Really? I am a Christian myself, but was that sentence necessary? Obviously, his lawyer wants to convince the jury pool that he feels bad about it, and while it may be wrong what he did, it's not like he bought the iPhone for $5,000. ;)

Yeah, okay...Apple is overreacting. Everyone pretty much feels this way, yes? Maybe one or two don't, but think about this: next time this happens, maybe someone will think twice before messing around with Apple and things like this.

It's like the guy that collected the cash for running the Numbers for the Mob back in the day. You'd see him walking down the street and guaranteed he would probably be carrying $20K on him at any given moment. But nobody touched him. He was as safe as if he was a baby in his momma's arms. Because you knew if you jacked him, your life wouldn't be worth anything. DAT's the Chicago way...

Sorry...lost my mind a little there. But yeah, making an example of this kid. But I suspect after hassling him, everything will be dropped and this won't go anywhere. They'll just rattle their sabers a little.
 
When I find something that is not mines I just ask for the Supervisor or owner and notify them of found object and give it to them so they can hold on to it.


Why was it so difficult for this individual who found it to ask for the manager and say "Hey someone left this off, they will probably come back for it..." Give it to the (Business owner or Manager) and move on?

This would never have even ended up in the news.

I smell foul play here.

this is why alot of kids are messed up in todays gen we never want to blame them for what they did and instead blame some thing else wether what they do or something else it astounds me really.
 
If I lose my iPhone and some guy found it and sold it but told me who he sold it to, then it's up to the person he sold it to, to give it back. It's not this guys fault for finding the phone and WAITING where he found it for the person to come back and claim it... it's the person who lost it's fault. This is crazy, this dude is 21 years old! What's Apple going to do next...
The minute the stupid kid walked out with the phone without turning it over to the manager of the bar, is intent was to steel it.

He was dumb when he quickly attempted to profit from this. Screw him! Being 21 is not an excuse. If at 21 he doesn't know that what he did was wrong, then when will he.

There's nothing revolutionary about this phone. They're not royally screwed. They're about as screwed as if the MBP prototype was found a couple weeks prior. We would have been, "wow, it's exactly the same except for this new chip that everyone knew would be in it". If anything it was a let down IMHO. Now if this was the first time we heard about iphone OS 4.0 and it's multi-tasking functionality then I would agree somewhat more with your post.
 
Once walking into a drugstore I found a hundred dollar bill on the floor of the entryway. I picked it up and went inside, walked up to the teller and told her I found a $100 bill and could she have her manager come to the counter. Once he came to the counter I handed him the $100 bill and told him someone might call looking for it. Most people are honest, this guy wasn't. He committed a crime and should be held responsible.
 
What?!?!? If this statement is true Apple Inc. has some explaining to do. A private corporation cannot go in and attempt a search without law enforcement and a search warrant. Either this is a false statement or Apple believes they are above the US legal system. Scary!:eek:

Come on. Someone from Apple showed up at the door and asked if the person was Brian. They said no. The representative said that Brian had their property can they come in and get it. The room mate said no. They left. End of story. Apple did not try to force entry or some other nefarious scenario.
 
This story is ridiculous, but one thing is really clear:

The finder did not make any efforts to return the phone. He had a friend call AppleCare on his behalf; that is all. In all likelihood, that's theft under California law.

But for the kid's lawyer to admit this much upfront makes it pretty clear that they're directing the true blame to Gizmodo and/or Chen.

Will be interesting to see what happens. I for one hope that nothing happens to the kid -- it's just bad PR for Apple -- but for Gawker Media? If they broke the law, those actions should have consequences.

What? cause people will not buy the new version, Please!!! Its one event, and noone deserves to go to jail so Jobs can have his spotlight. In the future maybe apple should not allow its engineers to take out prototypes beyond the labs. The real idiot is the engineer who took a top secret prototype to a pub.

His intentional actions (done for his own profit) deprived someone else of their property for several weeks. I know how I would label it.

Can I "borrow" a painting I found behind the loading dock of the Louvre for a while, maybe give a show where I charge admission to make a few bucks before I return it? Hey, that's not hurting anyone, right? I'm sure they'd be cool with that.

Now a prototype iPhone is not a master painting, but it could do millions of dollars worth of damage to Apple by giving away trade secrets to their competitors.
 
He should have done more to give the prototype back to apple...maybe email someone with photos or go to the apple store...something atleast...

Exactly... If it had been me, I would have gone to Infinite Loop and told them, "I got something you lost... I am here to return it, but not to you, to the Man, 'El Jobso' himself. Now setup an appointment with him, and I'll give it to him..."

Take a pic, have El Jobso, sign it and e-bay the sucker out... or ask him for the reward of a 64Gb 3G iPad... ooooh and call the press... that brings the ladies out...

I think a reasonable attempt to find it's owner is asking others in the bar. I don't see how returning it to a bartender is required by law. It's not like the bartender is the owner of the phone. As far as this kid knew (particularly at the time) it was just any old iphone. Heck if I found a new generation iphone I wouldn't know if it was an old or new version. You could show me a generation 1 right next to a 3gs and I wouldn't be able to tell you which one was the newer one if they were both in the same condition. I'm not a iphone owner (I do have a touch) and this kid that found it may not have been one either.

Why is this Apple doing evil? It was wrong for the guy to sell the phone, as if he owned it, to a tech publication, and wrong for the tech publication to pay for it and post images of it, dissecting it, etc.. That was all wrong. You can't say it's right? Like it or not, Apple is doing business in a very competitive world and they have to protect their product from the competition.
