I'd like to preface by saying that the mirrored back of some iPods is too good for itself. Why? It will become scuffed or scratched ( pretty no more ) or you have to cover it with a protective case and not be able to see it at all anyway.

Back to the point... This is one of a handful of extremely stupid lawsuits. Let's give lawyers thousands of dollars and push Apple to keep prices higher than they should be to recoup this. Is that $25 worth all that to you? I say humph to you.
 
I have one from day 1 as well. Still love it.

I don't think I can take advantage of this even if I wanted to though. I actually can't read the serial # due to the severity of the scratches.
 
There goes 22.5 million for research and development.... Congratulations.:mad: A class action lawsuit like this is just stupid, plastic scratches, no sh*t. Take care of your things and this won't happen.
Apple banked over a billion dollars in the last quarter. This won't have a .00000001% on difference on R&D. People here are making such ridiculous statements. If you bought one of the faulty nanos (before they FIXED the plastic issue) then you wouldn't be so upset that Apple agreed to make it right.

Secondly, it's moronic to think that is all the money simply lost... people have to collect it from them. It's not an automatic cost of $22.5M.

Lastly, this improves the customer experience to know that, even years later, Apple admits to its mistakes. The $249+tax I paid for my 1g nano was perfect hard cash, the nano should be free of defects just as my money was.
 
Thanks to all the jerks that sued Apple. Now that $22.5 million will be paid out by all the other Apple customers that didn't complain. How else do you think they get their money back? Prices go up, or they don't go down when they should.

You all complain about how expensive Apple is, but they sue them at the drop of a hat. And that costs us all money in the end.
 
Cash? That's odd. Usually it is money towards a future purchase.

I still have and use everyday my iPod 3G 40GB with no video, no color screen, low battery life, etc. I love it.

I think I got $20 over a battery life lawsuit back in 2005 which I used to buy a mighty mouse.
 
To be fair, lawsuits like this have made iPods better. All ipods are now much more resistant to screen-scratching...

Amen. If nobody complained about poor quality, manufacturers would have carte blanche to produce any old crap - and we'd all lap it up. This is how the game is played.

Actually, I think it is. From my reading of the settlement, Apple has already deposited $22.5M in a separate fund. The fund will give cash to whoever bothers to claim it. Anything left over goes to charity - NOT back to Apple. I've claimed mine, btw. At least then I can decide which charity it goes to (although it just might be my kids' college fund!)
 
My iPhone is horribly cracked, who knew that it hitting the ground would cause it to do so. This is the exact reason why our legal system is so f-ed up. Soon we will have people suing BIC because their pens run out of ink too fast. :rolleyes:
 
Hard to fake a serial number...
You could just find a high quality picture on the internet of a first generation iPod Nano, and use that as a way to get the $25. I would not do that though. I wouldn't want to (literally) steal from Apple.

The stainless steel backs of my 3 ipods are all scratched....

Same, I have two iPods with stainless steel backs. My iPod Touch is scratched even though I have kept it in a case since I bought it. I hope future iPods have a back like the iPhone.

You can get the serial # in iTunes.
 
I meant people who have Nanos that they don't use, just claiming so they can get the $25, regardless of whether they actually deserve it...

I have a nano, I don't use it anymore, therefore I won't claim (I don't even think I can in the UK)

If you own a first Gen Nano with a valid serial number, then you qualify for the claim. That's all there is to it. It's up to each owner to decide whether or not to file a claim.
 
I know that some people will be very happy with this. I personally have had many issues with Apple products in the past and still in the present. But I have always been taken care of really well with real issues.

I never bought an ipod nano, so I can't comment much on how much it scratches. But hopefully this will bring up the quality on all the products. Even if only a little bit at a time.

Very true. I think people should do the right thing and not take the $25 as it will just make things more expensive for all the people doing the right thing in the end.

From the menu, go to Settings-->About. Your iPod Nano's serial number should be there.

Does anyone know if this refund will be available in Australia?
 
You clearly have no idea how bad the plastic was on the ipod nano and 5g ipod. It was unacceptable how soft it was, some people could barely read the screens anymore because of how badly it would scratch from just being in their pocket. No one gets sued because a product isnt scratch proof, they get sued when the product scratches so ridiculously easy that it gets ruined from normal use or requires you to buy something just to protect it from getting ruined.

Don't put it in your pocket with your keys and spare change.

it's like suing Apple because your belt buckle scratches the screen of your 24" iMac when you lift it. Although I would take the $25 if they offer it on my old B+W 40 GB iPod. Still going strong.

To re-iterate Arran in post #57, Apple will not save money by anyone not claiming. It says in section 8 of the settlement document "Apple has agreed to provide a total cash settlement fund of $22.5 million (the “Fund”) in full settlement of the claims of the Settlement Class...Apple has no ability to get back any part of the Fund."

Although, in theory, any of the $22.5 mil that goes unclaimed would go to charity, as per the next to last paragraph in Section 9.

I would like to reiterate to those who did not own one of these early 1G Nanos how bad the issue was. This was my first Apple purchase and it was scratched within 5 minutes of removing it from the box from just sitting it on the desk while syncing it. I baby all of my electronics so it was quite frustrating spending $249 on this with how easily it scratched. The case I purchased for it also scratched it when I would put it on and take it off. I can't imagine what it would look like if I did put it in my pocket with keys or spare change.

The fact that Apple started adding a coating to the Nanos in December shows that they knew something was wrong with the Nanos they produced from Sept to Dec.
 
YAY! Apple pays out $25 to the whiners, and the lawyers get millions. AMERICA! **** YEAH!
