How is it abusing the system if you owned one of these ipods? Even if it didn't bother you to have scratches, $25 towards a new nano might make a lot of people buy one...then it will actually benefit Apple sales.

If Apple does the same thing they did with the first generation ipod battery settlement. ( They gave $50 Apple gift card or $25 cash )...

You've taken my post out of context, as I already stated to someone else, I meant, people who no longer use their 1st gen nanos, but still have them, who then claim their $25 regardless of scratches, or if it bothered them in the first place.

what about the ipod touch chrome back. The thing scrates if a fly touch it.

Hardly affects use though does it, only resell value :p
 
I got this e-mail of couple of days ago and figured it was some sort of phishing scam. I didn't actually believe it until I saw it here.

ATRAC = SONY answer to MP3. It's mostly being used on MiniDisc. ATRAC is not bad, I use it on my PS3.

No one in there right mind should refund you idiots for your nano's. Are you now going to start a class action against the car makers because you get scratches on your car for normal use. People will do anything for a buck! You make me sick:mad:
You all probably have iPhones now anyway and your Gen1 nano is in a drawer somewhere. You're like leeches, anyway you can make a free buck.
Either our court systems are royally screwed up for ruling in this direction or Apple has some serious fools for lawyers.
 
I'm not exactly sure how I feel about this one. All iPods are prone to scratches so why single out just the nano's? Since I have had mine, it has been kept in its included sleeve always, period. Mine looks brand new. I am a bit of a neat freak when it comes to my mac/apple gear.

With all this being said, I hope it just ensures us better products in the future.

I sure am glad I hung on to and didn't let it go for $30 bucks a few months back. :D

When you drop that kind of coin on an iPod, it should be able to withstand wiping the face with a cotton cloth and not get dulled and scratched from it.

It was piss poor manufacturing and Q/A plain and simple.

And yes, I still use my Nano as well as my iPhone.
I'm not going to go jogging with an iPhone. To awkward and heavy.

Not surprised people are acting this way

I am not surprised people on this board are acting this way in blind defence of Apple; lots of Apple apologists out there. At least I prefer that to the Apple bashers! It is too much to expect independent thinkers in this world; seems to be the way of the world.

I have a 1st gen iPod nano which I still use quite a bit (also have a Mini and an 2nd gen iPod Touch 16 gig). I spent at least $25 trying to protect it and remove scratches when it was brand new. I love my little nano, but given the choice of materials Apple used, it is hard to believe they were unaware of how easily marred its finish would become with even gentle use.

While I was awaiting my Invisible Shield ($20 at the time, plus shipping & tax), I couldn't help myself and wanted to use it. So, I wrapped it in a gentle lintfree cloth and went out and mowed the lawn. When I returned, there were micro scratches all over it. Less than 2 hours old! Ridiculous. And so much of the enjoyment of an Apple product lies in its cosmetic features, so yes, it does matter. I spent an hour of my time polishing out the scratches with a chemical cleaner, and over an hour applying the Invisible Shield once it arrived. (And having to wait 2 days before it functioned again, because of water from the application process of the Shield) Really, a waste of my time and money because of a poor choice in materials by Apple, to maximize their profits I am sure (all businesses work this way).

I am convinced Apple knew better. Prior to the nano, we bought an all aluminum Mini, which to this day, is still pristine. I was flummoxed Apple reverted to plastic after the successful choice of materials in the earlier Mini. Notice how in the next gen of nano, they once again embraced aluminum as the material of choice, almost as if they realized that by saving a $1 or so, they caused some significant issues for their premium paying customers. All Apple devices are boutique by their nature, even the so-called "low end" ones. But I prefer them, don't mind paying more for quality and a superior user experience in this world filled with disposable crap. But when I do pay out, I do expect quality when I pay boutique prices. And so should all of you who love Apple products as much as I do.

The only problem with this class action is that it is so late. But that is our legal system for you.

just filled out a claim form-either $15 or $25 from class action settlement with Apple, depending on whether they shipping with slip cover or not.

It pertains to the first few months of sales when these initial FIRST gen nano's did not have the scratch coating on them. Must
mail claim form by June 10.

I personally feel that it would be wrong for me to demmand a refund for a product that has preformed exactly as I expected it to and I will not be seeking my 25 dollar payment.

Your choice. I don't think anyone is putting a gun to your head to submit a claim.

As to myself, I've already said my piece and have already filed the claim and feel completely justified in doing so. I spent more than $25 and a LOT of my personal time (you don't want to know how much I have to bill an hour for work; not that I see much of that money) just trying to protect my nano from the rigors of gentle, casual use; this is a partial compensation for something I still use everyday.

You feel this is a moral issue for you? So do I. Consumers have rights too.

To explain: This is such a polarized issue and I'm trying to understand if those opposed to compensation have 'good' nanos (i.e., properly coated and scratch resistant) which, I'm assuming, wouldn't qualify for compensation anyway.

Personally, I bought mine within days of them being released and it was badly scratched within hours. I'm not an industrial chemist or anything, but it seemed like the plastic (resin) face wasn't fully 'cured'. Years later, it's still soft as butter. Way, wayyyy, softer than my nano 2G which followed it.

To the, "you should've bought a case", brigade: Point taken. But there really were no cases available for weeks after release. Early owners were reportedly using Altoids tins for protection! Not like now where we have iPhone 'nano' cases supposedly appearing before the actual device :)

A class action lawsuit like this is just stupid, plastic scratches, no sh*t.

maybe the $22.5 million could pay for Apple to read some e-mails about copy and paste and calendar search on the iPhone? As on post said earlier, the standard is that the product must be fit for a particular purpose. It's main purpose, other than lining Apple's pocket with money, is to be a portable media player. If the unit is too frail to maintain that purpose, then the manufacturer must be responsible. Look at Microsoft and their warranty extensions. They saved a lot of face (even though they are still Microsoft at the end of the day) by extending warranties on the xbox for three years since they knew they had some serious issues with this device. The consumer did not have to wait three years for a settlement, the company saves a ton of money in legal fees (so does the consumer as the attorney leading the class action gets 1/3 plus fees (court fees, expert fees, copy fees etc...). If it had gone to trial, then the court could order attorney's fees be paid by Apple and I have not heard anything in the settlement as to that matter. Yell all you want, but at least they acknowledge they had crap product and we are willing to fix it.

I enjoy Apple's products, but sometimes they push thing with the style aspect. I have had both iPhone, yet needed to hide there great form from the world because that that sensitive chrome bezel, which still got nicks and scratches on it while being in a case.

Onto page two of this... and I give up reading this, it's 2005 all over again, complete with the same breed of ignorance talking like it has a clue.

Over three years on, and clearly there's a lot people around here who don't realise that early runs of 1st Gen nanos had a fascia that was made out of plastic that barely gave hardened wax a run for it's money. Without a doubt the worst I've encountered.

Putting in your pocket would scratch it, putting a case on the thing would scratch it, a micro-fibre cloth gave it lovely micro-fine scratches, you could accidently scuff it with your nail.

That thing went right back to Apple, no messing about, full refund (and they didn't argue about it either).

By comparison, my 2nd Gen silver has never been babied, never gets put in a case, and the plastic screen is completely flawless after 2 and a half years of use and abuse.

CNBC reports that Apple is in the process of settling a class-action lawsuit against the company filed in 2005. The lawsuit charged that the first generation iPod nano's screen scratched "excessively during normal usage".

According to CNBC, the settlement calls for Apple to set aside $22 million to refund iPod nano users who apply for a partial refund:While Apple has agreed to these terms, a judge still needs to sign off on the terms on April 28th. I still own one of those nanos and let me tell you all it is unbelievably easy to scratch. you can literally scratch it by rubbing it with your fingers. I recall that my nano was extremely badly scratched after the first day of use - a couple of hours in my shirt pocket with nothing else in it besides a store receipt. I bought a plastic cover for it and it's been fine since although I couldn't get rid of the original scratches.

I still remember posting complaints to some forums and some dumb schmuck telling me that the new nano was obviously an object or art and beauty and it should be put on a stand and admired from afar - no scratches that way. i swear I'm not making this **** up. I dropped some very angry feedback to apple at the time but never thought anything would come out of this.
