Wonder if he's going to sue his car maker as well since I am sure the MPG is not as advertised. :)

It maybe an advertising standards thing, but being being able to sue over this for damages is ridiculous.

I am sure siri hasn't caused that much distress in his life that he requires damages. If he does win at best he should be allowed to return the 4s for a full refund.

The point is, and I agree, that Siri (a major part of the iPhone in Apple's ads) doesn't work anywhere near the promises by Apple. Period. This will or will not be proven in court. Period. My personal belief is that Siri stinks. He should be able to return it for a full refund (and he probably tried).

If I bought something and one of the major features didn't work right, I would want a full refund, too. If the camera, for example, was terrible (not a defect but just poor design), I would want a refund.

Suing a company simply for failed expectations? Gee, some people are really too fond of themselves. Did Apple not mention that Siri is in beta when they released the iPhone 4s?

I hope that moron spends a bunch of money on lawyers and ends up losing the case.

I don't know about all this. I really think the situations in the commercial are pretty simple. I imagine many people receive similar results with their 4Ss.

It's not like they are showing off something ridiculous that could never happen like "Siri, find my favorite toothpaste on Amazon.com and order 4 tubes and have them sent next day to my house."

Probably a :apple:'n illegal with a horrible accent. No wonder if Siri can't understand you. Trying to get a free paycheck from apple in additon to food stamps and welfare.

Tell me how you can obtain food stamps and welfare if you're an illegal alien. The only way is if you'll stolen someone else's social security number. Even then it's difficult in most states because you need to show a birth certificate and other ID. There are plenty of Americans who can't construct a proper English sentence and don't speak clearly and there are plenty of Americans who sue for no reason. We're the lawsuit capital of the world, not the countries that the so-called illegal alients come from.

Furthermore, many immigrants actually speak far better English than Americans do because they study it formally.

So how should Apple advertise Siri if it were up to you?

Um....like every other software company on the planet: they don't advertise something that is "beta". Do you see ads for MS Office that are in beta...that you can buy right now? Nope. There may be products "coming soon" such as MS Office 2013 or Windows8 or Mac OS _____. But don't advertise AND SELL something that is beta.

wow if this guy is suing apple because they are over exaggerating siri then that man might as well sue apple for doing that to every product on there line...

Apple said Siri is a beta feature. Who sues someone for a beta feature not working?

During the keynote? On their website.

Newsflash - there are, I am certain, millions of people that have seen or read neither. They went into the Apple store or their ATT/Sprint/Verizon and simply said they wanted the new iPhone. Many of the same people even if they saw they word "beta" wouldn't know what that meant either.

Isn't the responsiveness of Siri is based on your network connection? In comparing a friends 4S who has Sprint and anothers who uses Verizon, the Sprint phone may not get an answer from Siri while the other works fine. If this guy is connected via wifi and has the problem, he may have a point, but if not, the commercial is clear that the responsiveness is sped up for the commerical and that it varies based on network conditions. I don't really get how you can sue... If it's a false advertising suit, then apple should sue for that phone-and-a-half commercial where the dumbass woman keeps saying her iPhone can't do something that the other can.

The ads are completely misleading and do not mention anywhere in any way shape or form that Siri is beta (nor that it is next to useless).

Apple should not have promoted Siri so hard until it was a more workable product that they were ready to stand behind and not hide behind the word beta. Seriously - can you imagine if another company ran these types of ads for an unfinished product feature?

Whatever happened to earning an honest living??

what a bs comment. Apparently honest living means marketing bs can say whatever they want and honest hard working lawyers cant make a case against it. Anyway the judge will decide if their claims are valid or not, not you, and certainly you cant deride them for making a dishonest living when after years of study they are practicing law.

Oh come on. I think most people know what beta software is. And if not, they should ask the salesperson.

When Siri has been up it has worked perfectly for me, the only exception is in my car (turbo back exhaust with no cat), it is just too loud. My only complaint is that the servers go down so often.

What happened to the time when people who were dissatisfied with a product or service just went over to a competitor? Now we have to sue when we're not happy?

Many people are very happy with Siri. Technologically we are not ready to have voice recognition work for all (accents, languages, dialects...). We're just not there yet. Why shouldn't some enjoy a feature meanwhile even though all can't?

Will we be seeing lawsuits about Samsung's Note soon? The pen clearly doesn't have a brain but the commercial said it did. I'm sure someone is willing to make money off of that.

lol "honest lawyers"

I was going to write something nasty about this, but I decided that this idiot doesn't deserve much attention.

He must be starving for money just as much as his lawyers.

Just take your phone back and get over it!

I didn't sue HTC for making such a crappy piece of junk they called TouchPro 2.

All people I know that use SIRI loved it, so for one moron to have trouble with it because he can't speak right, it's stupid to sue.

"SIRI! Are you talking to me???"
