You are right that if Apple found out they would likely ask for the money, very strongly! However, keeping it may well be theft and selling it on would be more serious, so they could call the police if they wanted, but that may be unlikely.

It's up to you. I'd call Apple if I were you, but I'm not going to yell at you!
 
Ignoring the moral majority for the moment, if you were planning on keeping it I would wait at least 1 month without even opening the package and see if either Apple or the courier company contact you about it.

If I were going to sell it, I would sell it to a friend, cheaply and make it totally clear to them what the situation and possible consequences are.
I know plenty of people who would snap my hand off for a cheap iPad.

Personal experience: Ordered a Kindle off ebay a few months ago and it would not register, contacted Amazon in the US (I`m in the UK) and the woman I spoke to confirmed it was part of a stolen batch.
Ebay told me to return it to the seller at MY expense then contact them again when the seller (or thief!) had recieved it back.

Sod Off Ebay. Despite not being able to register it I have been able to use it perfectly using Calibre and it`s been in use for months now.
Amazon have had their insurance payout and Ebay must be on a different planet if they think I`m sending it back.

DON`T sell or otherwise dispose of it until you are sure Apple won`t come looking for it, which could take weeks or months and they are sure to notice the loss at some point and that iPad inc. serial number WILL BE associated with YOUR name and address on their system.
 
My guess is it has already been written off by both Apple and FedEx. If it is returned they probably have no protocol for putting it back on the books, and would rather you not even contact them at all.

They have both probably been compensated by there insurance companies.

It all comes down to the cost of doing business, which is part of the original cost of the product, which is ultimately passed on to the consumer.

If the OP signed for the delivery then both the courier company AND Apple know that the device has been delivered to that address AND SIGNED FOR.
Insurance companies will not just pay out willy-nilly without at least performing simple checks.

Be Careful OP.
 
Same thing happened to me with an Amazon order made of books a few years ago. I didn't send the other pack because I had basically opened the box not knowing what was inside. Well, I still have the books and I still feel bad about it that I want to fix somehow but don't know how. You should contact Apple and tell them and see what they do, they might actually let you have it, and then you'll be much more relaxed. If not, you still have yours.

FedEx also knows they lost it and have already setted with Apple for losing it. Apple knows they settled with the OP by sending him a new one. At Best FedEx owns it, but since they delivered it to the OP after they found it he should consider it a gift from FedEx to keep him in their good graces. Clearly they don't want to have to store found packages forever even if they have settled for them. Even auctioning off recovered packages means they would all have to be opened (to verify what the contents are) and pay staff to take care of it. All costing them money that they didn't have to come up with by simply sending it on to the original destination. Any FedEx employees want to chime in here?
 
Then the iPad in question is now the property of Fed-Ex`s insurance company and Fed-Ex have now located it, hence the delivery.

You really think Fed-Ex (or Apples) insurers are just going to say : OK, No Problem, just keep it dude!

I never said DON`T Try to keep it, just be careful if you do, it may bite you in the ass many weeks from now.
No-one else on here has anything to lose, you however may end up having to pay up for an iPad you never really owned and have now sold.

Once more for the Cheap Seats: Not saying Don`t Keep It, just saying Be Careful if you do.:rolleyes:

The screw-up wasn't your fault, so keep it, sell it, whatever! :D

In all seriousness, I think the best thing to do, is to keep it for 4-6 weeks and don't open it. If you hear nothing from either Apple or FedEx in that time, then it's fair to assume it's a casualty of the system, and should be yours to do with, as you please.

...why don't you contact apple, tell the that you got the "one you wanted" delivered and see if they'll let you return the other unit paying the difference = win, win for you and apple!

Call amazon and tell them what happened they will let you keep them..and you will feel better.
 
When I was younger I'd probably want to keep it. Now that I'm older and have a few years under my belt and have a better grip of right and wrong there'd be no question I'd return it. Not saying I'm an angel and not saying that for a minute I'd have a gimme gimme gimme moment but right is right and wrong is wrong. Hell if I go through a drive thru and get the wrong change I give it back.

If apple would have done the right thing by immediately shipping me out another one right when it was deemed lost..then it wouldn't even be a question..but I originally ordered my iPad 7 minutes after it went on sale...their carrier lost it and they were making me wait 5 more weeks..that just p&$$Ed me off...so then I had to stand and wait out in the cold and rain to get one..and I didn't even get the exact one I wanted..apple has already been paid by fed ex....

Yes..I am trying to rationalize it :).

just for this I would keep it, don't sell, don't claim warranty, just enjoy it for your self. After warranty is gone, sell it if you like...

It would be interesting to check the tracking number and see where it was held up and if there is any note of the package being reported lost.

I can not believe how many people in this thread have said this would be theft. If it had been kept it may have been dishonest but far from theft. It would be upto Apple to try to regain their property and if they ask for it back sure you should give it them but if they dont I really can not see a problem. Did Apple really not know about the backlight bleeding issue after the US release? Was it not dishonest of Apple to release a product to 25 countries world wide when the product in question has a known defect? Apple are happy to refund you but only if you ask for a refund they are not doing a product recall which would be the honest thing to do!

Just my opinion but I would have kept it and been willing to give it back if they had asked for it, in the same way Apple would give me a refund if I ask for it.

Whilst I'm happy for your conscience, merely keeping it(unopened), would've meant you doing nothing wrong as well, as it was their screw-up.
If after a certain time had passed(a month or two), you still heard nothing, then you would've been clear. If you were to have been contacted, then you still would be in the clear, as the return would've been done.
But, as long as you're happy, then all is good. :)
