It is honestly quite astounding the lengths some people will go to deny giving Apple any credence at all...

Posts ranging from 'Oh it's just a generic design' to 'Apple didn't innovate anything because LG, Sony, Nokia, RIM, Palm etc all had phones BEFORE the iPhone...'

And then there are the other lot who while having to grudgingly admit that Apple's design has indeed been copied, then moan because Apple are actually going to try and stop a rival from ripping them off..

There were phones before the iPhone, but because the iPhone introduced such 'revolutionary' concepts as a fantastic UI allied with great design...

Lo and behold it became wildly popular..

You might want it to be because of some amazing scam pulled on us all by Apple.

You might want us to believe that actually the Treo/Prada/blah blah blah phone were actually infinitely better than the iPhone...

but you are wrong... not a little bit, not slightly off, not bending the truth....

It appears that Samsung, as a manufacturer of Apple components, had an easier time duplicating the experience and design of Apple products than is usually the case. This led to Samsung products that are too similar to Apple's to ignore.

Samsung should get a creative team together and tell them they are not allowed to look at the products manufactured for Apple.
 
Apple did assert trade dress claims, which fall under trademark law.

That's the point really, does anyone even have the full claims Apple is bringing forth so we can discuss this intelligently ?

What trademark do they have over the "look" of iPhone and iOS ? Without a registration, they're are a bunch of damages they can't claim (punitive ?).
 
People need to stop mentioning the Prada. It wasn't the first device with icons in a grid or a touch screen (neither was the iPhone). That's not the issue here.

Samsung blatantly ripped off virtually every design element of the iPhone, which the iPhone did not do with the Prada. Here are some examples:

#1 Size of the grid - both 4 x 4 (Prada was 2 x 3)
#2 Shape of the icons - both square (Prada was circle, win/mac/palm are app dependent)
#3 Placement of the dock - both bottom (obvious, but still copied... Prada was on the side)
#4 Size of the icons in the dock - both the same as the icons in the grid (Prada had smaller icons)
#5 Page indicators - both use dots (As far as I know the Prada had no such thing)

Once again, the problem isn't that they copied the idea of of a grid of icons, but rather that they copied every element of Apple's implementation of the grid, along with hardware design and accessories. There's a line between inspiration and copying and I think Samsung may have crossed it.

You cant defend UI in court.
 
While I dont know any laws regarding this issue, Im very surprised at the negative reaction some members are having for Apple trying to defend their work.
Its been posted before. The mobile world wouldnt be clutterd with wanna be iphones and ipads if there werent an iphone and an ipad to copy. True, Im sure technology would have arrived there eventually, but in a very non Apple way.
Its surprising to see that year after year, Apple is still somehow able to innovate tech in such a high degree that the entire tech world pauses to hear what Mr. Jobs has to say. When Jobs unveils a new product, its almost the equivalent of a World Presidential Address. You better believe that all the major tech companies of the world of also waiting in anticipation, just so they can jump start there own similar products.
Seriously, 2 years ago the Windows world was trying to push Netbooks as the next big thing and now they're almost extinct.

Why spend millions on R&D when you can just wait and see what Apple comes up with and either copy or improve upon it.
 
Oh yeah. I wonder what everyone here that has something negative to say, how would they feel if it was their work that was being copied? Seriously. People complain about companies and people trying to defend their own work. Just like those people who cry because their Limewire doesnt work anymore. Why shouldnt an artist or movie studio get payed for the work they did? I hate Lady Gaga's music, but just like any other artist who spends hours, days, weeks, months at the recording studio, touring the world giving concert after concert, countless magazine shoots, interviews, tv show appearances, paparazzi, etc. Artists deserve to get paid for the work they produce, just like Apple has the right to defend their own products using the law.

Great way to "get back at someone" ... Sever your ties with them so you can't sell millions of your products to them anymore. Who else is buying the same quantities of tablet-sized displays and other components, that they can make their replacement customer?

couldn't Samsung simply get back at Apple by NOT making Apple's stuff? I mean, come on.
 

Well then I guess the Prada phone they sold in Korea are totally different from what they sold overseas. I know the difference between resistive touch screens, and capacitive, and the LG Prada phones I've seen are NOT capacitive.

So, as I've said in another post, either there are two different types of phones, or someone is just confused. I guess it's the former.

Funny, Apple specifically mentioned the UI, so they think they can. If you can't defend the UI, why do people keep bringing up the Prada (although the UI's are very different through anyone but an apple haters glasses)?
 
ITC suggests to judge that Apple lose suit against HTC/Nokia

In the meantime, the ITC has just yesterday recommended that HTC and Nokia should NOT be found violating the patents Apple brought against them.

ITC staff says HTC and Nokia didn't copy Apple

(If you recall, the suit against HTC was considered a proxy attack against Google by Apple.)

The patents involved included rubberband end-of-page and slide to unlock, IIRC.
 
I am having a good laugh watching all the "industry plants" hate on Apple because they can't make a quality device like the folks over at Cupertino. LOL

When companies are desperate they have to resort to desperate measures like having their employees infiltrate a Mac forum. So lame but hilarious.

I noticed that iPads are prevalent in hospitals. I would stay clear of an ER with staff running Android. Why is it that hospitals choose iPad? Can you imagine someone's life depending on Android? ROFLMAO

It's funny that on this site when other companies sue Apple, it's assumed to be unscrupulous patent trolling, but when Apple does it, it's a noble defense of intellectual property.

That depends on the company suing Apple. Many of the companies that sue Apple are patent trolls.

Wrong!

Both parties are correct. Apple did rip off other people's design and UI and tech. But they improved greatly on them and made it much more usable. They did use other peoples tech non the less. You believe just because the others where not as easy to use, were failures, and just plain sucked that it does not count for them.

Better yet, let's ask physicians (whose job it is to preserve human life) why they choose iPad over Android?

I've noticed a huge anti-Apple thing here, when this is meant to be a fan site!

Hate to say it, but I find AppleInsider a little more grown up. This place seems to be infested with 12 year olds.

Just because I like Apple's products does not mean I have to like Apple :)

I've looked at the complaint. It's gargantuan. Tons of claims. 10 patents (7 utility and 3 design), etc. I didn't read it with enough detail to determine whether they registered the trade dress, but I think they did. (If not, state law damages are still available).

No one's life depends on Android or iPad or any damn tablet. What the hell did you think they used before tablets just a year and a half ago? The tablets are being used to access patient records, that's it. Nothing that old fashioned paper and pen hasn't done well for the past century. The tablets aren't being used to perform surgery, you have nothing to worry about if a hospital uses Android :rolleyes:

Now, if you're severely injured in a car crash or having a heart attack or stroke, you want to do some hospital comparison shopping and see what tablet platform they use before deciding which one to have the paramedics take you to, be my guest.

Many hospitals had been using Windows based tablets all these years, for a couple of good reasons:

1) They were often specially designed so they could be sterilized often, which means closed ingress ports for one thing. One can only imagine the iPad moisture sensors in this case... assuming anyone bothers at all.

2) Using a pen was more sterile than finger swiping and potentially carrying germs from patient to patient.

I just checked. They did register the trade dress. 3,457,218, 3,475,327, 3,470,983.

They also sued for trademark infringement (also registered), including the phone app icon, the chat icon, the photos app icon, the settings icon, the notes icon, the contacts icon, itunes icon. (Not their most compelling arguments, IMHO, though some are more direct rip-offs than others).

They also sued under california law for trademark related stuff.

The complaint, with exhibits, is 373 pages, btw.
