I'm a big iphone fan too.... But the phone has not lived to its expectations.... And if someone like this doesnt make an issue then apple as such is going to go worse and release defective phones and softwares. Even though nothing is going to happen atleast they'll know they are going wrong ... we might get the fix soon...

Its a great piece of equipment but gotto be straightened up a bit before it become THE phone...

I could care less about monetary damages, but if it leads towards a quicker resolution of the issue than I think it is a good think that it was filed.

Actually it will likely be a hindrance as now Apple's legal team is going to need to sign off on any changes/upgrades to protect them from culpability and other issues.

This is beyond dumb.
 
How was it being swept under the rug?

One example, ok, maybe two..... Internet forums like this one and Apple discussions deleting relevant threads to the fundamental problem at hand.

Just for starters.....

To enlighten yourselves even further, read the original posters web site post, go there and read what Apple has swept under the rug in the past.....according only to an Apple user reporting what an Apple manager told him.....

LOL... that was funny, at first. Then I realized....well I'll keep it to myself. Don't want the Apple powers to know what I think. I might get banned.
 
Have to wonder why people didn't avail themselves of the 30-day trial period and return the phone.

If you have subpar 3g performance during the 30-day trial period, and decide to keep the phone -- you are basically saying that the performance issues don't merit returning the phone and/or switching providers.

Well some people paid ETF to get an iphone. Others may have had old grandfathered plans with really great features and prices that you just can't get today. The inclination for these people would be to hold onto the phone and hope the problem gets fixed because otherwise they just screw themselves over if they return for a refund because they end up with less than what they started out with and nothing to show for it.
 
Honestly, in the first week or two, i was getting sick of people b!tching about 3G problems this, 3G problems that....(many people felt this way) but now that i have experienced issues myself and forums are getting inundated with complaints, it's clear that there's obviously a real issue here that cannot just be chalked up to a "quit b!tching there's nothing wrong with your phone and if you think there is go return it" attitude.

While it certainly hasn't made me want to go return my iPhone, it has made me extremely frustrated at times. Am I satisfied with my product? Absolutely. Is it up to Apple's usual quality standards and is it performing as has been widely and aggressively advertised? Nope. I can deal with the intermittent 3G issues, which works well 80% of the time, but when my Dad's BlackJack II has full 3G bars and my iPhone is jumping from 1-4 bars intermittently, something's gotta give here...

Never thought of that. I was more thinking of the total time in man hours the world has spent trying to get their phones to work as advertised.

I'm actually interested in this. If the outcome is an end to Apple putting the cart in front of the horse then I am all for it.
 
There's no way this will have legs, because Apple hasn't really had a reasonable amount of time yet to fix the problem. And I'm pretty sure they'll eventually get it fixed, it's in their own best interest to do so.
The reasonable time to fix problems like these is BEFORE the goddamn product is released. We should expect nothing less, and all other cellphone manufacturers live up to these expectations, so when was Apple granted a special license to use paying customers as beta testers? We already have that attitude in software. We don't need it in hardware too. This is becoming a habit with Apple, they're getting complacent because Macheads lick Steve's feet even when he kicks them in the face.

Hmm. I think that's distinctly arguable in court, especially given two firmware releases have been done in that time.

A very quick Google turns up reception issues with the Nokia E72 and Blackberry bold, among others. This definitely isn't a problem unique to Apple.

To me, there is some truth to your argument. Recently, it seems products are released too soon, before the bugs are identified and solved. It gets released anyway, all in the name of greed.

That being said, the specific issues with the iPhone may not qualify for a class action suit. Perhaps some of our members with law degrees could help. ;)

Look - I've had up and down issues with 3G data on my phone, but ultimately there's really not that much to complain about. If anything, I think the media has been blowing these problems out of proportion. The only reason it's getting any attention at all is because it's Apple, and people love Apple - it makes for good controversy.

At least she got the media to bring attention to the iPhone's 3G problems AGAIN before it got swept under the rug.
 
I don't imagine this is about getting money from Apple at all. This is purely about generating media coverage over the iPhone 3G's issues. She doesn't want to take the easy route out and return it - she wants an iPhone that works! We all want Apple to devote additional resources to fixing the problems with the iPhone and make it the product we all want to be proud to own - so good luck to her, I say - it takes some front (I was going to say "balls" but realised that didn't really work) to take a company like Apple to court!

Nothing says "I mean business" in America more than "I'll see you to court". ;)

P.S. There's not really any "high expectations" in expecting an iPhone to work as a decent phone with good coverage (as good as other models) and doesn't drop calls!

I had 3G issues with my Samsung Blackjack2. Actually the day i was waiting online for my iPhone, i was trying to use my Samsung to go online to this forum and no luck. It just hung. I tried a few times. Standing just in front of the AT&T store!!! So, no, it's not a problem with just Apple's phone. I also had trouble in NYC with the 3G Samsung. I could not get online. The problem i see with the iPhone is it doesn't seem to find 3G first. I've been doing something differently over the past week. I go into settings and turn 3G off, then back on and it's there. 3-4 bars and it works great.
 
So what happens to this lawsuit when Apple releases the 2.1 update that is supposed to fix this issue in September?
