I can not believe how many people in this thread have said this would be theft. If it had been kept it may have been dishonest but far from theft. It would be upto Apple to try to regain their property and if they ask for it back sure you should give it them but if they dont I really can not see a problem. Did Apple really not know about the backlight bleeding issue after the US release? Was it not dishonest of Apple to release a product to 25 countries world wide when the product in question has a known defect? Apple are happy to refund you but only if you ask for a refund they are not doing a product recall which would be the honest thing to do!

Just my opinion but I would have kept it and been willing to give it back if they had asked for it, in the same way Apple would give me a refund if I ask for it.

Dude- step back and seriously look at the situation. The word morals should not even be spoken in this context. The fact that this thread turned into an ethics lecture is an interesting take on human nature. There's too much "holier-than-thou" going on here.
 
To this day I still do not know why people come to internet forums and ask peoples advice. Most criminals get caught because they either brag about what they have done or ask about if they did the right thing. Now, I will add to this its obvious you are not a hardened criminal and probably never even stole anything, not even a grape at the grocery store but do you honestly think anyone here can tell you its ok to keep it?

Well, he didn't ask "how do I get away with it", he asked about advice what is the right thing to do. In such a situation, anyone should try to figure out what is the legal situation, what is the moral situation, what is the risk of getting caught, and make a decision based on these facts instead of doing something uninformed and possibly stupid. If you read through all the replies on this thread, then you should get a good grip on the situation. I don't think we should impress our morals on anyone, but we should definitely help anyone making an educated decision.

Someone adviced "just sell it", which is illegal, immoral, and has an unacceptable risk of getting you into trouble. Yes, someone _will_ advice to keep it. But legally, the iPad is either Apple's or Fedex's lost property, and for example according to Californian law, keeping lost property and not trying to return it is theft. And there is a good chance that it would be found out.


Called apple..of course after being on hold for over 20 minutes because they had no idea how to handle a situation like this...finally figured out where the return should go and are sending me return labels. So apple will be double dipping...getting insurance money from fed ex..and the ipad...but at least I have a clear conscience.

Which was the right thing to do morally, it was also legally safe, and there was a slight chance that Apple would have let you keep it. They probably couldn't because someone else was involved (Fedex and insurance), so Apple will be spending some time and money to sort it all out. Overall the most clever thing to do.

What is bankrupting society is that large corporations have no regard for morals and skirt the laws at every chance possible, and succeed on the belief that the brainwashed masses will "do what's right" and maintain morality. Put in a similar gray position I guarantee both Apple and FedEx would keep the "iPad" and be praised as smart business leaders.

If apple would have done the right thing by immediately shipping me out another one right when it was deemed lost..then it wouldn't even be a question..but I originally ordered my iPad 7 minutes after it went on sale...their carrier lost it and they were making me wait 5 more weeks..that just p&$$Ed me off...so then I had to stand and wait out in the cold and rain to get one..and I didn't even get the exact one I wanted..apple has already been paid by fed ex....

The fact that you feel the need to rationalize the choice to keep the iPad points to your already knowing what the right thing to do is.
 
My guess is it has already been written off by both Apple and FedEx. If it is returned they probably have no protocol for putting it back on the books, and would rather you not even contact them at all.

They have both probably been compensated by there insurance companies.

It all comes down to the cost of doing business, which is part of the original cost of the product, which is ultimately passed on to the consumer.

However, it wouldn't be the worst thing in the world to do to actually make somewhat of an effort to make both companies aware that it was delivered.

This would A.) clear one's conscience (if there is one), and B.) might convince Apple to take it off of any serial based blacklist (if there is one).

Just because you have no conscious or moral compass, don't try to pawn those same views on to others just to make yourself feel better. Some would keep it, some would not. We all know that. But you have no business calling anyone here a liar.

If Apple "double dips" at the expense of FedEx, that's an issue between Apple and FedEx. When you have even contacted FedEx about this, you have done what you could to prevent it. At least you haven't double dipped on anyone else's cost. Even though calling it "theft" is taking it too far, it would certainly be seen as some kind of misappropriation if you kept it.

Yes, and just as you alluded to, the problem is that corporations are run by the type of people who would've kept the iPad, therefore, one could technically say that this kind of thing "is" what's bankrupting society.

By the way, a note to the few here who seem to have flushed their sense of humor down the toilet some time ago, my comment about "not keeping him out of jail" was a bit tongue and cheek, hence the :cool: symbol I added. But then I guess I mistakenly thought reading comprehension was a prerequisite for forum readers.:cool:
 
same thing happened to me. New here by the way. bought a new imac, 3 weeks later fedex either lost it or sent it back to apple. each time i called it was always a different answer from fedex. apple overnighted me a new imac, 2 days later my original imac showed up and is now sitting in my living room in its box.

And of course the mindset of consumers like you that think it's reprehensible for big corporations to do it (unproven) and as a result it's fine for you to do it also. It comes down to the "it's always someone else's fault" mindset.
