their iPod got scratched.

I have a 30GB iPod Photo that scratched just from me wiping the screen off with my thumb. That's how the iPods were a few years back. They scratched. Deal with it. It still works like new by the way.
 
I tend to upgrade pretty regularly, selling my old iPods to recoup some of the cost and putting it towards the new hotness.

The fact that the first gen nanos are so easily scratched (quite a bit easier than any of the other half-dozen iPods I have owned) significantly reduced the resale value. So I'll gladly file for the $25.

Does anyone else see this is Apple under Tim Cook's first test to satisfy customers? It struck me as remarkable that Apple, the company notorious for ignoring customer demands until a product refresh, is giving away money as a peace treaty. Think of all the other things which customers have been annoyed about. Are they all going to get refunds too? This could be a potentially very bad move.

What do these people do with their iPods!?

I have a first gen... used it everyday at home and at school... there's scratches on the back but not on the screen.

The screen of my macbook pro gets scratches when i throw my set of keys at it from across the room. Will i get $25 in 3years for that? *heavy sarcasm*

No, not really. My girlfriend still uses the 3G iPod I gave her and I'd happily still be using my iPod Mini if I didn't give that away too.

In case you didn't bother to read the thread ... this lawsuit began back in 2005 and has absolutely nothing to due with Tim Cook's present temporary day-to-day management of the company. The courts finally helped to bring about a resolution. Tim Cook did not suddenly step up and say, "Let's spend about 1/10th of 1% of our cash on hand to resolve a court issue that is 3.5 years old just so I can look good to people worrying about my leadership abilities. Get serious.
 
I bought the 1st gen iPod nano on day 1. However, I will not take advantage of this B.S. This lawsuit is lame.
