Gave it another try, with the IMEI route
My iPhone 4 was replaced a few months ago by Apple under AppleCare after it got wet. So, I knew my IMEI wouldn't be the same on my account. So, I wanted to see if by chance I could squeak in under my new IMEI. Below are the results:

Me: It was a replacement phone that Apple sent me when my other was damaged
Wendy : It would still be under the contract on that line and could not be unlocked
Me: But it can be unlocked when my contract runs out?
Wendy : Yes it can be
Me: ok, so there's no wiggle room on letting anybody unlock before the contract runs out?
Wendy : No sorry, the phone needs to be out of contract.
