People need to read the EULA instead of just blindly agreeing. Doing that would have answered the question without the thread.

To be fair, if you put up a good fight, every retailer in the US usually gives in to their return policy. Legally you don't have an argument as it is still 'coming later', but if you try, I think there is very high chance of success. Go for it.
 
While I understand the frustration (well sorta as I don't own a 16/16 Pro), the standard 16s are really great phones. They were the star of the lineup this past cycle. You know they will get the smarter Siri, so if it were me, they do everything else really well, and will get the update in time, I'd keep my 16/16 Pro.

I went from a 7+ to at 15+ in January just to keep away from the AI fiasco. It will take Apple until iPhone 20 to get it AI figured out. Meanwhile, my phone will stay on IOS 17 as I watch for the nuances that non AI IOS 18 causes. If it looks all clear, then I will update the 15+ to IOS 18.

My iPad Pro M4 is AI capable, but I am holding back on upgrading the IOS for the same reasons.
 
I do find it interesting that to sell the 16 range that apple intelligence was the main selling point specifically the personal context part which they marketed heavily , surely that would have some sort of legal problems for apple ?
and would be interesting if promises of apple intelligence helped to sell the 16 range .

Never buy ANYTHING, tech of otherwise, based on what is promised in the future. I bought my 16 Pro knowing I wouldn't use Apple AI, and so far, all is good.
That holds true for virtually every other product, but Apple is unusual in that they normally don’t announce products or features before they’re released or imminent. There are exceptions, but those are rare, and the ones that don’t ship eventually are even rarer. This one feels different, though, where it’s both a signature feature of their latest devices and also seems much more of an “if” than “when”
 
The current MacRumors podcast discussed this issue and the guy opposite of Dan brings up a good point. There’s an unfinished incoherence with Apple these days.

- Apple vision that too heavy to use
- camera control that is awkwardly placed

It’s seems as though testing and refinement didn’t happen when the negatives are so glaring. I had the 16 for a few weeks and didn’t like the camera control placement. And didn’t care for accidental presses. I definitely could live without this. I don’t have experience with the Vision Pro but I do see it often has a dedicated table that’s completely abandoned and empty.

Anyway, thanks Apple for saving me money and not pulling 1k from my pocket.

Certainly iOS 18 without improved Siri can still be used just fine.
True, at least now. My iPad with an A13 works just fine. It can't run AI anyway.

The original release of iPadOS 18 was a disaster, but I have to admit it is fixed now.

There are other articles on this very forum highlighting how Apple has changed the advertising of this feature now that it is delayed indefinitely. This was a, if not, THE main point in the keynote as well for the 16

.......but I am guessing you knew that already and being difficult because reasons

Considering that they have yet to be able to produce a bug-free iOS for the iPhone in the last few major releases, the lack of:
a) attention to detail and
b) producing a quality product is going to catch up to them in sales
Who needs a product that drains the battery so fast and can’t get mail correctly delivered?

When has a major release of any software been bug-free? Wouldn’t that defeat the need for a .1, .2, etc?
Each major release doesn’t seem to stabilize until the x.5 version.. In iOS 17 and now 18, the battery drain problem is prominent and annoying to users, just check out the battery thread.. just saying that more attention should be paid to items that are major selling points..IMO
 
Our society is in sad shape. If you needed a new phone you got a new phone, with expected upgrades some of which have come and some of which are coming. I would be embarrassed to say I expect a lawsuit for my stupidity.

OP, in what LEGAL construct do you even think you could do that? Particularly after the return period has expired?

It's surely not the United States.
You could certainly do it in New Zealand, if purchased for personal use. The Consumer Guarantees Act requires that products are fit for purpose, and that they're "delivered on time". A delay of a year would certainly not be considered to be "on time" (this provision also covers "services" in addition to "products").
