While both are popular pieces of software, there's practically no risk of consumer confusion between the game and OSX. They could still apply for it, and get it.

Except perhaps when trying to find anything related to "OSX" + "Diablo" you'll get a heavy mix of results related to Diablo the game and Diablo the OS running on a Mac.

I think lawyers just trademarked these so they have them if they want to use them. There's no way the marketing department approved Mammoth. There's no way they want you thinking "giant" and "extinct" about one of their products.

I've never referred to an OS X release by name, but these names all suck spectacularly. I still think 'Mavericks' is the absolute nadir, though. Unbeatably awful.
