Apple charged for the upgrade to 1.1.4, to 2.0, and so it's quite obvious they would charge for 3.0

It's the Sarbanes Oxley ruling. An iPod is a device for which they claim revenue AT THE TIME IT IS PURCHASED wher an iPhone is an ongoing revenue earner through payments through AT&T. It's all got to do with accounting reporting. Minor bug fixes can be free but adding any extra functionality MUST be charged.

what exactly does this mean? We cant play other in games?
 
Arg! I stayed up late thinking about the update and now its not even out when I woke up! Its like when you order something online and UPS ****s up and delays your package!

This is even worse because the package is sitting on your porch, your just waiting for ups (apple) to knock on the door and give it to you.

Returns policy

bought an ipod touch on june 8th, after 3.0 was announced for it. normally you get a free/almost free update in a case like this.

anybody hear how apple will handle this one?

Apple have a 14 day returns policy in most countries. Return your product and then buy a new one and you should get the update for free. Be quick though.;)

Of course you do!! Haha, that's exactly what I'm going to do as soon as I get it! :D As well as test out the other new features! :D

I just downloaded the 3.0 for the iphone! let me know how you touch people are doing if its available for yall yet
