Couldn't agree more. A lapse basically puts you back to square one with having to register your car again and reapplying for insurance
Here's a scenario. The guy doesnt pay his insurance and gets the phone. With excitement, he opens it ASAP and plays with it while driving to his next destination. He gets into a fender bender and now has to pay up the wooha for all the damages. For a phone? It could happen....
I have a silver 128gb plus coming at the same exact dates too. Hopefully we get tracking numbers soon!

okay I've had a order number since 8:30 Friday morning, I order at 3:50 am CT but 4:50 ET. I got my confirmation like right after then at 8:30 I got my order number and saying it was preparing to ship! My dates are still in October I see nothing in fedex or UPS. /:

In the case of what the allegations are stating, it doesn't appear to me that they are alleging that Apple specifically made any guarantees about "priority" or other such different access to available inventory than any other non-Upgrade Plan members.
Rather, they are tracking on the opposite, which is that since Upgrade Plan members literally could not have even accessed the standard allotment of available devices (at least by going by any reasonable process to acquire), this prevented members from having equal access, and by preventing such access, some members of the Upgrade Plan could be reasonably expected to incur extra costs associated with their current plan's requirements (since law tends to look at the intentions of people, it could be reasonably assumed that such lawsuit members would have been able to legally change to a different phone if they had reasonable access to the full allotment of devices).
So, we're dealing with a couple of different things here. First, the lawsuit isn't going after prioritization of devices (as I originally stated). Second, the bases of the complaint have more to do with Apple's inability to reasonably handle the Upgrade Plan process, causing subsequent fallout, which is a totally different issue.
Therefore, such a case could have a chance at surviving in court, but for different reasons than originally stated.
The question that the lawsuit would have to answer is, does any EULA stipulate that Apple must be expected to have a reasonable process in place to allow members to upgrade at pre-determined times? What if Apple provided a mechanism within a reasonable amount of time in the case that the normal process fell apart (which news reports now state they do)?
I'm also waiting on a silver 128gb plus. Silver seems to be the hard to get phone this year.
7 plus 128. I ordered early afternoon on Friday. It was just an email about my plan update. But I havent done anything since preorder. I checked my bank account but the payment is still pending. I'm hoping they start the process and ship out tomorrow.
That was a tell-tale sign when I pre-ordered my 6 from AT&T. I received updates about my plan and contract via email and text and shortly thereafter I received shipping notification.

that is nil . what matters is the number of tracking. you need to count 24 hrs after you get tracking number. emails of order or confirmation has nothing to do with it.
Just checked my online banking and there was a charge yesterday for the iPhone 7 Plus 128 GB Black, the order was placed at 1:48 AM CST on 9/9 and now the charge is gone. Does anyone know what this means? I'm sure someone has answered this before but I just want some clarification. I'm really confused about this whole process, last time I pre-ordered a phone it was a iPhone 6 and it was completed in store.
I usually get in line around 8 pm Thursday and have never been more then the 3rd person in line so that's how I know I will get what I want
I just cant be telling everyone but ill tell again yes. They are overnighted and considered high value items. so you are required to sign. but you opt it out by presign but you bite if it get lost or stolen after they scan deliver and drop it at your door step or whatever you tell them you drop your pacakge at (back door,back yard and blah blah)
That was a hold, you'll see another charge that will actually process once your phone ships.
For an idea of how AT&T process phone for delivery, please enjoy this video. In past years when I've ordered from AT&T, and gotten my iPhone on launch day, on Wednesday/Thursday is when changes started to appear on AT&T's website and when checking orders on the phone. It never shipped or moved before Thursday, which is when I typically got my shipping information.
You'll probably get it. Mine was being held since the 10th at FedEx in Fort Worth got the tracking number 3am this morning 7 plus black ordered 2 mins before preorders started on myatt app
