I want to comment on the engineer though: he's an idiot. A complete idiot. I agree that "real world testing" requires the real world, however when you're carrying a prototype phone like that for a company KNOWN to be obsessed about secrecy, for the love of all that's holy, don't go out and get smashed. It was flat out irresponsible.

Nowhere in the report does it say Powell was drunk that evening.
 
I would think that the possible rewards that could come from Apple by shutting up, returning the lost prototype phone to them, and signing an NDA would be worth more than any money that any publication would pay for it.

He wasn't carrying a cell phone. He was carrying HIS JOB. When I go out with my laptop or any other expensive device the FIRST THING I do before leaving is check to make sure it's still with me. I'm intelligent enough not to go anywhere that my judgement may be impaired with really expensive gadgetry.

He wasn't smashed. You are making that up.

It says in the long essay search warrant paper, that Sewel or some Apple security guy said the phone didn't have a value as it was so. important. He said it was priceless or something among those lines.



But if Apple considers the prototype to be priceless, it shouldn't go into a bar where the engineer will get intoxicated.

This is abundantly obvious to most of us, but the phone cost Gawker 5k to buy, and probably cost Apple a few million in lost sales.

Actually $8500, plus a bonus if it was real. So much for the "we didn't know it was Apple's phone" defense - they agreed to pay more if it was.

Not sure if it was $8500. It said $8500 total, $5000 in cash and didn't know where the other $2500 came from. At least one of the numbers is wrong.
 
I wonder if the phone had a kill switch or they were able to kill it cause the SIM was still in it.

Priceless prototypes shouldn't be used in a bar, when accidents like this can happen. Also, Gra could still test this iPhone like everyone would, just not bring it to any dumb place like a bar.



Regardless. He should have checked his purse/bag, and or pants pockets. having a prototype that money can't buy (according to apple) should mean being X-tra careful. If i had something like that, it would be in my pockets, hand, or at home safely hidden. Def not in a bag.

What is wrong with you? Blaming the victim seems to be your only modus here. That's all you can bring to the discussion?
 
Gizmodo = Internet Web Based Magazine NOT a tech blog?

I thought they were just a blog. This distinct designation could have some interesting outcomes in how Gizmodo.com and the staff is treated during this issue. In mind opinion, the folks at Gizmodo.com lost any sort of freedom of speech protection via being a reporter when they bought the iPhone 4G. The outcome of the processing of these felony charges will be interesting establishing better definitions between blogs vs. news agency.
 
Wow, why this warrants such a deep investigation is beyond me. At the end of the day, it's a stolen phone. Police resources would be much better spent on murder/rape cases.

Apple should have got their own private investigators (probably did). The Police clearly only went to such lengths as this is an unannounced Apple product.

For the actual testing, technicians frequented all the places where consumers go: office buildings, subway platforms, stairwells, elevators, crowded bars, sprawling suburban malls and congested city streets. They also showed up incognito at Apple and AT&T stores.

As for trusting young men with things like this, an iPhone prototype pales in comparison with some of the very expensive and dangerous military gear that much younger soldiers, sailors and airmen are entrusted with. And you know what? They get a LOT drunker than Gray ever will ;)
 
Do you bring your cell phone when you go places? Honestly, that's quite an unintelligent thought.

Would you be mad if your phone was stolen/taken apart/an then leaked all over the Internet-oh ya and did I mention this device was priceless. Yea so it was stupid on there part. I agree withe first guy.
