The video is super short this week:

I changed my research from how to evict someone, to how to avoid being evicted, and my optimism about the case has improved. Basically, every resource in Ohio says something to the effect of, "You have two options if you are being evicted for failure to pay: pay or move out, and you should probably just move out. Any other route does not work out well for you."

Edit: I realized I may not have been clear. The case has been filed, I have a court date. At this point any further research is simply for my own peace of mind.

You guys don’t have any snow yet in Ohio? I figured by now, you would have at least half an inch or an inch on the ground. We’re already at 24 inches in for the year. (And it’s not even winter yet).:D Now, here is a serious question….. do you shovel snow in sandals?😁

Definitely follow up on the furnace heat if any adjustments on your utility bill. I Imagine if you tweak it right, (which seemingly you can pinpoint), you probably would be able to have a significant savings every month controlling how often and when it’s triggered.

And I noticed the ‘24 hour video surveillance placard’ on your window when you were making the adjustment with the plywood. I got to tell you, we have those around our house (Actually, they were ‘security stickers’ that were included with the CCTV set up), any deterrence is always necessary, especially for blind spots around the house.

I've been working with a rheumatologist and just started seeing a neurologist, on Monday I go in for a brain MRI...

We've had some snow, it just hasn't stuck around. I will do stuff with flip slops in the snow, but I also have proper boots and will wear them if I need to. :)

Thanks for the support guys, here is an eviction update, copied from a post on another forum, I had to clean up the language:

It’s so incredibly frustrating.

In my county the bailiff has to serve the person being sued. But it turns out, if they feel they’ve tried hard enough, they can just give up and not tell anyone that they’ve given up. Your case pretty much just dies at their desk.

A few weeks ago they came to the house, parked next to Leon’s car in the driveway, then walked next door, knocked on the wrong door, then left when they couldn’t find Leon at the wrong house.

So, I called the bailiffs office and they said they’d try again. I also told them that if they give me 30 minutes notice, I can be there to let them in the house. The next day I get a call, they are 5 minutes away. I wasn’t able to get home in time to let them in. I watched on camera as they knocked on the door, waited about a minute, then left. Leon walked outside to watch them drive down the street.

I call them back, we arrange and entire day for me to take off work and stay home so I can let them in. They never came and offered no explanation.

I talked to my lawyer this morning, because the court date is Monday. He was finally able to talk to someone and apparently they just gave up, and my lawyer had to pay again to re-start the process. So, yeah…

If he gets served this week it'll have Monday as the court data on his papers. But he needs to have 7 days notice between being served, and the court date. If he gets served this week my lawyer and I still have to appear on Monday. If Leon shows on Monday there is a good chance the judge will hear the case anyway, this is good. If Leon doesn't show on Monday the Judge will push it back a week.

In the meantime, there is a liquid dripping from his room into the basement, and there is feces smeared on the bathroom walls. He is partying every night, keeping anyone else from sleeping in the house, and the police are no help.

What I've learned:

2: There is a way to use a private process server instead of the bailiffs, but you need a judge to sign off on it first. From now that motion will be filed at the same time the case is filed. I talked to a process server in my neighborhood and he is totally cool with me giving him a house key, and limited access to the security cameras, so they can see when the bad tenant is home, and they can walk right in and serve them. This waiting for the bailiff stuff is for the birds.

Sorry to hear this. Hope the bailiff connect with him soon. In the meantime as you are renovating the property, couldn’t you ‘need’ to disconnect the power and heating for a bit? Might speed up the process!
 
That's terrible, sorry to hear it. Sounds like this is getting worse & worse. Fingers crossed that everything gets sorted out Monday.

I’m probably echoing what I’ve already said, but make sure you have as much documentation, photos and video as possible, and I certainly hope you pursue any civil charges that are necessary for cleanup services, damage or any other necessity costs. I know it can get expensive when it comes to civil litigation, but you have a clear case for a larger pay off to be reimbursed and hopefully his paycheck is taxed because of this.

What’s insanity to me, is how is he able to hold a job steadily as you mentioned before, and yet pull antics like this. This is clearly somebody that has mental issues, but needs to be held accountable in every way possible regardless.

I do have to ask, what possible substance/liquid do you think is leaking from his room into the basement?

I’m no longer convinced he has a job, but I won’t explain why I think that until he is fully removed from the house.

I will be seeking a judgment against him, though I doubt I’ll ever collect a dime. The judgement plus the eviction on his record will make it very difficult to find a quality place to live. In addition to that, the other tenant is a programmer and we are working together to built a VM that will scrape craigslist ads and auto email them to warn about him. So any home owners in the area that don’t do background checks will know not to rent to him. At this point, I want to make him homeless. Unlike whistlindiesel, I am NOT forgiving when it cones to stuff like this.

I truthfully feel like the worst is yet to come, especially on his last day or two. In that case, what I would do if I were you is request your local police department to provide extra patrol where they can standby when he has to be out by a certain time. I would also have as much video evidence as you can that shows any of his actions internally, obviously with the exception of a bathroom, bedroom, ect.

If you find a paper trail based off where he’s going next, [which some state government websites will actually input local updated address, if there’s like civil/divorce cases], I would definitely warn the likes of a property owner if he’s renting again.

Wow, that sucks. I would think that he's creating a health issue by smearing feces in a public place.

Sorry to hear all of this, just wish there was something we could do.I'm about 2 hours away if you need anything. Too bad you aren't in KY, I would enlist my nephew who is a Kentucky State Trooper.

Careful now. Be mindful you’re dealing with someone who got a psych disorder here while he’s in the house.

Boy, if I could just get the cops to search the room...
So…what exactly is transpiring here? The audio (Which I tried to amplify), is kind of unclear of why he’s arguing with the Hoochie mama, aside from ‘F-this-F-that’, and what’s the significance to the guy with the backpack that just wanders off? (I assume a possible dealer?).

Anyways, searching a room that is not shared commonly is really tricky, because even though you are the ‘owner’ of the residence, you personally don’t share-and/or have access to that room specifically for domain.

So for example, if you guys were ‘bunk mates’ in the same room, then you could give the police the permission required, but since his room is private, they would need a warrant AND Probable cause has to be established. (That may vary from state to state, but generally that is the rule.)

[Yes, I work in Law and have had this situation happen before.]
 
Leon, the tenant, is the white guy. The black guy is Tyler, who I removed from the house once, then had the police remove from the house the next day. Tonight Leon and Tyler had some sort of verbal altercation, the girl walked out, then Leon told Tyler to leave, and followed him out.
 
Honestly, I understand the need for financial assistance with the mortgage and the various rebuild projects.
However, I say, 'rip it up, and start over', i.e. have all tenants move out, and start fresh.

This has to be awful to deal with...surely...
