Poor logic. I've had pneumonia, does that make me capable of diagnosing another person with pneumonia? No. And just to be clear, OCD is described very generally for a reason, thats because it comes in all different shapes and forms.

And again, its actually 100% irrelevant because even if OP does contact apple, he doesn't even need to mention his sickness to get the phone replaced. Dealing with Apple is easy; send an email to the right person and it doesn't matter what your problem is, it will be taken care of.

And where did I mention buying a used iPhone? I specifically said sell his old phone AND take a loss; as in cover the difference between what he got back for his used, and what it costs for a new phone.

With all of the talk in the news and inter-webs, I know for me, if it smells like a fish, it probably is fishy. Posting fishy stuff in on-line forums tends to get the members irate. You get stuff like this: http://forums.imore.com/iphone-5s/274323-iphone-problems.html

The OP bought a brand spanking new phone, says it wasn't used for three weeks and then when finally used discovers the white color could send him to the hospital. It's not logical to me as when I bought my iphone 5s you couldn't pry the phone from my hands for 24 hours. However, I guess it's probable.

The bottom line is anyone who doesn't like their purchase after the exchange window has expired, should send an email to the office of the CEO, starting their position and ask for a phone exchange. Squeaky wheel always gets the grease.

What a perfect example of the stigma and intolerance attached to mental illness. I'm sorry that you had to go through the abuse leveled at you, Polarioid. My wife suffers from a non-apparent disability and has suffered from the same kind of abuse for most of her life. "It's all in your head", "You're making it up", etc.

You people should be ashamed of yourselves at the disgusting behavior in this thread.

*you're. You are.

*Apple. Capital A.

I would not debate or belittle the op's condition, and I am sympathetic to uncommon, but no less debilitating triggers.

However, I think in some cases a sufferer has to appreciate that their condition is not a carte Blanche to always get what they want. Loud chewing drives some people nuts, but we cannot demand that others stop eating.

Sometimes you have to forge your own solution. And in this case there are plenty of solutions for the op, they just aren't the "everyone bends to my needs" type.

Yes it sucks that he has to take a bit of a time/money hit in selling/rebuying, but painting everyone else as the bad guy is a poor way of handling life's hurdles.

And anyway, let's think about this. I know that if I let my old obsessive compulsive impulses get the better of me, I'd be absolutely itching all over at the very thought of trading in my bought-new iPhone for some other stranger's on Craigslist. Where the heck has this used phone been? I have NO idea. How many teeny tiny scratches has he put on it? What else did his hands touch before he touched that phone? Has it been in the bathroom? Near the toilet? ...IN the toilet??? What if the previous owner took inappropriate selfies (or worse) with the camera? Would I really want to take pictures with a camera that has seen... who knows what? YUCK!

No. Thanks!

And I'm a guy with a white iPhone who ISN'T being made physically sick by it.

iPhones are made by humans who are practically slaves in a relatively poor country. Your house was built by filthy construction workers. The UPS driver just handled his package while delivering yours.

It's amazing how people can compartmentalize. An iphone isn't an apple from the garden of Eden.

For those saying whine until you get your way, learn to take responsibility for your actions. The OP made a mistake. It's the OP's responsibility to correct it since it was realized outside of the return window.

Entitlement seems a much more pervasive disease than OCD and possibly a more apt diagnosis in this case.

I can't due to my disability, I need it naked phone, i can't have anything on it or I feel sick, due to OCD

I know this is going to come off as callous but no. If you have such an issue with OCD that you become physically ill if things aren't a certain way, that is not Apple's issue. That's yours and you need to go see a therapist.

I also find it a tad hard to believe that you have such an extreme level of OCD and yet it took two weeks of staring at a 'bad' phone for you to get sick. I suspect their lawyers would find it hard to believe and hard to find anyone to back up your claims.

And I find it hard to believe that you have such an extreme case of anything that you just have to have an iPhone.

----------

What? I chose white instead of black to try something new, i never knew it would be such an issue, yes I had 14 days to return but it didn't start up straight away.

I have diagnoses thanks and very offended to be called a liar, I have support at uni, doctors letters and gone through a lot of crap cause of them so please don't be so rude.

Then go find a lawyer, sue Apple and Three and demand at they refund your money AND give you a black iPhone that you so desperately have to have (and be sure your doctors are very firm that you can only use an iPhone and exactly why).

When you win you'll be a hero to all the folks with disabilities for standing up to these two heinous companies and their ridiculous anti disability policies

I have a disability card to as evidence I usually carry around, it requires doctors evidence to actually get one - id happily cover the re stocking fee if its under £50.

Not good enough.

I actually have some knowledge of this.

I want to see a letter from your doctor, on his letterhead (What kind of doctor is he, license#, office address + phone number), then he writes why a white phone can cause medical conditions.

You are spending all these time with us when the one you have to talk to is Apple.

I know but you'd think they'd maybe try help or something - not asking for much really

Actually you are. You are asking to be treated special simply because you think you have a special case.

You forget however that in many, if most, countries Apple is legally mandated by a variety of consumer laws to treat everyone the same. They are required to set up firm policies and enforce them equally. You signed two different contracts, one literally with your carrier and one at least by implication when you paid Apple which dictate the terms of both companies policies. Now you are asking these two groups to let you break those terms because you feel you should have that right.

You think that is no big deal, but in fact it is. It's a very big deal. And if you truly believe you have a valid and legal reason for demanding that exception then fine, but do it via the proper channels of a lawyer etc. Not posting on message boards etc where you come off as a whining 'special snowflake'

----------

Solving the parallax issue costs them nothing.

Particularly since they didn't do anything special to help those folks. They refunded those that asked for it during their valid return period and put in a software toggle (during the beta period as I recall)

Again, I know i had 14 days but it didn't affect me at the time bad enough,

Wait a sec. You said to several folks that the issue didn't occur until after the 14 days which is why you didn't swap it on time. Now you are saying it did but you ignored it. So, knowing you have this extreme OCD that makes you physically ill such that you might pass out and give yourself a concussion, you ignored it.

That makes it your fault.

Apple has 30 day return policy for iPhones, unless you bought it from 3.

Apple's general return period is 14 days but yes in some areas (like the US) on phones they have a longer one.

The carriers are between 7-14 depending on local legal requirements.

And if you bought it from a carrier that is who you must go to, it's not Apple's responsibility to enforce consumer laws for the retailer. And the terms of their warranty in basically all countries that don't legally require differently is you receive EXACTLY what you turn in. Which is why no color or size swaps, model swaps etc. Why if all the parts aren't Apple, it's a no go etc.

In some countries Apple may not be allowed to interfere with a consumer issue between a customer and another company. Thus why if they weren't the retailer, warranty laws as the manufacturer kick in. And color isn't a defect issue so there are no grounds for them to step in. And goodwill is not legally required. They tried it for a while and consumers abused it like mad, so no more.

Poor logic.

To you only.

And again, its actually 100% irrelevant because even if OP does contact apple, he doesn't even need to mention his sickness to get the phone replaced....

This and the rest of the response makes it clear you haven't been keeping up with the OP's shennaningans, or the thread. Not worth respoding.

forget it, just let this thread die out - doesn't matter but if someone else was having problems id try help them if you think I'm a liar don't post but why would I lie and make a big deal about this?

You bought the item.
It's up to you to avoid using it. The item is in perfect condition, and the seller isn't responsible for misuses on customers' part.
Apple has all the right to deny the exchange. We can't help you.

I have always had black iPhone, but recently got a white and it is affecting my disabilities causing me sickness, headaches and dizziness.

I have spoken to Three and Apple but both have refused to simply exchange white for black.

I am shocked that both companies refuse to acknowledge this issue and seem to put money above their customers health.

I was not aware of the issue un till after the 14 day swap period, so basically it is my fault.

Apple has only said I should stop using phone, yet I need it daily for my disabilities.

Thanks Apple and Three!

I may come across sounding callous and ignorant, but I'd like to learn - what medical condition do you have that causes that to happen to you?

I thought I heard it all but I was very, very wrong.

OP if you have OCD that bad you probably shouldn't ever get out of bed or ever buy anything. I am amazed you can even function in society with OCD that bad.
