You could certainly do it in New Zealand, if purchased for personal use. The Consumer Guarantees Act requires that products are fit for purpose, and that they're "delivered on time". A delay of a year would certainly not be considered to be "on time" (this provision also covers "services" in addition to "products").
I'd be interested to know what Apple's advertising for the 16 series and AI was in New Zealand.

It's surely not the United States.

In the UK it could come under CRA 2015 S9 https://www.legislation.gov.uk/ukpga/2015/15/section/9 primarily 7c which can be inverted to state that the terms are likely breached if a public statement is made about a product which influences purchase before the contract is made.

Will there be lawsuits? Sure.

Will they go absolutely nowhere? Yup. Not every lawsuit, solo or class action, gets a settlement. Demonstrating the harms and that there’s a breach of contract on Apple’s side given all the disclaimers is far-fetched at best.

Lawsuits are filed every day. Not all are settled. Some have no merits and get dismissed. This would almost certainly fall into that category. I can’t even imagine there’s a “class” that a court would cert.

In-house counsel for big companies is top-notch, and most big companies have also retained the best law firms.

We do have false advertising laws here (USA). But you have to sue first. That takes time, and by the time everything gets resolved it's 2-3 years past the initial offense. So, OP thinking they can just return their phone because SIRI was 'cancelled' is laughable here.

It's something I hadn't really followed.

In September 2024:
"Apple Intelligence will be available [...] this December. Some features [...] will be coming over the course of the next year."

I suppose if this missing feature turns up by September 2025 or soon after then it would be acceptable, but if it's later in 2026 then it wouldn't meet the legal requirements. It's actually a bit more complicated than I first thought (I assumed it said "mid 2025" or similar).

This is 100x worse than the Apple Maps fiasco in which the future of Apple leadership was fired. Tim has had his time and milked the cash cow for all its worth. He has led AAPL down a path with no innovation, lagging all competition, hardware dominance, but software stagnation and outright failure. The board should give him his golden parachute and set him on his way and find a real innovator for the future of Apple. Someone who understands possibilities, who has an imagination, and a little bit more financial awareness than Steve. Someone who’s almost like Steve, which there are few, but who understands it’s a for-profit corporation and AAPL needs to be important. Steve cared about the customers. Tim only cares about the shareholders - mostly his own shares. Would be nice to have a founder type of leader who is building the future not living in the past.

I believe Apple will need to pay at least $300 per iPhone 16 model sold with the promises that failed to fruition due to it not even being real. I mean Jon Gruber said it best when he mentioned it’s all BS. What Apple needs to do is fire Tim, correct the wrongness by giving people 30 days to return any iPhone 16 model or iPhone 15 Pro model that was sold since Apple stated AI would work on these devices. People who bought an iPhone 15 Pro before the AI features were announced and advertised with 16 and 15 Pro models as built for Apple Intelligence with ads like the Bella Ramsey ad, should be entitled to a full and complete refund. Additionally, Apple could offer you keep your iPhone and get a $300 cash return due to the failures and downright lies by Apple executives.

All of this could have been avoided with a leader like Steve who wouldn’t have spent $25B on an Apple Car project or Vision Pro that isn’t ready for consumers. A leader who understands technology and where it’s headed. Instead, AAPL has a bean counter in the lead seat which is only good for shareholders. It’s been a disaster for consumers, employees, and any other stakeholders involved other than the shareholders.
 
The feature wasn’t “cancelled” but delayed. So no, no return because of this.
The feature isn’t even coming until when people could have waited and purchased an iPhone 17 instead…. LIES LIES LIES. Tim is all about the shareholders and the lies are coming through as we speak… Have been for years. Failure, stagnation, and greed lead Apple now.
 
Lets be clear, Apple are far from blameless here and I can understand the OP's sentiment.

However, no. It *is* coming but later. Sure, its *definitely* forced a number of previous iPhone owners to update prematurely but the missing Siri features are an important but smaller part of the bigger picture.

We already have a number of the promised features such as writing tools. genmoji, image playground, and picture editing.... just not all of them.

Of course there will certainly be 'mericans who will attempt to sue - they do love their class action lawsuits and id be surprised if they didnt have a go.

But, I have to say, Apple's biggest most unforgivable blunder here is the Bella Ramsey adverts back in September. Those clearly were 'showcasing' vapourware and it was clearly a simulation of capability rather than actual capability and its really wrong of Apple to do that - especially that early on using it to sell iPhone 16s and knowing that these features would be minimum of 8 months away.
 
They really should. Especially in Europe and China. Apple Intelligence was a huge selling point when iPhone 16s launched, but people in those places even not getting a single feature now.

Does this mean iPhone 16 owners can return their phones on the grounds of having a key feature cancelled? I’m talking outside of the 14 day usual Apple Store return window..
Don’t ever buy a device on the promise of a an unreleased feature. It may or may not ever see the light of day.

Perhaps I am not seeing the same Steve Jobs you are.

I'd have to go dig up links to articles, but the Steve Jobs I am familiar with told customers to get bent whenever Apple did something customers didn't like. The most famous, "You're holding it wrong!" in relation to the iPhone 4.

Steve had a vision. And customers were not going to get in the way of his vision.

Your problem isn't with Tim Cook, whom Steve hand selected for the purpose of PROTECTING Apple by being a caretaker. Your problem is with Jony Ive, the lead designer for the period of time you claim Apple lacked innovation and was lagging the competition.

I'm no great fan of Tim, but Jony Ive bears a lot of the responsibility here.
 
None that will hold up, as it wasn't stated that it shipped/was sold with those features.
Everything it was promoted as having, it has already.
Including contextual Siri which it was marketed on by Bella Ramsey on TV?

The feature are not cancelled… they are delayed. Apple wants to make sure that the features are at a certain quality level before pushing them out. Apple intelligence and improved Siri are not being scrapped… they Need additional time to perfect the basic functions.

There are already many Apple intelligence functions and features available… Siri is also available, it’s just that the next generation Siri is slightly delayed

It was marketed as "coming later" and delays do and will happen - the features it was said it came with, it has already.
Reminds me of the "built for Windows Vista" stickers.

They covered their behinds but that doesn't make it right.
 
Opinions abound! Are any of the above posters practicing attorneys?

Between Siri and AI issues, Apple has a lot of egg on their face, they may will quietly take back a device if asked to do so.
