Apple believes that Masimo's patent(s) are invalid and is therefore disputing them. If they felt that they did not have a case, they would likely settle with Masimo and move on.

If things go south, Apple could offer the Blood Oxygen app as a purchase on the watchOS App Store for the price of Masimo's license fee. That would mean that Apple could continue selling their current models as-is and only customers who wanted the Blood Oxygen feature would need to foot the bill.

Alternatively, they could drop the Blood Oxygen feature from all models except the Ultra.
 
Masimo's complaint about poached employees diminishes the value of any other, even valid, claim by them. Their employees aren't chattel.

Someone absolutely need to sue this company out of business. Clearly they want Apple to discontinue the watch outright.

If Steve Jobs was alive, he would’ve punched the ITC and moved the company out of USA at this point.

Would not be surprised if they decide to target Vision Pro next as soon as health feature is put in. This company wants to kill Apple using any means necessary.

Masimo? Yes. Already stated in this thread that Apple will simply drive them into the ground financially, the investors will change their board and Apple will get a good deal or Apple will conduct a hostile take over (prob through proxy) and get the tech at cents on the dollar.

The CEO of Masimo filed a declaration to the Court to overturn the stay of the ban. In that declaration, he makes a point to talk about the price difference between the Apple Watch SE and the Apple Watch 6. He implies that the only difference is pulse oximeter in the 6. The 6 cost $120 more than the SE when they were released. He's laying the foundation that the value of the pulse ox to Apple is $120.

This effort falls in line with the earlier rumor that I heard that he's asking Apple for $100/watch. That would be more than $5 Billion/Year. A totally ridiculous ask for the patent they are trying to enforce. Those of you who think Masimo has been coming to the table in good faith are being ridiculous.
 
No. Apple copied Masimo's hardware. Doesn't mean the algorithms are the same.

Everybody licenses ARM technologies, but it doesn't mean everyone's implementation performs the same.
I wouldn’t say that we know 100% if Apple copied Masimo’s sensor. Would be interesting to see X-rays or architecture design documents.
 
I'm supposed to believe that a demographic with some of the poorest eating habits and who consider watching a sports game to be exercise is upset about a feature *they never use* are going to return their watches? Is this droll self-mockery?
 
This isn't even a question—100% certainty it will only be disabled on newly sold Watches.
Why isn’t this a question? The current interim injunction is only a sales ban, for now. In case they keep winning they will also claim damages for the already sold watches. In this case the court will define what apple will have to pay in damages. If apple does not want to pay, they have to remove the function. There are enough other cases out there where it went that way.

So what's it gonna be Apple? Are you gonna actually pay Masimo? Or are you actually gonna sell your customers a gimped Apple Watch?
If it’s a choice between gimping the Apple Watch or paying Masimo, I think we all know which choice Tim will pick. Of course Apple could just raise the price of the Apple Watch to cover the licensing fees, but that could potentially tank sales.

Masimo hasn't proven any of that, and have essentially lost on almost all of their claims.

The vast majority of commenters here are simply parroting APPLE BAD because they can't spend 10 minutes looking into what a disaster Masimo is, and the actual facts involved in this case.
So then can you list these facts that everyone is missing if they’re so important?

Apple infringed on a patent that was rightfully held by a much smaller company. They blatantly stole it, used it in one of their key products, and didn’t bother to pay royalties. This is what a court has found.

So what are we missing here? Educate us, oh wise one.
