Exactly this. People insisting on sticking with iOS 6 really get under my skin. There's no need for it, regardless of what bonkers statistics and things you can come up with for why it's better than iOS 7. Update and live in the current.

What about iOS 7 being buggy like hell? Last time the statusbar just disappeared on my iP5 and I couldn't bring it back without restarting the phone. On the other day while listening to music the lock screen became simply unresponsive, I couldn't even unlock my phone, I had to reboot it again. These are the kind of bugs that can be really risky for people who depend on the perfect operation of their phone (businessmen, etc.). And I've experienced a lot more glitches which were less serious but still very-very annoying.

If you only use your phone for Facebook and Instagram, well good for you, but your lack of understanding of other people's concerns is surprising at least.

(I love Apple products and iOS 7, I like the flat design, I like the new features, I love swiping back and forth in Safari - in fact I am doing it unconsciously in every app and it disturbs me if it doesn't work, etc...
BUT...I am not blind, and I know that this OS still needs a lot of work)

People who say useless crap like this get under mine. I use my iOS devices for pleasure and I did not enjoy iOS7 and it retro 70s flatness and color scheme. It is the past as far as I am concerned, and it looks like crap.

I used iOS 7 and reverted at the last min I could and have felt relief. I was going to buy an iphone 5s but rethinking that. It sends the wrong message to Apple and I'd hold on to my money than give it over for something that I don't like.

iOS 7 -- the first Apple release designed for Millennial fashionistas because they can't remember seeing this tasteless crap recycled from the 1970s.

And lots of people here are so Anti-Apple it's bordering a Microsoft/Android forum.

How dare some people be "Pro-Apple" on an Apple-Enthusiasts board.

I've given Apple more money than some people earn in a year. I've never owned a computing device NOT made by Apple.

It is not anti-Apple to point out that Emperor Jony is showing us his junk, and you can see it waving in the wind even as some of masses ooo and aaaah over how lovely the new clothes are. What's wrong with real clothes, Jony, too skeuomorphic for you?

Maybe a lot of paid Apple employees are forced to express "their" glorified opinions about iOS 7, the new Tim Cook and Jony Ive Apple era in general, and to vilify people who have a different opinion.

iOS 7 on the iPhone 4 is practically unusable. Much like the iPhone 3G was with a previous iOS version (5 or 6, I can't remember). As much as people in here are screaming "get with the times," I can understand somebody not willing to update to preserve their device functionality. At the very least, Apple should include an option in the software update settings to turn this on or off, and if you turn it off after the download of the new OS, it should delete the update and free up the storage on the device. That's not exactly rocket science. And if the person decides to upgrade to the new iOS at a later time, they can sit through the download process at that point in time.

If you are still using an iPhone 4 it wont matter what iOS you are running you need an upgrade. My wife still has the iphone 4 and comparing to iphone 5S wow. iOS 7 on iphone 4 runs slower than iOS6

Somehow I can imagine why this guy is doing it.
As long time fanboy I was unhappy with 7 on a 4
and bought a fresh 4s/iOS6 to get my iPhone feel back
there was however an extra price to pay
the update is waiting on your phone and now
it shows up as 2,56Gb other memory on my 4s/16Gb
a memory loss of 16%, but if you own a 8Gb it would mean 32%.
2nd line Apple support was really supportive but couldn't
offer help to reverse it and free up the space,
they only made an official report "client is highly inconvenienced..."

If you thought you had enough space left and don't want to upgrade
you either already lost memory or you have to quickly fill it up
with stuff you can delete yourself,
a highly user unfriendly and unApple solution.

That was exactly his point...

I can remember when I first held my iPhone 4 in my hand, it was, wow... super fast, super usable, just perfect. But that was a long time ago. Don't you think it's somehow a reasonable desire that your phone that once served perfectly remains just as usable as it was originally at least? My sister is using a 8 GB iPhone 4 with iOS 6, she bought it less than a year ago when it was already quite old, but she's perfectly satisfied with it. People do not need to upgrade just because they have an iPhone 4. People do need to upgrade exactly because of the fact that the new OS rendered the once perfect phone pretty unusable.

Hours before I saw this article on MR, I checked my storage on my 32gb iPad 3. Haven't looked at that in months and was stunned to see capacity remaining at only 6gb.

Now I know the reason why and I fully support this guy's decision. I don't want iOS 7 on my iPad. Just my personal preference. Just give me my storage back

Well, I often think it's silly court action, but for this time, I completely agree!

First of all, some of us just don't like the way iOS 7 looks, which doesn't really look appealing due to some very very low contrast (light blue and grey on white... you can see crap unless you have perfect sight and in perfect condition). Give an option to turn off some transparency, add more dark line contrast instead of light grey or light blue and then we could speak again about iOS 7.

Secondly, some of us might still have some old iDevices that won't run seamlessly with iOS 7 even thought they are supposed to be "supported".

And finally, automatic download is a nice feature, as long as you have a way to delete the thing. If you have an old 16GB iDevice, you could use a lot of room for nothing.

So yeah, there's real _reasons_ why someone wouldn't like to upgrade to iOS 7 and wouldn't appreciate the automatic download. On a brand new 64 GB iPhone 5S, well, it's maybe not a big deal... but not everyone is using that and could be perfectly happy with an old 16GB iPhone 4 and iOS 6...

Why should they? Because you say so? You ios 7 lovers make me want to puke.

America: The home for frivolous lawsuits, yayyyyyyyy.

I'd wager this is just an Android fanatic trying to get some cheap shots...

Can someone explain if he succeeds, what power this judge or magistrate has in ruling?

Just curious on a ruling for the plaintiff yields any sort of success in the end.

Well, worst case for apple is that they'd have to incorporate a way to shut off automatic OS downloads/updates. You can do it for apps, you really ought to be able to do it for the OS too I suppose.

As someone mentioned before, the first page of this thread is a car crash. I'm glad it improved. Was starting to get a bit worried. Haha

I think this is great. At the very least, hopefully Apple will ease up on the Borg assimilation process of updating. ;)

It's funny reading posts of those who are opposed to the argument. The best part is, nobody has a good reason why the lawsuit is invalid... just a bunch of 'omg this is so stupid' posts that only prove that the lawsuit holds validity.

Keep in mind...

1. Not everyone wants iOS 7, for a hundred reasons... risk of being buggy, controversial new look, having to relearn some things, etc. It's very disrespectful to imply that everybody should be 100% on board with everything Apple does.

2. Not everyone has unlimited data at home. Some people live outside the U.S.! There have been posts about people who pay a lot for their internet in remote areas of North America and the rest of the world who, for them, have had to pay a hefty premium for the automatic download... not everyone is made of money. And all for what..... because Apple and a band of supporters think that imposing the download in the background is fair and essential? Selfish.

3. There is still much work to be done on iOS 7. There is lots of good, but it's very common in every industry to sit-out the immediate launches of things. Many people get burned by early adoption (many from iOS 7, too), and are happy waiting for a later release of it to update. It's not like iOS 6 suddenly stopped working, it's a very solid and reliable platform.

Well I bet you're going to love working as a software beta tester.

Because that's what iOS 7 really boils to - it's a mass-scale beta test. So many usability issues, so many ill-advised GUI decisions and it's not even as consistent as iOS 6 (which already had issues). I'll eat my hat if we won't see some major usability fixes and a refinement of the art direction in the next few iOS revisions.

Until then, enjoy using a semi-broken operating system on your mobile devices. I'll be staying with iOS 6, the OS that actually works.

Simple solution: Install the iOS 7 download and get over yourself. iOS 7 is great, live in the now and not in the past.

I'd like to go back, iOS7 is a mess on my iPhone 4S;

-"convert to 192kbs" music no longer plays
-Gets stuck on "waiting to sync", frequently needs a reset to get working
-Frequent crashes, at least once a day
-Once a week it does a complete crash and resets itself. Once occurring during a phonecall.

I've forwarded all these onto Apple, but since they never fixed some of the bugs I reported for iOS6 I doubt we'll see a fix.

"Get over yourself" my arse . I love the look of iOS7, I just wish it worked as good as 6.

I'm considering going back. I love some aspects of 7 (the look, the auto updates) but it's a buggy mess for me. I even did a full format and reinstalled the OS from scratch hoping to get it working correctly. Spoiler: it didn't.

I can see why the adoption rate for 7 is worse than 6.

People sue for just about anything when they're bored, don't they? :D

Unfortunately it's the only language some large companies can hear.
Why isn't there a way to delete idle update data? These are paltry 16-64gb devices, there's not much room to breathe on them!

Why does someone need to show a breach with the EULA? The issue concerns the advertised capacity of the device. When the iPhone is purchased, it states in the documentation that the capacity might be less due to formatting of the device, not because of subsequent forced downloads that have nothing to do with the formatting. Furthermore, no where in the iOS 6 license/terms of use, does Apple reserve the right to reduce the capacity of the device beyond what is necessary to format the drive. Did you even read the EULA?

The EULA for iOS 6 says that Apple "may make future iOS software updates available". Great, make them available to me, but that does not imply that I consent to having those updates pre-downloaded. So if the update actually consumes 3gbs of storage space (and this isn't formatting related), then Apple is reducing my storage capacity by 3gbs. Apple is guilty of false advertising.

I'm pretty sure there are consumer protections laws against someone selling me a device with capacity X GBs and subsequently making only X-3 GBs available.

Cause that is how the law works. A contract claim is based on written terms. A tort claim is not. But there is no physical injury or property damage. So no tort claim.

People don't understand the law and lawsuits. I defend them every day.

Another example of Apple NOT giving people a choice.

Every day I have to endure some frustrating issue with iOS 7. I can't change my greeting because when I press the (non-button) "Greeting" nothing happens. When I am on a call and I get a txt msg, if I view the txt msg, both the call screen and the txt msg screen are superimposed on each other. Dozens of usability issues that need to be fixed. iTunes Match issues. iTunes Radio says not connected to internet when LTE is on and functional and can browse the web just fine. It goes on and on. Is the guy crazy for not wanting to update to iOS 7? Not at all.

It's also common practice for many to wait to upgrade until a ".1" update has been released.

In the end, people should have the choice if/when they upgrade to ios7 and should not have valuable storage space hijacked.

Simple solution: Install the iOS 7 download and get over yourself. iOS 7 is great, live in the now and not in the past.

Maybe some people prefer the simplicity of the older version. Since Apple forbids you from downgrading, you shouldn't be forced to upgrade. You also shouldn't be forced to download the update and tie up the limited storage on the device. A lawsuit seems a bit harsh, but probably the only way to get Apple to respond.

----------

Such a simple fix, unless you're jail broken: settings > reset > Erase All Content and Settings.

Done.

(Turn off WIFI at home to keep the firmware was re-downloading.)

Yeah, because that makes your iDevice useful

Good for this guy. Hopefully more people join up. I know people running iOS7 on iPhone 4 and are complaining of lag and other issues. I know people on iPhone 4s devices that complained that they didn't expect an update to turn their phone into such a visually unappealing device. There are people who had no idea the update was so dramatic and completely ruined the user experience for them. I know people who bought iPhone 5 and were happier with iOS6 on it.

And plenty of frustrated users who don't want to update to iOS7 (esp on iPhone 4 devices which the OS runs laggy on) but are either stuck with GBs worth of storage used up and not way to free it up, or be forced into iOS7 even if they don't want it.

I briefly considered going back to Apple for my next phone and getting a 5s but no thanks. It's a nicely designed device but iOS7 ruins it.

does this guy expect to be using ios6 till the sun explodes?

That could happen without any warning. You might want to invest in 2000 SPF sunscreen.

I won't be upgrading my iPad 3 because then it will be different from the iPad 1 the kids use. I'll be rather ticked it the 3 suddenly downloads 3 gigs of worthless data.
