They can only do that when they get FCC approval.

FCC Approval is only required for the 3G version. The Wi-Fi version requires no approval since it is using IEEE standards already approved by the FCC.

Unfortunately it seems like an odd time for anything other than general maintenance. Apple is usually pretty regular about stuff like that. I'd love to be wrong, though.
