Your modem's data plan explicitly says 5 gigs so of course you were charged overages

As I had said, I have yet to hear of anyone getting overages or kicked off ATT for tethering with their iphone

My point is that if they are willing to do it with that, I would not put it past them to charge someone they have caught tethering..
 
I don't think I've ever seen so many people defend AT&T like this before lol Especially when it comes to iPhones.
 
Is being pregnant and going to an all you could eat buffet illegal? Your baby is essentially tethered to you, but you only paid for yourself even though its for unliimited food, one might argue that you eat way more than you normally would not be pregnant. So is the mom still a thief... or the ethics and morals arn't as set in stone as most you guys put it out to be?

its not wrong because ATT lies about giving us unlimited data

Im the type of person that would feel pretty guilty stealing, or having in my possession a stolen item, but I dont consider using mywi stealing, especially when you consider that ATT basically lies when they say they are giving us unlimited data plans...

1) Having a 20 mb limit on downloads from the app store is not unlimited data
2) Downgrading the video qaulity of youtube over the 3g network is not my idea of unlimited data
3) Having some apps on the ipad (i.e. the Gaurdian photo app) only able to function on wifi is not unlimited data...
 
Well, using MyWi is probably dishonest. Now, not offering tethering, free or for a fee when others do, the annoying dropping calls, not having service in the middle of one of the most populated areas of the planet (when they say they do), offering an unlimited plan that it is limited, etc. makes At&t hardly honest.

Sometimes laws are useless when they are not in congruence with reality.

No one has any evidence, but love to argue it does exist. Most point to the other devices in their argument, when they quote the TOS. Anyway, this has been beaten to death in the forums.

Not so far, according to Zach Epstein over at Know Your Cell. He’s pumped 31GB of data over AT&T’s network over the past few days, trying to see at what point Ma Bell will cut him off. They haven’t yet.

“If I can hit 100GB without being shut off by AT&T, I think it will be safe to say that users can consider the $29.99 iPad data plan to be “unlimited”. Considering I’m currently at six times the 5GB soft cap placed on smartphone data plans after just two days of usage, things are looking good,” writes Epstein.

I'm not complaining. Comprendo? You people act like I'm the first one to come up with the soft cap idea. Get over yourself.

Perhaps 'complaining' was a poor choice of words, but I've seen you quoting the cap as gospel all over this forum. The other day you even proclaimed that you paid for unlimited data with a 5 GB soft cap as if it were something written into your contract that you were entitled to. I just wondered if you had any evidence for its existence.

I also fail to see how anything I wrote implies that I need to 'get over' myself; is it your opinion that the mere act of questioning your 'facts' is proof of narcissism?
 
the unlimited iphone data plan from att does not have a cap. It is truly unlimited. Only the tethering plans have a cap. Also they cannot charge you for data used while tethering if you are caught. They can cancel your data plan and make you sign up for the correct one though. I used 30 gigs a month for 2 years while tethered with my windows smart phone and never had an issue. Simply don't go to sites that you would never go to on your phone and they have nothing in place to flag you activity.

I personally don't consider it stealing as I am using no more data while tethered than I would be by using the phone. i am simply viewing it on a larger screen

Not by any means. I didn't quote any contract stating the 5GB soft cap. I've simply regurgitated the same useless information spewed out around here. If you truly want to locate the origins of this "myth" then perhaps you need to look elsewhere. I was not the first to write such garbage and I assure you I will not be the last. A simple, albeit cluttered, Google search will fully support that this it is widely assumed that there is a 5 GB soft cap on the unlimited data plan. Surely you can agree with me there. I'm real quick to admit fault and error on my part, but I don't think jumping on the 5 GB soft cap bandwagon is at all a crime ... I think we've already established (or the jury in this thread has) that I am a criminal. ;)

I know you are violating terms of service, but would you consider jailbreaking your iPhone to use the MyFi app stealing? Stealing from Apple? Stealing from AT&T?

You can violate your TOS till the cows come home. It is certainly not "stealing". It's your hardware to do what you want with. I know that seems weird in the twilight zone that Jobs has created over his paywall garden, but don't worry - you are completely innocent :).

On this subject, there were threads here recently complaining about posts regarding iPad jailbreaking - saying that it was basically carried out by people aiming to run pirated apps. That's an insult to anyone who wants to use their hardware as they see fit and install apps that rely on a "jail broken" OS. Maybe we should do some revisionism and reclassify "jail breakers" as "freedom fighters". The only jail is in your mind. If you pay for it, it is yours.

Smartphone/BlackBerry Plans: Smartphone/BlackBerry plans may ONLY be used with AT&T-certified RIM BlackBerry devices, and smartphones for the following purposes: (i) Internet browsing; (ii) email; and (iii) intranet access (including access to corporate intranets, email, and individual productivity applications like customer relationship management, sales force, and field service automation). Data Services sold for use with AT&T RIM BlackBerry devices, and smartphones may not be used with other devices, including but not limited to, Personal Computers, PC Data Cards and the like, either by tethering devices together, by SIM card transfer or any other means.

and what is the legal penalty for this? Personally what you posted doesn't affect me as I'm not in the US and use MyWi for my own nefarious uses, but I'd like to know exactly what it is I'm stealing and what constitutional law I'm breaking. If I'm "most definitely stealing" then please provide evidence.

Most definitely not stealing. It's a TOS violation. Stealing is a crime, punishable by means of law. Violating a TOS is a civil matter, theybcan terminate your service, or sue you for breach on contract. :)
