I'm not sure how you can not copy the iPad somewhat, touchscreen ...check, rectangular shape ...check, cameras ...check. speaker ...check. etc. etc.

Google for Apple's design patents. What Apple has protected is very, very specific. And I bet you that Jon Ive would have no problem creating another tablet that is no copy of the iPad or iPad 2. He's probably going to call it "iPad 3". There is a story about Raymond Loewy, who was hired by a company whose design for some machine had been copied by a competitor. The competitor claimed in court that due to the function of the machine, it was unavoidable to copy the original design. Loewy appeared in court and showed the judge three completely different designs.

I get the reasons as to WHY they're doing it. But, really...enough already...

I mean, are they going to go and sue Sir Issac Newton's family about the "Apple"? Or it's misuse?
 
It's obvious to everyone that all these tablet manufacturers didn't out of the blue get the idea to include a mobile OS on a tablet, rather than a full-fledged desktop OS like Microsoft seems to still be trying to do... Not that there's a better way to do it or anything, but all these Android tablets are just mimicking the iPad, like Android did with iPhone OS in the first place.

Nokia included a "mobile" OS (Maemo) on their Internet tablet back in 2005.

The Xoom's design, dimensions and features are vastly different to the iPad and Honeycomb is different compared to iOS. Having some extensive time with both OS's, they're completely different (customsation, application launchers, browsers, media playback, connectivity e.t.c).

I understand the JayTech tablet, which is a complete ripoff of the iPad, but the Xoom has its own design completely. Nobody buys it anyway because it starts at $800 and is a piece of @#$% :p

I totally agree Apple does the tablet right just like the iPhone and others just follow that.
But I also think that Apple can not patent the idea of putting a mobile OS in a tablet. So Apple can not sue other companies based on this.

EXACTLY. The tech companies thought it was such a stupid idea to put a mobile phone OS on a tablet, but once the iPad blew up, they all bit there tongues and did the same exact thing. :mad:
 
Everyone is suing everyone else for patent infringement. Why don't they mutually agree to either open all the patents--thus paving the way for true innovation and exciting new products, or just pay each other royalties? It will probably all come out even in the end.

I agree... I'm getting really tired of litigation as opposed to innovation.

Copy? There are only so many ways you can design a tablet. It would be like Ford suing Chevy for building a car with 4 wheels and an engine. But the OS is what really matters, and Honeycomb doesn't look a thing like iOS. If you see any resemblance to iOS in that screenshot, you're blind.

Do you seriously think that the Xoom looks like the iPad? Sure, Motorola followed Apple into making tablets, but you can't sue for that.
 
That Jay-Tech tablet looks like an iPad, but the Xoom does not. If Apple wins an injunction against Motorola then I would venture to say that the community design registration for the iPad in the EU is not specific enough and probably should be challenged.

I personally thought the Galaxy Tab looked different enough to me, but I presumed that there must have been key aspects that Samsung was infringing upon. But if this design registration is broad enough to cover both the Xoom and the Galaxy Tab then I am becoming a bit skeptical about the validity of it.

With Samsung I am a bit less forgiving because of their design infringements in the phone arena and because they redesigned the Galaxy Tab AFTER getting a look at Apple's iPad 2 -- there is both a track record and clear declaration of "going back to the drawing board" after getting a chance to look over Apple's design.

But Motorola clearly designed the Xoom in-house and probably drew inspiration from the same sources that Apple drew inspiration for the iPad. There is not much chance of mistaking the Xoom for an iPad if you are reasonable familiar with the products.

so ever 2nd digital picture frame thing is an iPad rip off too? its a freakin tablet, how else is it supposed to look. its like saying a laptop is a mac book rip off and vise versa
 
Looks like the also-rans are in for a spot of trouble.

Time for them to step up their game.

Not that the Xoom was really a threat in the fist place. Moto can hardly get units to move. It's the example the counts.

What aspects of the xoom do you think are like the iPad?

Home button placement? Port locations? Camera locations? Logo placements? Button placement?

Or is it all about that black bezel?

I can't see any specific design feature that the Xoom copied other than the black bezel, which is not enough to be a "copy". On the other hand, the Jaytech looks like a Chinese knockoff of the iPad.

Although I think that the iPad is the best tablet out there by far if anyone wants to call me a Droid fan.

Someone needs to sue Apple for making a black rectangular smartphone with a touch screen and that ran apps. I had one of those 5 years before the iPhone.

I don't feel like the current patent troll climate (in software or hardware) encourages innovation at all. You may have the next best thing in apps, hardware, or whatever, but because of some ridiculous patent like "clicking a link that communicated with a server" (or some other insane stuff) people either get sued into oblivion or simply find another job.

Often the little guys are the ones who are squashed or simply threatened like a geek oriented episode of the Sopranos.

There has to be some kind of middle ground. If Apple come up with somethng that works well they should be able to protect that from bring copied, but at the same time somethings shouldn't protected.
