This is nothing new and exactly why a lot of companies don't bother trying to do business in China. Their patents are stolen, the government doesn't care, and lawsuits have a home court advantage. Such lawsuits are just the cost of doing business when dealing with China.

Jaguar-Land Rover is currently suing a Chinese Automaker for photocopying their Range Rover Evoque and selling it as something called a Landwind. Good luck to them with that. Hahah.

I wonder if they have a Chinese equivalent of East Texas for patent claims.
And some obligatory mention of how outlandish US copyright laws are should be made.

No, the difference is in New Zealand the price you see advertised, the price on the tag, the price you get quoted, is the price.
Good for you. Ample reason for you to not visit the US, then. You were given the opportunity to understand that we just have different ways, but you chose to try to force your NZ viewpoint on us. We're now instructing officers at all international points of entry to not let you back in.

You're juggling the facts. People leave a lot of non oppressive countries simply due to economical reasons, unemployment and low wages and happily migrate to other countries including oppressive ones, again due to economical reasons.

Chinese government does good and bad things but some want to see the world black and white and paint China only black because it's communist :eek:.
 
Reading all this, it seems that some company has created an app that lets you view a video, convinced Apple to sell it through the app store, and it turns out they don't have the copyright or a license to do this, and the copyright holder is understandably annoyed.

In the USA, they have the DMCA act that many people constantly complain about; in this case it would work perfectly: The copyright holder would send a DMCA takedown notice to Apple, Apple removes the app from the store and copyright holder and app producer can fight it out in the courts if they want to. Or the app producer writes to Apple that they indeed have a license, then the app goes back, and copyright holder and app producer can still fight it out in the courts. Apple could only be sued successfully if (a) they receive a DMCA takedown notice, and (b) they don't remove the app quickly.

Seems that doesn't happen in China. If there was indeed copyright infringement, then it is quite possible that Apple has to pay the huge sum of $10,000 to the copyright holder; I'm sure Apple can then sue the app producer to get that money back (probably not worth it). And $10,000 doesn't sound unreasonable to me; in the USA people have been sued for more for making a few songs available on the internet, without any evidence that these songs were actually downloaded.

I think it is ironic that Apple says Spotify is breaking App store rules that have always existed and Spotify shouldn't get preferential treatment but Apple thinks they should get preferential treatment in China (no anti China propaganda) and India (need 30% of India manufacturing to open retail stores).

Get your facts right. Apple has been sued. There is no mention that Apple is asking for preferential treatment. And there is no mention of anti-China propaganda. This sounds very much like a propaganda movie depicting the heroic fight of China against the Japanese invaders (who murdered hundreds of thousands of Chinese citizens in the 1930's and 1940's), and it seems this movie is popular enough that someone says this app causes them financial loss.

I agree it's not all black and white, and I'm the first to admit democracy isn't perfect either, but I am saying when given a choice, people will choose personal freedom over communism, every time...... and yes, those choices are mutually exclusive.

I don't get it either. But this is just a bait of western companies.
China and Russia has agreed to gradually remove western companies from their own country. (sorry but I apparently cannot find the exact source of this claim.)

Apple and other companies seem to have no qualms letting China be so close to their intellectual property, or else nothing would have been opened up[ and shared to other countries. Even despite China's 90% piracy rate (or India's 70%+ rate... sources: various tech media, circa 2005), so one entity is incorrect in belief. And China's piracy rate has said to have gone down - not a bad thing, is it?

Patent laws were reformed in 2011. Shouldn't be an issue anymore.

But Donald Trump is a dangerous president candidate is it not? His constantly inconsistent claims and speech already drags his reputation to somewhere between minus infinity to zero. His style would be the most favourable one for some racists in USA though. Then, if he is president and pull all manufacturers back to USA, next generation iPhone may eventually double its price. First generation iPhone costs $500 USD I remember.

No, Communist Party does not even mind hurting themselves at all, as they don't care China has bad reputation around the world. So that Communist Party will always have excuses urging Chinese back to China, rather than staying outside.
