This happens every new iPhone someone will post they were sent 2 and they are keeping them. Happens every year and the OP will probably never be heard from again.
 
If you had been raised by both parents who were ethical and moral, you would not need to be asking this question.
 
I say send it back. You obviously know it's not yours if you created this thread in the first place. The might realize they sent you an extra one. They might not. They'll charge you if they do. Simple as that.
 
They sent me an extra lightning cable and a 30 pin to lightning adapter free of charge. I'm not asking any questions...

You're a lawyer? You work in law enforcement? Acceptance of an item you know you aren't entitled to can constitute theft. It doesnt matter how it came into your possession. This thread would absolutely prove the recipient had knowledge that he wasn't entitled to that property.

However, I do believe the op is full of it.

Actually, I am wrong on this one. My bad.

I'd swear I'd seen this same thing before with the recipient being charged (and the charges dropped). I would confirm with the recipients state laws for receipt of unsolicited goods.
 
These big companies figure out their mistakes when it affect them. They will charge you, they will activate the line. Then you will have a real mess.

what you're thinking of is if you buy a product from someone, say off of craigslist. In that case you could be charged if it was stolen (they rarely charge the buyer though). In this case the product was not stolen, apple just willingly went ahead and sent it to him. No law is broken

look at it this way. Person A greatly dislikes person B. Person A sends Person B a "product" of little value. Person A presses charges against person B for "stealing" said product. Person B goes to jail. Sound like a "law" you would want?

Nah, I'm aware it's a crime to possess stolen property. I don't think I could have confused it that badly. I could have sworn that I read something more specific to this particular scenario. Maybe the facts or country was different.

In response to your edit: I'm aware that situation wouldn't be theft. My counter would be: you invite me into your home. I take my watch off and lay it down. I ask for the watch back the following day and you won't return it. There are many varying levels of malice to his equation that would likely define the case. I'm not arguing with you on this particular case though. I was unable to find anything other than laws on unsolicited goods.

I'm sure their accounting will rectify this problem and charge you for the full price of the second phone.
Its best that you take it back, and get a receipt or other proof of your return just in case they do want to charge you anyway.

ATT send me an extra iphone too. But after a week or something i saw the charges on my credit card.
 
Just return it. If you haven't opened the phone it can go to someone who is waiting for theirs.
 
What's funny to me (and honestly couldn't care less what people do like erratikmind said) is that people are super quick to jump on an opportunity to steal or cheat (yes, it is what you're doing) a company, however also get highly offended if someone tries to do it to them. eBy scams, CL scams, what have you, if you're the one being wronged its' the worst thing in the world, but if you're "screwing the man" then hey, they deserve it anyway, right?

Actually, let me back up for a minute because I in fact do care, because it effects me. You think that losses like this are somehow just absorbed into the company and they don't care? Service costs increase because of things like this; CS quality goes down, and people with legitimate problems have a harder time because companies have less relaxed policies due to fraud. So yes, have fun with your free phone, but remember exactly who screwed who here when you have problems in the future.
