The biggest risk to democracy and free markets is if the government (i.e, the FTC) decides to get in the way and block the deal. Given the people in power, I would not be surprised if such efforts were made.

He is proposing making the content moderation code open source. All moderation will be publicly viewable as a record of the content. All legal speech allowed.
Content moderation is people, not just code. And no matter how detailed any list of rules is, you'll always have people making subjective judgements on what to keep or remove.
Spam is legal speech, and Musk listed removing it as one of his top priorities.
It’s ironic that a popular counter-argument to censorship a few years back was that social media platforms like twitter were private companies and critics were welcome to create their own alternatives if they didn’t like those policies.

Ideology-based moderation is most certainly censorship. Free speech protects speech you find detestable, which is the whole point. Why would you need to protect speech that everyone already supports?

When content moderation done by either AI or a human is recorded as a record of the content, the community will be able to assess if it was fair or not and provide feedback. When moderation is done by AI, the community can be assured that it is fair by having access to the code.
