As part of its ongoing legal battle, Epic Games is now seeking testimony from Apple's former iOS software chief, Scott Forstall.

Forstall left Apple in 2013, in what was widely reported at the time to have been a forced exit, largely because of the botched early launch of Apple Maps. Since then, Forstall has kept a very low profile and has only made a few media appearances in the past few years, choosing instead to focus on Broadway production. Epic Games now wants to ask Forstall some questions, given his involvement around the launch of the App Store, to use as potential evidence for its case against Apple.

According to court documents (via FOSS Patents), on Decemeber 15, 2020, Apple offered to depose and later represent Forstall. Epic alleges, however, that Apple is now stating it never offered the deposition and that Apple "kept promising it would provide a date for Mr. Forstall's deposition but did not."

Epic says it didn't proactively attempt to reach out to Forstall itself, given Apple's indication that it would handle the logistics and planning of the deposition, according to the court document. Both Epic and Apple agreed to a tentatively scheduled deposition for February 11. Ten days earlier, Apple admitted that Forstall did not respond to its request to appear, according to Epic.

When Epic asked Apple for specific information about Forstall's whereabouts, Apple provided a PO box and Twitter handle, according to the court filing. Apple initially stated it did not have the authority to provide Epic with Forstall's phone number, but then later said it didn't believe it had that information in its possession. Epic continues to allege that both parties agreed that a deposition may occur after February 15, and that Apple set a deadline of March 10, 2021.

Epic says it is now "attempting to locate Mr. Forstall." In response, Apple says that it "does not object to a deposition of Mr. Forstall in advance of March 10, 2021," but reiterates the fact that it plans to represent him in the deposition, and that it cannot compel a former employee to take part in the ongoing legal dispute. Apple says that it will work "collaboratively" with Epic to resolve the issue, but says that Epic "cannot hold discovery open indefinitely while it seeks to locate, serve, and depose another witness."

Epic believes that Forstall could be of use in its ongoing battle with the Cupertino tech giant because of his involvement around the launch of the App Store, the center of its lawsuit. Apple may be reluctant to have Forstall testify, however, given the rocky departure he had from the company, and any form of deposition would be a test for Forstall's loyalty to his former employer.

Epic now has until March 10 to locate Forstall and seek his agreement to appear for a deposition. Whether he agrees or not, Apple CEO Tim Cook and SVP of Software Engineering Craig Federighi are set to testify. A judge ruled in December that both executives will need to appear for a deposition at the request of Epic.

The two companies are preparing to battle it out in court in a hearing currently set for July 2021, which will mark almost a year since the whole dispute between Epic and Apple began.

This is purely anecdotal evidence but now and then I hear my kids talk about games with each other or their friends. This used to be about Fortnite quite often. I haven't heard them talk about it in months ...
The circle of tech - my 8 year old has started playing it with his friends and they’re obsessed with it.
He gets limited playing time and it’s been stressed I won’t be spending extra money on it.

Scraping the bottom of the barrel it seems, EPIC is struggling.

epic believes that “Enemy of my Enemy is its friend”.

epic is hoping the term oil between Cook and Forstall still has a seed or has germinated in Forstall. Lol

they dot realize the man is happy outside of tech and still helps others in tech. He’s far beyond Apple now and has matured.

so I agree Epic is epically reaching here.

so what do you think of the Apple Watch and it’s industry leading tech and market domination? Consider FitBit, Sony’s smart watches have left the industry when they pushed it into the mainstream and still anything Google is a failing hobby.

Blinders are tough. But it’s not the topic so the bean counting and prowess of proper supply chain management is what Apple NEEDED to compete and be healthy. Also the current and former CFO’s are killing it for Apple and leading the entire tech industry.

The App Store is still a sound alternative to what Epic and others like FB are in a consortium complaining about. They want their greedy policy and ideas to replace Apples

akain to how government can justify old laws for the sake of getting new ones passed.
 
Epic Games could always hire a detective instead of asking Apple about the contact details of a vice president that left the company more than 10 years ago. He left the company as millionaire. He can be anywhere.

Apple offered to the represent him. So supposedly they are in contact with him. We just found out that they seam to be having difficulties in finding him. He must be hidden somewhere. Hehehe

I don't think it's the alleged felony (though I love that line ) ... but for launching Apple Maps as an alternative (financial and integrated use) vs Google Maps.

yes the implementation was horrible there were a LOT of mistakes. A LOT. But integration into Apple Contacts that had addresses was there from the beginning (lack of providing private map searches or map travelling or location data to Google also was there too - BIG win for Apple and all of us users).

So ... because of the complaining ... Cook asked for Forstall to state a public apology.
I agree that Forstall should NOT have done so for the following reasons:

1. Forstall didn't do the entire code himself - he's not responsible for everything within each line of code. IF he was then Federeghi SHOULD have been kicked out of Apple for launching not 1 but 2 major public macOS releases with SUDO having NO PW! That's a entire computing system compromise not a map showing to turn off a bridge (common sense drivers would never do that, and nobody did, no lives lost or injured).

2. Apple Maps would NOT have been implemented in iOS without it being shown to Cook and Cook giving the final approval before it was implemented and shown in WWDC on it's debut. So yes Cook is JUST as responsible for the final product on it's inaugural launch and subsequent years as HE approves it's updates before being implemented.

Seems like Cook didn't like Forstall for not kissing his but like Federeghi does AND because Forstall was rumoured (him being fired does show major credit to the rumour potentially being more true) as a potential runner for CEO when Jobs was still around prior to his last operation. I hope we all REALLY find out - or maybe it was Forstall jokeying for CEO within and Cook and the board didn't like this and waited for an excuse to oust him. But the real issue at hand is Federighi didn't work well with him: I'll put money on the real truth that Craigs coding skills and OSX and iOS knowledge was not as deep as Forstalls.

We know what he was referring to, but he suggested apple would bribe him to provide false witness testimony.

Why would Epic do that when it would cost them money? I think they are hoping Apple will do it, and that it would backfire on them.
