It's all the r&d efforts, their Intellectual Property (IP), then the patents granted to protect them, then protecting them.

If apple's patents are being violated then they have to sue, simple.

There is nothing wrong with protecting your IP.

To be honest, Apple deserved to lose the multi-touch patents; and I hope they lose every time they sue a company for that.

But samsung is absolutely shameless. They have copied all iPhone designs from iPhone 3G to iPhone 4; their keyboards; their UI. Samsung is disgusting. If Apple made a friggin refrigerator, they would have copied that as well.

If some people have a Nascar race. Jeff Gordon wins and Busch comes in second. Everyone says Busch was first because his car ran more smoothly the entire race.

It doesn't work there so why do you think it works now. No one ignores first place. Apple was not first deal with it and give the prada a shred of respect. It did cross the line first. It may not had the cleanest race but it came first.

(I think those are Nascar drivers. I like football not left turns)

Prada was no where close to the iPhone. Are you kidding me?

Also, most people prefer 18 months contracts rather than 24; so the contract cost goes up a bit. :)

That's the advantage of the UK, we can buy the iPhone outright and unlocked, get it on 12, 18 & 24 month contracts and also get it on PAYG.

There's plenty of choice to suit most needs and it hasn't seemed to have 'eroded the iPhone brand'. :)

Wikipedia is wrong on that.
The LG Prada (which really looks nothing like an iPhone, seriously) is resistive. You can ask any LG Prada phone user. (Oh, right, they're almost all gone now...)

EDIT:
Just in case you don't believe me or actual people who use the LG Prada phone... here's linking proof: http://c2499022.cdn.cloudfiles.rack...ent/uploads/2007/04/lg-prada-sb310-lb3100.jpg

You could also ask LG

Features
" Capacitive Touch Screen

shrug.

I am not agreeing with that guy that the price points are trying to erode the iPhone brand (which to some extent they are).

But releasing a KIRF at a cheaper cost is bound to create such tension and frustration among the company with the original product.

It's high time and its intolerable.

Exactly. Some people are just blind, hating on apple for the sake of it or are in denial with weak arguments.

Does make you wonder why they even bother following an Apple news blog.

I've noticed a huge anti-Apple thing here, when this is meant to be a fan site!

Hate to say it, but I find AppleInsider a little more grown up. This place seems to be infested with 12 year olds.

Why? Apple spent time and money researching it, and have the patent (assuming they do). Why shouldn't they defend it?

Ok, lets say you spend time and money developing something, and everyone copies it because it's just so good.

How would you feel when they turn round, stealing your sales and tell you "well, it's just so good it should be a standard"?

Even in my own events, we research ideas, research places, make good routes, and then spend money driving those routes and visiting those places. What we got for our trouble was nooby competitors copying our research, copying our routes, even copying our website! Hell, some of them even started using our ********g pictures from our events!!

And then they had the gall to call themselves "the original events company"??? WTF???

This place was great until the haters came in. Rewind back to 2008 and we are good.

But this is the internet, deal with it.

Yes, they should be credited for it.

In 2050, when some one reads about an iPhone, it should read that Apple invented pinch to zoom and other multi-touch wonders. [ci needed]

But having patents on that? It's ridiculous. What if some one had a patent on clicking on a trackpad OR clicking on a mouse button OR ...

These are basic things; absolute common sense which apple should be credited for; that's all. They should never have patented it.

To be honest, Samsung off of all competitors, deserves that.

- iPhone design copy? check
- iPhone UI copy? check
- Apple keyboard copy? check

Everything is copied.

Samsung deserves that and I am sure Samsung will lose this.

Only the front is similar, so uncheck.

The App Drawer check, but everything else, uncheck (Have you seen samsungs camera app? It pushes the iPhone's down a flight of stairs)

Keyboard? Uncheck. Galaxy S keyboard loks only similar in the fact that it says QWERTY on it.

As an owner of a galaxy s phone, I do see why Apple is scared. The phone kicks ass, and is much more open than the iPhone (When was the last time you could freely view files on your iPhone without a complicated jailbreak?)
And the Galaxy S2 will only make things worse for apple...

So, all this back and forth, do we have any ideas on what are the exact claims Apple has on this ? "Look and Feel" is a lost cause thanks to "Apple vs Microsoft" and it can't be patented in the United States where this lawsuit is filed.

Which patents exactly is Apple claiming Samsung infringes ?

Looking at the TouchWiz UI, I see your point.

But, at what point does an interface become too generic? For example, the concept of pages of icons in a grid isn't really new or innovative. The concept of swiping across screens is simple and intuitive and should be standardized
(e.g. copied) for that exact reason. Should other phone makers put the icons in a circle, "just because" they need to be different? Should they force you to do something differently just because the best and most intuitive way was "already taken"?

Everyone loves car analogies, so: what if Ford decided to sue other carmakers because they copied their steering wheel design? Would other companies have been forced to adopt other types of controls -- joysticks or dials or foot pedals, perhaps -- "just because"? And would that have been good for the auto industry?

It only comes generic when apple does not sue for people ripping off their iphone, thus why they need to sue. Lets say 5 companies rip off apples iphone look and their interface, and apple does not sue. It would become generic and apple would lose their patient.

whatever. Other then the dock, the layout is pretty much like every other Android phone and tablet. So I guess Apple has to sue everyone.

Sounds more to me like Apple is afraid of the Galaxy line gaining on the iphone ipad line. Which is silly of course. Even thought I think the Galaxy line is better. I own both ipad and galaxy phone

That's not how patents work. You're thinking Trademark. The article here says we're dealing with a patent lawsuit.

If Apple keeps a low profile for a while with a patent and waits for Samsung to be successful (which they are with the Galaxy line, it being one of the best selling Android device), they lose the capacity to sue for punitive damages, they can still sue and get actual damages though.

Patents do not have the "made generic" clause of trademarks, nor can they be invalidated from lack of defense or selective defense like trademarks.

Here's what I have:

Samsung will come up with actual numbers sold, not shipped, finally. Apple will see how few it is and drop the suit.

Actually Apple has excellent intelligence and already has a close enough estimate.

It seems that since there's only so much one can do with the shape of of smartphone, Apple is Attacking out of fear.

It's all about little Stevie's ego as usual.

After all instead of paying dividends to those of us who believe in Apple and buy stock, why not give it to Apples legal team. It makes for better headlines.

Besides I'm upset he didn't sue Cadillac, my neighbors Escalade has four wheels just like my BMW X5!

Sheesh, I think Samsung's product looks like the 3gs and side-by-side it shows how similar they are. If I recall it was fairly recent the 3GS was no longer being sold as a new phone so who really cares? In total the similarities are striking and enough to so warrant the lawsuit, but its not like Samsung has an iPhone4 look-alike that I have seen.

I admire Samsung for their overall build quality and technology. It seems they could use a bit more inspiration in their application of design. But their implementations are usually stable and reliable. I've had several Samsung phones prior to the iPhone and they and other consumer electronics I've had and seen are rock solid.

Its not like other manufacturers are not trying to ride the iPhone smartphone market. Even Android has a similarity in static images to the iOS.
