Got an email back from atomic. Initially they stated that while they would refund my purchase price (upon return obviously) that they would not refund shipping as they qualified my reasoning as "changing my mind". I explained to Ummi (not vinnie, my bad) that I "changed my mind" because apparently reception problems were so severe that they are redesigning the case, and that concerned me. In addition, he confirmed that I was sent the OLD design...
After a little bit more back and forth, Ummi agreed that if I paid to ship the thing back, he would refund the original shipping, which is fine with me. While I find it a bit disturbing that I had to claim to be submitting a large business order to get a phone number (and that response, mind you, was almost instantaneous), I do appreciate that in the end they've done the right thing.
I did ask him why they would continue sending out a design that they KNOW is flawed...to the point where they redesigned the case, and here was the response (along wiht much of the email thread as a whole). Basically, Ummi is saying that the issue is

We knowingly send out the cases because most of our customers are not affected or have insignificant impact having the case on. I personally have 5 bars with or without the case
We sell about 50% USA and 50% international. If and when Verizon pairs with iPhone this issue would be moot. When you are dealing with aluminum it becomes a challenge. We can of course make a 100% signal solid case out of plastics and rubber but it is just not the same.

You bet I changes my mind when I read that the reception issues were enough of a concern that you are redesigning the case. I don't blame and in fact praise you for that. What I do question is why you would continue to ship a knowingly flawed product?

In any event, I would still suggest steering clear until the new design is out for a bit and has been put through its paces, but it's good to know that with a minimum of "push back", they'll work with their customers...and to be fair, this is more back and forth in one day then I got with Element since I pre-ordered in August (which is NONE).
