I wouldn't loose any sleep over stiffing ATT or Apple over the extra phone. I'm guessing, though, that no matter how long you hold on to it, the second you activate it, they'll figure it out and bill you. Might also get charged with steeling it (that would be my luck). Tough call.

Sounds about right, good thing no one ever in the history of the world tried to improve things for other people. That's just a lazy, convenient way to think of the world so you never have to feel responsibility for anything because people are just bad. You're just as bad if not worse.
 
You're a lawyer? You work in law enforcement? Acceptance of an item you know you aren't entitled to can constitute theft. It doesnt matter how it came into your possession. This thread would absolutely prove the recipient had knowledge that he wasn't entitled to that property.

However, I do believe the op is full of it.

well if he didnt sign anything they cant prove he ever got it and technically it was canceled so they cant do shiat about it

even if they charge him for it he could ask for his money back because he officially never got the phone they charged him for

Similar stuff happened with me with sena iphone case... Ordered one... but got two in the box... I emailed customer support about the second one and told them I was making sure i wouldn't be double charged... they said sorry about that and told me to keep it-no charge.

Same thing happened to me with SwitchEasy. Ordered a case and received it. Then, I randomly received the same case again. I contacted the company offering to return it, but they said to keep it. Granted it's a $30 case and not an iPhone, but, I still think the best option is to contact the company.

In response to your edit: I'm aware that situation wouldn't be theft. My counter would be: you invite me into your home. I take my watch off and lay it down. I ask for the watch back the following day and you won't return it. There are many varying levels of malice to his equation that would likely define the case. I'm not arguing with you on this particular case though. I was unable to find anything other than laws on unsolicited goods.

again though, one would still have to prove that the watch belonged to them and that you didn't give the watch to me. Possession of property still holds a strong place in the eyes of the law. It is a bit easier to prove ownership these days with serial numbers etc. but if the person disputing ownership can't prove it was stolen they are sol

Let's be honest, here. This wasn't an unsolicited gift mailed to you by a donor. You placed an order for the product. While you did everything you were supposed to do to cancel that order, for whatever reason it didn't get canceled. The mistake was on the carrier's part. Should you be able to profit from that innocent mistake? Do you wanna "stick it to the man"? Only you can make that decision. I can say with full confidence, however, that you would do whatever you could to NOT allow the carrier to profit from an honest mistake YOU made, and you would (rightfully) conclude that it wouldn't be fair or equitable for the company to be able to do so. So why are you looking for internet justification to do that very thing? And just because some posters might give you that sought-after justification, does that make it right?

You're the one who has to look yourself in the mirror after you make your decision. You're also an anonymous poster, so no one - except you - will ever know the decision you ultimately make. Remember, though, that character is doing the right thing when nobody's looking.

No, they cannot prove he got it, unless he signed for it. Why got give it a shot. It does not hurt. Its a multi billion dollar company, I wouldn't worry about screwing them over.

You could make over a hundred excuses as to why you should keep the phone, but at the end of the day, it's still excuses.

Sure AT&T screwed the order, they made a mistake, they might also be one of the worst blood sucking companies on the planet, but keeping the phone still equates to stealing.

The company is obviously unaware that they sent out two, but you are not.

Be honest is all I can advise. You might get a charge on your card a month down the line, you might not, the reason you came here for advice is because you are obviously wrestling with your conscience , you want to badly override that voice that says "Be honest"
 
They sent me an extra lightning cable and a 30 pin to lightning adapter free of charge. I'm not asking any questions...

to me that is totally different though, they didn't send you an actual iPhone free of charge. They may have thrown those in for inconvenience or something. When it is little things like that I have found that when I ask questions or mention it I always end up getting burned by trying to do the right thing, of course my conscience gets to me and I still do.

This is an iPhone, if they find out it disappeared (even if they can't prove you received it) they may turn it into a brick and whoever you sell it to then gives you money for a useless phone. Too many what-ifs, do the right thing.

It has nothing to do with me, I'm just saying don't be surprised when people act greedy because history says there will always be a ton of greedy, selfish people. I don't use this as a convenience to think of the world, I use it as a defense because there is always trying to screw you over because they're, wait for it, greedy

All I will say is that the OP is the type of person that will find a phone in a store, and instead of making an honest attempt to find the owner, he will just keep it. He really made this post to gloat that he got a free I phone, and to see if there can be any repercussions.

I wouldn't keep an iphone. For two reasons:

A: I know it is wrong, and DO believe in karma
B: I also am smart enough to know that it probably WILL come back and bite me in the arse... which, well, is kinda like karma.
