The fanboyism is flowing in this thread. Dear lord. This is pretty open and shut. Not sure how much economic loss is viable, but it's effectively the same logo....Apple will settle for a reasonable amount and should change the logo back. Pretty cut and dry.
 
This is actually funny. After seeing Apple suing for using apple in logo / name etc. I'm from Poland and few years ago they sued the grecery compagny with web site a.pl (pl is polish internet extension) for the use of this logo

Apple has been using the logo way longer than that. Check out this screenshot of MacOS 10.0, from 2001 (notice the "Applications" icon):

The recent change is a natural evolution of that design. There's no way they should win.

EDIT: And yes, that is Internet Explorer.


Yeah, before I got down to this post, I was already thinking "Why does the Kon logo look so much like the earlier app store logos just paint filled in black?" On a level playing field, they would never win this complaint.
 
The Applications icon from OSX 10.0 is very different to the icon Apple use now for the AppStore icon - in OSX 10.0 it is clearly a paintbrush and a pencil resting on a ruler. Whereas the new AppStore icon is 3 interconnected lines - no pencil or paintbrush.

The recently updated AppStore icon has lot more in common with the Kon logo, in my opinion...


I disagree, it's the same icon, just updated. They are just not putting details in the icon. It's just been simplified. It's a natural progression to the same icon. I think it's stupid that window is still using a floppy disk as their save icon. They should smooth out the details (flatten the image).
 
I don't think there is any validity to "confusion in the marketplace", but to me Apple is clearly infringing on the design. You F'd up on this one Apple. Geez, do you have to "fisher price" every icon and UI element now? Go back to the Pencil/Paintbrush/Ruler icon for Pete's sake.

So are you somehow saying that the Apple logo DOESN'T look like this one? Or is it okay because this is Apple? I am pretty sure, no lets correct that, POSITIVE people on here flipped when Samsung "borrowed" design language from Apple for their products. I take it that's cool, right?
 
I own an apple farm - Apple has ripped me off for 30 years using one of my apples as their logo! I want my money!

Really? So does that mean that the chinese government now is going to go after the hundreds of thousands chinese companies that steal designs and make fakes? Give me a ****ing break. They ll have a case when they go after fake iphones in china and and fake manufacturers there

Further more that design was used way before 2009
 
Well, accidental infringement is still infringement. I hope the little guy (because all businesses are the "little guy" compared to Apple) wins.

The AppStore icon really makes Kon's logo look ridiculous.

I thought you could only successfully sue a company when the trademark is infringed upon in the same market as the original trademark?

Heh. That has never stopped Apple from trying to intimidate anyone else using an apple in their logo... no matter how different their market is.
