FWIW, Siri works nearly every time I use it and responds right away where I live. I suppose there isn't nearly as much network congestion where I am compared to major cities.

Not sure if it's just the UK version, but Siri for me is terrible. It's excellent for humour - but incredibly frustrating if after the 10th attempt at sending a text message still fails to get the message even mostly correct.

I hope the lawyers spend loads of money trying to sue for this. What a joke. Phones in commercials never drop calls or run out of battery life, either. :p

Siri CAN operate in the fashion shown on TV. If they showed Siri building a car from corn then I'd see a case.

I'm not saying every company should be off the hook. However there are plenty of ads that point out in the fine print that the picture/video is not 100% accurate of the actual product.

That's the problem nowadays. The small print. It's small for a reason and it should be illegal.

Whatever happened to the truth in advertising law anyway ?

It's beta. And it says right on the commercial that the sequences are shortened. No way this lawsuit goes anywhere. Companies always advertise how their product SHOULD work.

I've tried them all. And they work for me.

The ads say "some sequences shortened" at the bottom, so obviously it's not going to respond quite as quickly.

I imagine a defense could be they the person's Voice in the ad works. Every voice gets different results (remember the problem with certain accents?).

It's called BETA for a reason for God's sake! Man I'm SICK of losers trying to leech money out of Apple at every small thing. Don't like it? Just shut up and return your phone and buy a Samsung crap that will understand what you're saying!

Yeah, learn from Apple, who would *never* ;) file a law suit of questionable merit against anyone :D

Can other companies put Beta after their product and everyone on MR will be forgiving ? Say windows 8 Beta.

Hmmm iPad LTE beta edition..... There we have it, the rest of the world cannot complain about LTE compatabilty... It's BETA.

If it's Beta then Apple cannot make it out that's it's so amazing, especially in it's ads as it's misinforming the user. Every ad with Siri makes it seems like it's flawless. Far from the truth.

I agree that Siri, for the most part, is just barely north of useless and that Apple grossly over-dramatizes how fast it actually works.

That said....the software is in beta and the fine print in the ads says that everything is sped up for demo purposes. The judge will barely get comfortable in his chair before coming to the conclusion to throw this thing out.

One Word: litigiousness

You're ignoring the point of the suit. It's not a suit over whether or not states the product is in beta. It's a suit over the fact that if you don't go to the website or ask someone if it's in beta, you're led to believe, by the commercials, that it works as advertised. It does not.

I understand your point, but honestly, that argument could be applied to so many products that are in the market. E.g., Washing Machines do have problems, Cars Navigation systems don't always give the best or fastest route.

Here is what I see in this:

1. Man with nothing to do and looking to make money
2. Apple = Amazing bundles of money that make GDP for some countries look like an average kids savings account.
3. Everyone is suing Apple (see point 2)
4. LightBulb Moment! Frank can make money too...

I love Apple like the rest of folks but also see where they let folks down. This isn't really one of those moments.

It maybe an advertising standards thing, but being being able to sue over this for damages is ridiculous.

I am sure siri hasn't caused that much distress in his life that he requires damages. If he does win at best he should be allowed to return the 4s for a full refund.

Siri

Exercise your right to choose !!
not freakin cry.......

If you dont like the Iphone go get something else .......and stop bitchin.

Personally I think Siri is pretty useless. I've tried it a handful of times with restaurants and similar locations and it fails every time.

I think the class-action is justified. Apple (or others) should have far better working software before it makes promises and advertises like mad.

So how should Apple advertise Siri if it were up to you?

I recognize Windows 8 as beta and expect it to be buggy and not have some parts work.

As bad as the Metro GUI is.

;)

And I might add if this guy bought the iPhone 3 just for Siri he has a "Serious" problem.

Probably a :apple:'n illegal with a horrible accent. No wonder if Siri can't understand you. Trying to get a free paycheck from apple in additon to food stamps and welfare.

I think the important thing is that in a perfect world, Siri could perform pretty close to what the commercials show. Sure, it's a little less magic, but when the stars align, nothing in the commercials are "impossible." How many times does a Big Mac look like the one in commercials? Never, but theoretically it's possible.

Which doesn't require a lawsuit. It requires a complaint to the FTC and a request for a refund under the warranty. Because I bet you the unspecified damages suddenly become $6 million for the "stress" caused by Siri not working to this person's content.

Suits like this shouldn't even be permitted until one can prove that you already complained to the parties and there was no acceptible resolution.

I've seen beer ads that certainly imply that you'll get laid if you order that beer. Can I sue them? I've seen soapsuds ads that claim they can get out any stain. Certainly hasn't worked for me.

Decades ago, I was involved the development of CD-ROM products for the b-to-b market. We had a product for the legal market and I got a call from a user requesting some new product features, which I said we would look into. He called back a month later and asked if the new features had been implemented yet. I said "no" and he threatened to sue us. I told him that we had an unconditonal warranty and even though he had already used the product for many months, he could return it and get a full refund, no questions asked. After all, we never advertised the the users could call us and ask for any feature they wanted. He still threatened to sue. Of course, he never did, but some people are just completely arrogant and feel that if you don't give them exactly what they want that somehow their rights have been violated. And that was before the Internet gave everyone license to criticize anything and everything, with or without facts and knowledge.

I get your comparisons, but this is a gross misrepresentation. If it weren't it wouldn't be satire on SNL. The whole point is that it's beyond a GPS not always giving the best route. It's to the point where we can all laugh at SNL's satirical commercial because we all know how inaccurate and not-like-the-commercials Siri is.

That, despite the fact that so many lawsuits are frivilous, is why I support the suit.

I'll point out, again, that if the suit is just to make this guy money, I don't support it. They just haven't said if it's damages all for him or part of the suit forces Apple to change their advertising.

Good for Laughs

I know it's beta, but if they are going to run ads promoting it, it should be a little better. As others have stated, most people have no idea what beta is and Apple doesn't really make it that clear. My wife asked me the other day if Orange Crush soda was still around. I asked Siri and she gave me the name of a restaurant in Orange County named Crush. Hope it gets better soon. Right now it's more misses than hits.

it doesn't work for everyone, just like Google's voice commands don't. When I had the Droid, and then the Droid X, it never understood anything I said correctly. Siri understands about 95% of what I say, even longer comma separated sentences.

I've heard the opposite from some people though, where Android's voice command worked but Siri doesn't get anything right. I'm sure it has a little to do with the accents of those who develop it.

Over time they will converge and work with the majority of people, but unless it really is magical, it will never understand everyone. I can't understand a lot of people myself!
