The two are not comparable. There are laws that protect the consumer from selling a vehicle, as new, without disclosing it has been wreaked. Apple can do as they wish.
You seem to be assuming that unless there is a law preventing something occurring, anything is ethically and morally acceptable. Although you are technically correct concerning how the law may be applied (although in some jurisdictions it is not legal sell a used item as new), my comment was about what is morally and acceptable to you. For me the idea that Apple could be persuaded to to give me back all the money I paid for a new item for a used, damaged and repaired item seems a little morally and ethically suspect, but then that is me.

Applecare - probably no
Phone - May be.

Just bring it to apple store and see. When they scan the serial number, it will tell you whether they can or cannot take the phone back.

PS. take emphasis on the word 'should'. The person never said it 'will' fine, they said 'should' be fine. That means there is going to be an element of doubt as to whether they will actually accept it or not. Is bad though that none of the stores can give the same answer. All Apple stores should be operating under the same company procedures. If they are not then something is clearly wrong and not working because an Apple store is supposed to give the same answer when asked the same question. Apple corporate need to get a handle on this.

In reality, Apple Stores have a lot leeway. For example, if you take a dual physical SIM iPhone to a U.S. Apple Store for battery replacement, some stores will do it, while others won't.
 
As long as the repair was done by Apple themselves then yes it can returned. If Apple refuse it then it would question the integrity of their own repair process - the parts and the engineer performing the repair was one of theirs after all.
It is possible you may be charged for a month of Applecare+ considering you have claimed on it and used it, but the 14 day cooling off period still applies. For all they know, your mother dropped the phone and has lost confidence in using it since it is too slim for her - hence you have paid for the repair before returning.

In fact, Apple explicitly makes you sign a repair work authorization which allows Apple to use new or used parts.
 
Yeah, there is definitely some contention around this issue! I called 3 different Apple Stores in my area and each had a different answer. Some said yes, the phone would be returnable if the screen was replaced by Apple under A.C.+, but it would not be returnable if the repair had failed and the Apple Store had been forced to swap out the entire unit instead of simply repairing the display. Meanwhile, other stores said that the phone would not be returnable under any circumstance, because a repair had been made. And another store said that yeah, as long as you have the original receipt you should be fine.

Because it basically comes down to a goodwill gesture at the store. Stores can override some Apple policies for customer goodwill. Based on the terms and conditions of return, it must be in "original condition."

AppleCare+ warranty repair terms explicitly state Apple may use new or used parts. This automatically disqualifies it from return. Nobody can dispute that.

Can you return it? It comes down to luck.

Of course it is, I am more than old enough not to be that naive but I do not have to tolerate unethical and immoral people and I do not need to keep supporting its behavior. You need to wake up, just because the world is full of unethical and immoral people does not mean you need to condone it.
 
I purchased 16P recently. Did a few (around five) exchanges due to wanting different colour, and sometimes noticeable defects/imperfections. Every time I returned the device, they did this diagnostic using to see if everything is still on 'original condition' (whatever their definition is).

If there's a store that says they accept, I'd go to that store to get it swapped ASAP.
