I agree but low wages = low loyalty. No one is forcing people to work for crappy jobs in the states either... But it's not a recipe for a happy workforce...

I'm not defending worker's lower wages in China, but the country as a whole is doing better with the rise of the middle class. However, they still have a long way to go.

This is a very unfortunate situation. Not that I condone illegal activities, but this worker is likely poor and simply trying to provide for himself or his family. It is easy to look down on him for doing something illegal, but faced with similar circumstances there isn't anything I wouldn't do to ensure that my family were taken care of.

We also need to understand that as readers and commenters on sites like MacRumors, we are contributing to the thirst for part leaks and the shady practices that accompany them. Not to put the guilt trip on everyone, but we cannot read stories like this and shrug it off as if we are not part of the equation.

Does this guy deserve to rot away in a brutal Chinese prison for swiping a couple of iPhone shells? Absolutely not, but the world is a complicated place. I feel for anyone that was depending on him.

Admittedly, I don't have all of the answers about how to solve the problem. Apple does have a large role to play. I'm not sure if Charlie Rose discussed this with Cook on the second installment of their interview, but I'd really like to hear Tim's thoughts.

Excuse me, but this guy had what is a well-paying job in China. Most of the people getting low-level jobs at Foxconn come from the country side, work as hard as they can to make as much money as possible, stay in a dorm to save as much as possible, and return in their village with their pockets full of cash. That's not like a McDonald's job where kids need support from their parents, or Walmart where the company helps them to fill out forms to get more money from the state because the wages they pay don't allow you to live.

He stole five iPhone rear shells. Out of I'm going to go with 200 million. The term "pennies" doesn't even properly illustrate how little a thing this is. Should he be fined? Probably. Should he go to jail for this? No.

Yes he should.

Criminal Law of the People's Republic of China

Chapter V

Article 271 Any employee of a company, enterprise or any other unit who, taking advantage of his position, unlawfully takes possession of the money or property of his own unit, if the amount is relatively large, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention; if the amount is huge,, he shall be sentenced to fixed-term imprisonment of not less than five years and may also be sentenced to confiscation of property.

Anyone using the word "koolaid" in a non ironic way should be banned from the Internet... That's how I feel. Be original, find another word.

Being original is what once made Apple so great. Now, no matter what they produce, no matter how little the innovation or difference might be... millions and millions flock to the stores to have exactly what everyone else has.

Thinking different and being original is no longer rewarded in the Apple community.

He bit the hand that feeds. I can sympathize, but surely he's aware that for every foxconn worker inside working, there are numerous outside the walls waiting to take their place. In that situation, one must be careful.

Oh for sure... I'm not saying he shouldn't be punished. I just think that he committed a victimless crime and I'm sure his punishment is going to be far greater to him and his life than it probably should be.

I don't condone stealing at all and I think this guy should be punished. I also know that WE as readers of this site are the LAST link in the chain that fuels his behavior... so if we want to condemn him, we need to at least acknowledge our role in it... We didn't force his hand, but we sure do gobble up the information leaks.

He didn't just steal five iPhone rear shells. If anyone at Foxconn gets caught stealing five iPhone rear shells today, they will probably just get a slap on the wrist. But nobody is going to steal them today, because nobody is going to pay $960 for them.

He stole five iPhone rear shells _before the product was released_. So we don't have just theft, we also have the matter of violating trade secrets. We have unfair competition if these shells were sold to a company making iPhone cases, and other case makers had to wait for the details.

I notice some people think it's a small crime to steal corporate secret and there shouldn't be much or any punishment. They don't seem to get this is a multi-BILLION industry and every secret leak means hundreds and thousand of man hours lost to this idiot's greed.

As a business owner who works super hard and have money on the table I would put this guy in jail as a example.

It's the job of the court to classify or not classify it as such, not mine.

pardon me but you already made your thoughts on the matter when you said "yes he should" (go to jail) and you quote China law

"if the amount is relatively large, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention; if the amount is huge,, he shall be sentenced to fixed-term imprisonment of not less than five years and may also be sentenced to confiscation of property"

so based on your original post you do think a 1 penny shell is either realtively large or huge?

Hah... try again.

I assume you must be rather young.

Fact remains, these employees are practically slaves. They work outrageously long hours for incredibly low pay. Their work environments are little better than prison. Their freedoms are stripped from them and their lives perpetually in debted.

What a load of nonsense. They come voluntarily to work at Foxconn. Foxconn wages are a lot higher than what many similar companies pay. They are low compared to US or European wages, but then the cost of living is low as well. They work at Foxconn for some time, save more than 50% of their wages, and go home with their pockets full of money.

All the more impressive that the watch wasn't leaked.

Not really. Apple hasn't mass produced the watches yet, thus there's a lot fewer workers, which means the workers are even less likely to try this because they know they're more likely to be caught.

Sites like Macrumors create the demand for this kind of leak. Personally I hate having to sift through countless pictures of iPhone camera modules, home buttons, rear shells and all that nonsense just to find the one or two interesting Apple-related stories.

Whatever happens to this guy is down to Macrumors and other parasitic sites.

I was thinking this. But if sites like MR are guilty then the guilt extends down to me. I'm contributing revenue with my page visits. Is it certain that MR only reports on things that have already happened and in no way encourages these illegal leaks? Is that even possible? That's the only way I think I can continue visiting this site.

I wonder what kind of damage control Apple will have to do when this guy is executed for his crime.

Sadly true. They kill you for all kinds of **** in China... probably for even smoking pot, I don't really know.

In America, all thieves deal with is a couple days in jail and restitution and fines.

It's the kind of thing that Google would ask in a job interview. Try for yourself if you would pass.

He was paid $960 for five shells.

$960 is still less than both realitively large and huge, no jail time required

unless you include the value of hipsters hurt feelings for having their surprise ruined, than 20 years min
