What's funny is when people sue for every little thing, and when similarly minded people flock to justify suing everything.

And it’s funny that you think you can decide what other people should be allowed to do, like you're some GOD. .

So when apple repeatedly demonstrates it working in court you will say?

This lawsuit will wind up with the guy being publically humiliated for having horrible diction

And when Apple repeatedly demonstrates it and it fails?

The only point I want to make is... This guy has the right to sue if he feels cheated. Let him have his day in court. Who are we to tell him he can't sue?

"We" (assuming you are in the US) are part of a few lucky countries where you can sue anyone, any time. Feel lucky...

Oh, and "beta" = thrown out by the judge. Nice money grab though.

Exactly. But Beta does NOT mean tossed. It has nothing to do with the ad being misleading.

siri

I stopped using Siri to maintain my sanity and composure. Very poorly implemented in it's present state. I would say it's next to useless, and aside from setting an alarm Siri makes life more challenging. My Acura RL does a much better job of understanding what I am saying.

And Siri Evolves

So I suppose this means that Siri will be re-programmed to respond with something like this in the near future:

"I don't know the answer to that question. But if you'd like to sue me, I have located three competent trial attorneys with offices nearby. Would you like me to call one for you?"

Here's another anticipated Siri response in light of this latest development:

"I don't know the answer to that question. Are you crying? Would you like me to sing you a song to calm you down? I can even emulate your Mommy's voice. Are you still crying? Is this Frank?"

Court cost?

I agree, but he should pay court cost if he loses!

Red dog - Ad says wings, guess no one sue em cause they don't have as much $$.

Or their ads are so blatantly obvious tongue in cheek no one could be misled.

Whatever happened to earning an honest living??

...but, as soon as Apple featured Siri in an ad he became a fundamental part of the product.

You can't feature something in your ad campaign, and then claim that since some fine print somewhere calls it "beta" you're not responsible if it utterly fails to do what you have advertised.

This lawsuit is lame, but...

This lawsuit is definitely lame. Some loser hoping to scrape a few bucks of a company with $100 billion in cash. However, the Siri ads are misleading. Siri is not nearly as responsive as the imply in the ads. Then again, they only have 30 - 45 seconds. :)

lol First of all, I was referring to defining words that people might not understand along the lines of "beta" (apparently), not words like "the" that you might find confusing. Anyway, beta is a bit more than just being after the alpha version, but you don't really seem to know that. It's noted by nature that the beta phase is, indeed, a phase following alpha testing, but that it is a product that still has bugs and is not perfect. It's funny that you tried this argument though. So you think you could just make up an application that's nowhere near finished and call it "beta" and say it's okay because "beta is a vague term"? haha That's "a load of horse manure." "Beta" is an actual phase.

ok, the horses are seriously well fed by now. You don't think I know what beta is, lol, the point is that saying something is in beta and has some bugs, doesn't really mean anything concrete. Esp. so when your marketing says look what a great thing we are selling the new iphone with, but without a disclaimer.

This case has legs - if they want to beta something that doesnt work half the time, then for gods sakes dont spend millions advertising it working absolutely flawlessly across the entire United States, because thats not accurate in any way.

Someone mentioned making an honest living, yeah, thats what *Apple* needs to do in the case of advertising Siri.

I hate it when Apple advertises ALL of their stuff and the sequences are shortened or sped up in some way. FALSE EXPECTATIONS.

It's really not all that magical.

I use Siri all the time and she gets what I'm saying about 95% of the time!! Sending text while driving.
Setting alarms without having to unlock the phone.
Setting timers when cooking and have my hands dirty just hold the home button!!
I actually use it more than I thought I would!! And it's only gonna get better with every iPhone gen from now on.

This is a dumb, opportunistic lawsuit.

Then again, the lady who managed to dump scorching coffee on her nethers and blame someone else for it came out pretty well.

Let's see, my dish washer doesn't get the dishes clean if I don't rinse off certain food items before putting them in the washer. Drinking budweiser doesn't make beautiful women swarm around me. The list goes on and on. I should sue.
