I left an $8000 body and lens at a restaurant a couple of weeks ago. The waiter and manager went out of their way to get it back to me with nothing but my credit card receipt to go from. It's called giving a guy a break after a long day.

We all make mistakes, happens to the best of us. Sure it's not the OP's fault. But this mistake can be made right.

WOW!! I would like to think if I was shooting with something THAT nice I wouldnt make that mistake. I agree we all make mistakes but some are definitely ones that invole things that shouldnt be over looked.

Besides, what were you doing with your camera out at a restaurant?:)

To the OP, they did something like this for an ABC news show- it could be a second shot at it. If so, have fun reexplaining it to them!

On vacation, it was about the fourth consecutive day of getting up early and going from one thing to another, you know how vacations are. That's why you need a vacation when you come back. :)

I was dead tired. I put the camera on the bench on my wife's side of the table. I thought she had it; she thought I had it. It happens. Especially with 3 kids and all their stuff and shopping bags and everything else.:)

But let me tell you, after that experience, I will put maximum effort into returning anything I find from now on. Those guys in that restaurant saved us from a terrible end to our vacation.

wow! thats crazy.. I do agree.. keeping up with your kids will cause you to forget a lot of things! :D

Obviously putting it in the lost and found would just mean someone would take it. The apple store wouldn't do anything. What do you expect him to do? Spend the day trying to find the careless owner? When you buy a $400 device, you really should keep an eye on it, anyway. Enjoy the iPhone. Just remember...if your sister were to lose her iPhone, you think someone would return it to her? Most likely, and rather unfortunately, no.

Obviously the lost and found would have been a bad idea.

But handing the phone to the manager at the 5th avenue store next time he's there would have been a very good idea. With the phone in hand, those guys would have probably been forced to do something about it. Like email the owner of the phone.
 
I then called the 5th Avenue store and they told me no one had called in about it, and they have no policy set in place for lost iPhone's and looking up the serial numbers to try and contact the person.

So why aren't they getting in touch with the owner? I thought they were only selling iPhones via a credit card? And possibly may have asked for an email. Personally I don't think you have tried that hard, how would you feel if you left it behind on the train? For all you know the person was rushing somewhere and turned around and remembered their iphone and there goes the train.

It's up to you though, sounds like you like the idea of keeping the iPhone rather than giving it back.
 
i totally agree with not bragging about something like this, it just feels dirty.

I mean, c'mon, the OP tried to contact one Apple store, then didn't follow the suggestion of the employee of the metro- he wouldn't put it in the box for someone else to take, but he felt it was ok to keep it or himself? Twisted logic to me. And please, the guy is not 'noble' just b/c he is giving the thing to his sister.

So do what u wish with the phone of course, but remember, someone out there is probably devastated about losing it, just as we all would be.

The 5th Avenue store had NO policy set in place for this type of situation, and told me they didin't get any calls into the store about a lost phone/

Why would I put the phone in an empty box with scarfs and gloves when the shady employee most likely would have taken it. (those people aren't paid a whole lot fyi)

As well, I am not bragging. This is the iPhone forum on macrumors, and it isin't everyday you walk somewhere and see an unopened iPhone that someone left around.
 
For some reason, it just seems wrong that you are telling all of this about this. I think this is one of those noble deeds I would keep to myself. I also think that it is wrong for you to be putting someone else down for making such a costly mistake. Shame on you!

Well, by posting this thread you have done two things.

#1- you have helped find the owner because if they check here and see this they will get their phone back. Why do I say will? ....leads me to #2

#2- You've guaranteed the owner will get their phone back because if you refused to give it back for some reason a quick call to the police for a report (lost/stolen is the same report) and apple to verify the serial numbers and you'd be charged with possession of stolen property. So I'm pretty sure you'd extend your charity that you initially began today looking for the owner.



So in a way starting this thread was (more than you know) a way to ensure the owner gets their phone back if they are in any way worthy of having the phone since they would know this forum exists if they are enthusiasts :)

Be nice and they will likely slide you a few bucks for your trouble. It's no iPhone, but it'll keep you honest. You can simply match numbers on their receipt to verify them.

Do you have all day to run around and deal with things outside your control when you already have things to do? I was busy, and I took time out of my day to do what I could. Thats the LEAST I could have done, and more than most people would have EVER done.

go back to the apple store and have them match the serial number to the purchaser. If the owner kept their receipt, they may report it as stolen and when you try to activate it you may trigger something. You'll then be telling this storyvto the police.
 
It's not yours. Take it back to the store - they can find the owner.

Well its like this. The iphone has a serial number. That number is on the receipt. When you plug in the iphone to use it the SN is sent to ATT to activate it. Using a cell phone triangulates your position. Expect your sis to be arrested for using that cellphone in the future.

This is of course only possible if the person who bought it follows through with this scenario but seeing as how they were stupid enough to lose it in the first place they probably won't.
 
Yes. To the OP, are you in Manhattan often? Just take it to the store and ask to speak to a manager. I'm sure they can contact the buyer and issue a credit if necessary. Or simply get the phone to him or her.

If you're a little persistent, you should be able to get them to do this.

Come on, the vast majority of these phones are paid by cc. And the stores always ask for your email address. Worst case, they could issue a credit to the cc.

why the hell would anyone do this? what a hassle and waste of time. if it cant be resolved without me spending money (meaning other than over the phone) then i wouldn't go out of my way to return it.

Initially I thought you had a brain and a conscience, but now maybe not so.

The reason why the lost/ stolen report is the same report is because if something is lost and not returned it is stolen since it never was turned in to the police. It is irrelevant whether or not you stole it, found it, whatever. If the report is filed and you are in possession of it, YOU are in possession of stolen property. The first thing you will be asked.... "why didn't you turn it in to the police?" You have no answer. You THINK you have an answer, you think you are going to be slick about it.... as your tone of your response seems to indicate, but you do not.

It is needless to have to point this out to you further past this post, I have three law enforcement officers in my family and furthering this discussion is only repeating the simple truth of the law.

If it is not reported, you are in the clear..... but who loses a brand new iPhone and doesn't make a police report? Chances are if you activate it, they'll simply come get it...... and you in the process.

Which judging by the tone of your response and the rolling eyes, and the thumbs down to correct information whether or not you want to hear it, might just be a worthy action since you obviously do not seem sincere at this point.

They refused to provide me with any personal information, phone number, e-mail etc.

As well, them not having a plan in place for this scenario explains two things.

People who find iPhone's DON'T bother looking for the original owner.

People don't lose their $400.00 iPhone's that often.
